HomeMy WebLinkAboutCC ORD 1987-1907 REZONING CERTAIN PARCELS OF REAL PROPERTY PURSUANT TO TTHE LAND USE CODE (GP-4-86/ZC-6-86 AND GP-5-86/ZC-7-86)ORDINANCE NO. i9e/ AN ORDINANCE REZONING CERTAIN PARCELS OF REAL PROPERTY PURSUANT TO THE LAND USE CODE OF THE CITY OF NATIONAL CITY (GP-4-86/ZC-6-86 AND GP-5-86/ZC-7-86) WHEREAS, pursuant to the terms and provisions of the Government Code of the State of California, proceedings were duly initiated for the re zoning of the parcels of real property, hereinafter described, and for the amen dment of the General Plan of the City of National City; and WHEREAS, pursuant to legal notice, hearings were held by the Planning Commission of National City and also by the City Council of National City, and all persons interested were given the opportunity to appear and be he ard before said Planning Commission and City Council; and WHEREAS, the Planning Commission of National City has regularly and duly certified to the City Council its report and has recommended such rezoning and such amendment; and WHEREAS, the City Council found that on the basis of the Initial Study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment and adopted p a proposed Negative Declaration which addresses both said General Plan amendment and rezoning; and WHEREAS, the City Council finds the rezoning consistent with and necessary to implement the General Plan; NOW, THEREFORE, the City Council of the City of National City, California does ordain as follows: Section 1. All protests, if any, against said rezoning and said amendment to the General Plan, and each of them be and hereby are denied and overruled. Section 2. That all the real property described below is hereby rezoned as follows: From RM-1-PD (Multi -Family Residential -Planned Development) to RS-2 (Single -Family Residential), for approximately 0.56 acres of lo cated ocated on both sides of Twentieth Street, west of "N" Avenue, and excludingthe most southwesterly parcel, and for adjacent street right-of-way, as more fully described in the legal description attached and made a part hereof as Exh ibit "A" Case File No. ZC-6-86; and From RM-1-PD (Multi -Family Residential -Planned Development) and RS-3- PD (Single -Family Extendable -Planned Development) to RS-2 (Single -Family Residential) for approximately 1.09 acres of property located on the west side of "N" Avenue, approximately 135 feet to 300 feet north of Roselawn Street, and for adjacent street right-of-way, as more fully described in the legal description attached and made a part hereof as Exhibit "B" Case File No. ZC-6- 86; and From ML (Light Manufacturing) to CT-PD (Commercial Tburist-Planned Development) for approximately 1.36 acres of property located immediately south of the trolley station, west of Wilson Avenue, north of 24th Street and east of I-5 and the trolley line, and for adjacent street right-of-way, as more fully described in the legal description attached and made a part hereof as Exhibit "C" Case File No. ZC-7-86; and From MM-CZ (Medium Manufacturing -Coastal Zone) to CT-PD-CZ (Commercial Zburist-Planned Development -Coastal Zone) for approximately 6.4 acres of property located west of I-5, south of 24th Street, east of the SD&AE railroad right-of-way, and north of Paradise Marsh, and for adjacent street right-of-way, as more fully described in the legal description attached and made a part hereof as Exhibit "D" Case File No. ZC-7-86; and Section 3. That a Notice of Determination shall be filed indicating that the rezoning will not have a significant effect on the environment. PASSED and ADOPTED this /7r1 day of February, 1987. orge !f. Kimball's Map 584 in the City of National City, filed 20 February 1889 in the County Recorder's Office of the County of San Diego, State of California, described as follows: The southerly 125 feet of the easterly 290 feet, and also the westerly 40 feet of "N" Avenue contiguous thereto, and also the northerly 40 feet of vacated street contiguous southerly thereto. EXHIBIT "C" (ZC-7-86) Portion of Block 169, Map No. 348, National City, in the City of National City, County of San Diego, State of California, said map filed in Recorder's Office of said County 2 October 1882, described as follows: All of said Block 169 and vacated 20 foot Wilson Avenue contiguous thereto and also the southerly 40 feet of vacated 23rd Street contiguous thereto, and also the northerly 40 feet of 24th Street contiguous thereto, and also the westerly forty feet of Wilson Avenue contiguous thereto, excepting all westerly of the westerly line of the easterly 50 feet of Lots 1 through 10 thereof. EXHIBIT "D" (ZC-7-86) Portions of National City, Map No. 348, National City, in the City of National City, County of San Diego, State of California, said map filed in Recorder's Office of said County 2 October 1882, and Chamber of Commerce Industrial Lands #1, Map No. 1731 records of said County A.D. 1922, all westerly of the westerly line of State Highway I-5, described as follows: All of Tract A, said map No. 1731 and vacated Cleveland Avenue adjacent thereto, and also all of Block 232, said Map 348 and vacated Cleveland Avenue adjacent thereto lying northerly of and adjacent to aforesaid Tract "A", and also all Block 282 and vacated 25th Street, vacated 26th Street, vacated Cleveland Avenue and vacated Harrison Avenue adjacent thereto, and also, all of Block 281, said Map 348 lying southerly and easterly of the southerly and easterly line of the San Diego and Arizona Eastern Railroad right of way and vacated Cleveland Avenue and vacated 25th Street adjacent thereto.
