AN ORDINANCE OF THE CITY OF NATIONAL CITY ADOPTING THE UNIFORM
BUILDING CODE, 1985 EDITION, AMENDING CERTAIN SECTIONS AND APPENDIX
CHAPTERS 7 AND 70, DELETING APPENDIX CHAPTER 12, ADOPTING THE
UNIFORM BUILDING CODE STANDARDS 1985 EDITION, AND AMENDING
ORDINANCE NO. 1835 AND CHAPTER 15.08 OF THE
MUNICIPAL CODE OF THE CITY OF NATIONAL CITY
BE IT ORDAINED by the City Council of the City of National City as
follows:
Section 1. The City Council of the City of National City hereby
adopts the Uniform Building Code, 1985 Edition, and the Uniform Building Code
Standards, 1985 Edition.
Section 2. The City Council of the City of National City hereby
amends certain sections and Appendix Chapters 7 and 10, and deletes Appendix
Chapter 12, of the Uniform Building Code, 1985 Edition, and amends Ordinance
No. 1835 and Chapter 15.08 of the National City Municipal Code, to read as
follows:

15.08.002 Findings and declaration. The city council specifically
and expressly finds and declares that the nature and the uniqueness of the
climate, terrain, location, environment, and rate of population growth of
the city necessitates and demands specific changes in, and variations from
the Uniform Building Code, 1985 Edition, which are noted in and made a
part of this chapter.
15.08.010 Code adopted. There is adopted by the city council,
for the purpose of prescribing regulations governing the erection,
construction, enlargement, alteration, repair, moving, removal, demolition,
conversion, occupancy, use, height, area, fire resistance, and maintenance
of all buildings and/or structures, that certain code known as the
Uniform Building Code Appendix except Chapter 12 and Uniform Building
Code Standards, published by the International Conference of Building
Officials being particularly the 1985 Edition thereof, save and except
such portions as are deleted, modified or amended in this chapter, of
which code not less than three copies have been and are now on file in
the office of the city clerk; and the same are adoptedand incorporated
as if fully set out at length in this chapter, and from the date on
which the ordinance codified in this chapter takes effect, the provisions
thereof shall be controlling within the limits of the city.

When necessary to make an inspection to enforce any of the
provisions of this code or reasonable cause to believe that there exist
in any building or upon any premises a condition or code violation which
makes such building or premises unsafe, dangerous or hazardous, the
Building Official, San Diego County Health Department and/or their
authorized representatives may request entry as specified in Chapter
1.12 of the National City Municipal Code.

Unsafe Buildings or Structures, Section 203.
(a) All buildings or structures regulated by this code which
constitute a fire hazard, or are otherwise dangerous to human
life are, for the purpose of this section, unsafe. Any use
of buildings or structures constituting a hazard to safety,
health or public welfare by reason of inadequate maintenance,
dilapidation, obsolescence, fire hazard, disaster, damage or
abandonment is, for the purpose of this section, an unsafe
use. Parapet walls, cornices, spires, towers, tanks, statuary
and other appendages or structural members which are supported
by, attached to, or a part of a building and which are in
deteriorated condition or otherwise unable to sustain the
design loads which are specified in this code are hereby
designated as unsafe building appendages.
(b) Abandoned buildings or structures or portions thereof in
incomplete condition inherently constitutes a hazard, is
declared dangerous, unsafe, and declared a public nuisance
by reason of unprotected trenches and excavations, projecting
structural elements, open piping systems, exposed electrical
conductors and/or other conditions characteristic of construction
projects.
(c) For the purpose of this section, the term "incomplete,
building or structure", shall be interpreted to mean any
building or structure described herein.
(d) All such unsafe buildings, structures or appendages are
hereby declared to be public nuisances and shall be abated by
repair, rehabilitation, demolition or removal in accordance
with the procedures set forth in the Dangerous Buildings Code
adopted by this jurisdiction. As an alternative, the building
official, or other employee or official of this jurisdiction
as designated by the governing body, may institute any other
appropriate action to prevent, restrain, correct or abate
the violation.

square feet (100 sq.ft.) of roof area and providing all required
yard requirements are observed as set forth in the National City
Municipal Code.
(b-5) Retaining walls not exceeding three feet (3'-0") in
height measured from the top of existing ground level to the
top of the wall, except where supporting a surcharge or
impounding flammable liquids.

"Building Permit Fees effective
The determination of value or valuation under any of the provisions
of this code shall be made by the building official. The value
to be used in computing the building permit and building plan
review fees shall be the total value of all construction work
for which the permit is issued as well as all finish work,
painting, roofing, electrical, plumbing, heating, air condi-
tioning, elevators, fire -extinguishing systems and any other
permanent equipment.
(c) Plan Review Fees. When plans and/or other data are required
to be submitted by subsection (b) of Section 302, a plan permit
filing fee per Section 15.08.085(i) shall be paid at the time of
submitting plans and/or other data.
(e)1. Investigation Fees: Whenever any work for which a permit
is required by code has commenced without first obtaining said
permit, a special investigation shall be made before a permit
may be issued for such work.
2. Fee: An investigation fee, in addition to the permit fee, shall
be collected whether or not a permit is then or subsequently issued.
The fee shall be as set forth on the schedule entitled, "Valuation
Multipliers."
The payment of such investigation fee shall not exempt any P person
from compliance with all other provisions of this code nor from
any penalty prescribed by law.
15.08.085 Section 304(g)(h)(i) and (j)..added..Fees. Section
304(g)(h)(i) and (j) of the Uniform Building Code is added to read as
follows:
(g) Compliance Survey Fee. The fee for conducting a compliance
survey of an existing building and/or structure shall be paid
to the city at the rate of $.05 per square foot area, with a
minimum of fifty ($50) dollars for each unit located in the
building and/or structure.
(h) Energy Plan Check Fee. The fee for required energy plan
checking shall be all residential - fifty ($50) dollars,
commercial/industrial building - one hundred ($100) dollars,
and all additions - twenty five ($25) dollars.
(i) Permit Filing Fee. A permit filing fee of fifteen ($15)
dollars shall be paid for each project submitted to the city
for review.
EXCEPTIONS: The United States, the State of California, the
County of San Diego, the City of National City, and other
public agencies shall not be required to pay any fees for
filing an application for a building permit pursuant to
this code.
(j) Reinspection Fee. Whenever it shall be necessary to make
an extra inspection to any project due to incorrect address or
any reason enumerated in Section 305(g) a reinspection fee per
schedule entitled, "Valuation Multipliers" shall be paid to the
city.
15.08.090 Section 305(g)..amended..Reinspections. Section
305(g) of the Uniform Building Code is amended by revising paragraph
four of subsection (g) to read as follows:
(g) To obtain a reinspection, the permittee shall file an
application therefor in writing upon a form provided for
that purpose, and pay the reinspection fee per schedule
entitled, "Building Multipliers."
In instances where reinspection fees have been assessed, no
additional inspection of work will be performed until the
fees have been paid.
15.08.130 Section 3203(h)..added..Roof Coverings. Section
3203(h) of the' Uniform Building Code is added to read as follows:
(h) Wood Shakes
1. New roofs - treated wood shakes applied in accordance with
Section 3203(g), Special purpose roofs A -wood shakes.
2. Reroofing - treated wood shakes applied in accordance with
Section 3203(g), Special purpose roofs A -wood shakes and Appendix
Chapter 32 reroofing.
Shakes shall be laid with a side lap of not less than 1-1/2
inches between joints in adjacent courses. Spacing between shakes
shall be not less than 3/8 inch nor more than 5/8 inch, except for
preservative -treated wood shakes, which shall have a spacing of not
less than 1/4 inch nor more than 3/8 inch.
Shakes shall befastened to the sheathing with two nails only,
positioned approximately 1 inch from each edge and approximately 2
inches above the exposure line. The starter course at the eaves
shall be doubles. The bottom or first layer may be either shakes
or shingles.
Fifteen -inch or 18-inch shakes may be used for the final course
at the ridge.
Shakes shall be laid with not less than 18-inch-widestrips of
not less than Type 30 felt shingled between each course in such a
manner that no felt is exposed to the weather below the shake butts.
Weather exposures shall not exceed those set forth in Table No.
32-A. Hip and ridge weather exposures shall not exceed those permitted
for the field of the roof.
15.08.135 Section 3802(a)..amended..Automatic Fire -Extinguishing
Systems. Section 3802(a) of the Uniform Building Code is amended by
adding a paragraph to read as follows:
"Section 3802(a). In every building regardless of occupancy
group or type of construction when such building is more than
40 feet or 4 stories in height."
15.08.140 Chapter 7 Appendix Section 715(c)..amended..Covered
Mall Buildings. Chapter 7 Appendix Section 715(c)-of the Uniform
Building Code is amended by adding kiosks to read as follows:
KIOSKS - Kiosks and similar structures within the mall (temporary
or permanent) shall meet the following requirements:
1. They must be constructed of noncombustible materials or
fire retardant treated wood.
2. They are provided with automatic sprinklers if roofed over
in such a manner as to obstruct sprinkler discharge from the
building sprinkler system.
3. They are separated from each other by at least 20 feet.
4. They are not over 300 square feet in area.
15.08.145 Chapter 12 Appendix..delete..Requirements for Group R,
Division 3 Occupancy. Chapter 12 appendix of the Uniform Building Code
is deleted.
15.08.150 Chapter 70 Appendix..amended..Excavation and Grading.
Chapter 70 Appendix Excavation and Grading of the Uniform Building Code
is amended to read as follows:
"The term 'Building Official' as contained therein is amended
to read "City Engineer of the City of National City'."
15.08.095 Section 305(h)..added..Inspections. Section 305(h)
of the Uniform Building Code is added to read as follows:
(h) Compliance Survey Inspection, Upon receipt of a written
request for a compliance survey from the owner and after the
fee specified in Section 304(g) has been paid, the Director of
Building and Safety may inspect an existing building or structure
to ascertain its compliance with the provisions of this code and
other applicable laws and ordinances, and report his findings
in writing to such owner.
15.08.100 Chapter 3..deleted..Table 3-A Building Permit Fees.

Every principal building or structure located within the
incorporated limits of the City of National City shall be identified
by a designated street number as issued by the Director of Building
and Safety. Approved numbers, or addresses, shall be placed on all
new and existing buildings adjacent to the principal entrance where
the numbers posted at the entrance shall be posted on the building
or at a point that is plainly visible and legible from the street
on which is addressed. If necessary, directional signs shall be
posted showing proper access to a given address, from the point
where the Fire Department access roadway leaves the dedicated
street, to the entrance of each addressed building. All such
numbers shall be placed on a contrasting background.
