FINDINGS AND DECLARATIONS. The City Council of the City of National City, does hereby specifically and expressly find and declare that the nature and uniqueness of the climate, terrain location, environment and rate of population growth in the City of National City does necessitate and demand specific changes in, and variations from the Uniform Fire Code, 1985 Edition, which are noted in and made part of this ordinance. 15.28.010 Adopted. There is hereby adopted by the City Council of the City of National City for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion and establishing a bureau of Fire Prevention and providing a certain code known as the Uniform Fire Code and the appendix thereto, published by the International Conference of Building Officials and the Western Fire Chief's Association, being particularly the 1985 Edition thereof and the whole thereof, save and except such portions as are hereinafter deleted, modified or amended, of which code not less than three (3) copies have been and are now filed in the Office of the City Clerk of the City of National City and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of National City. 2 15.28.020 ESTABLISHMENT AND DUTIES OF BUREAU OF FIRE PREVENTION. A. The Uniform Fire Code shall be enforced by the Bureau of Fire Prevention in the Fire Department in the City of National City which is hereby established and which shall be operated under the supervision of the Chief of the Fire Department. B. The Fire Marshal in charge of the Bureau of Fire Prevention shall be appointed by the Chief of the Fire Department of the City of National City. Said appointment shall continue during good behavior and satisfactory service, subject to removal only for cause. C. The Chief of the Fire Department may detail such members of the Fire Department as inspectors as shall from time to time be necessary. The Chief of the Fire Department shall recommend to the City Council of the City of National City the employment of technical inspectors, who, when such authorization is made, shall be selected through an examination to determine their fitness for the same position. The employment shall be for an indefinite term with removal only for cause. Section 3: 15.28.030 DEFINITIONS. A. Wherever the word "jurisdiction" is used in the Uniform Fire Code, it shall be held to mean the City of National City. B. Whenever the words "Chief of the Bureau of Fire Prevention" are used in the Uniform Fire Code, they shall be held to mean the Fire Marshal of the City of National City. 15.28.040 Establishment of Limits for Flammable Liquid Storage. Amended. Establishment of limits of districts in which storage of flammable or combustible liquids in outside above ground tanks is to be prohibited. A. The limits referred to in Section 79.501 of the Uniform Fire Code in which storage of Class I and II liquids in above ground tanks outside buildings is prohibited, are hereby established as follows: All areas within the City limits of National City. B. The limits referred to in Section 79.1401 of the Uniform Fire Code in which new bulk plants for flammable or combustible liquids are prohibited, are hereby established as follows: All areas within the City limits of National City except for MM, Manufacturing Medium, MH, Manufacturing Heavy, MT, Manufacturing Tidelands as established by the National City Land Use Code. 15.28.050 Establishment of Limits for Bulk Storage of LPG. Amended. Establishment of limits in which bulk storage of liquified petroleum gases is to be restricted. The limits referred to in Section 82.105(a) of the Uniform Fire Code, in which bulk storage of liquified petroleum gases is to be restricted, are hereby established as follows: All areas within the City limits of National City, except MM, Manufacturing Medium, MH, Manufacturing Heavy, MT, Manufacturing Tidelands as established by the National City Land Use Code. 15.28.060 Establishment of Limits for Storage of Explosives and Blasting Agents. Amended. Establishment of limits of districts in which storage of explosives and blasting agents is to be prohibited. The limits referred to in Section 77.106(b) of the Uniform Fire Code, in which storage of explosives and blasting agents is prohibited are hereby established as follows: All areas within the City limits of National City. 15.28.070 Section 10.306 Amended. Fire Alarm Systems. Delete "EXCEPTIONS" in item number one CO and add new paragraphs (d) and (e) to read as follows: (d) "Approval. All fire alarm system components and equipment installed under these provisions shall be State Fire Marshal approved." (e) "Automatic telephone dialing device to transmit an emergency alarm shall not be connected to the Fire Department emergency telephone number." 15.28.080 Section 79.903(a). Amended. Service Station Hose Nozzles. The following is hereby added to paragraph 2 after the words "automatic closing type hose nozzle": "without a latch open device". 15.28.085 Section 79.605(b). Added. Underground Tank Testing. Underground tanks shall be tested for tightness in accordance with San Diego County Dept. of Health Services, Hazardous Materials Management Unit and those regulations adopted by the State of California. 15.28.090 Section 11.112. Amended. Outdoor Burning. The following is added to paragraph (c): (c) All outdoor burning and incinerator burning shall be done in compliance with the Rules and Regulations of the San Diego County Air Pollution Control District. 15.28.100 Section 2.105. Amended. Authority Of Fire Personnel To Exercise Powers Of A Police Officer. Change "powers of a police officer" to "powers of a peace officer." 15.28.110 Section 2.107. Amended. Right of Entry. Change to read "...shall fail, neglect or refuse after proper request is made..." 15.28.120 Section 2.201(a). Amended. Inspection and Unsafe Buildings. Change "The Fire Prevention Bureau" to "The Fire Prevention Bureau and other Fire Department personnel shall inspect." 15.28.135 Section 4.102. Amended. Commodities. Add subsection (d). The Chief may impose a fee for recovery of expenses incurred as result of activities undertaken pursuant to enforcing the fire prevention provisions of this Code. 15.28.140 Section 10.207 Amended. Fire Department Access. (a) No changes. (b) Where Required. Every building constructed shall be accessible to fire department apparatus by way of access roadways with all-weather driving surface of not less than 20 feet of unobstructed width, with adequate roadway turning radius capable of supporting the imposed loads of fire apparatus and having a minimum of 13 feet, 6 inches of vertical clearance. (c) Identification. The required width of access roadways shall not be obstructed in any manner, including parking of vehicles. Where no space is provided for parking along access roadways, they shall be kept clear as follows: 1. Owners and/or property representatives shall be required to identify and mark fire lanes to the satisfaction and approval of the Fire Department. This requirement shall be marked on the approved plans and complied with in the field. 2. The entrance to all required Fire Department access roads shall be posted with approved signs. A maximum distance of 100 feet shall be required in the spacing of signs along the length of the Fire Department access road. The placing of signs shall be subject to the approval of the Fire Department. 3. When applicable, all curbing which outlines the access roads shall be painted red. White lettering reading "NO PARKING - FIRE LANE" shall be a minimum of 4 inches tall and shall be placed every 30 feet or portion thereof, on top of designated curbing or striping. Additional striping for Fire Department access roads may be required under special conditions (i.e. areas in front of garages and parking spaces). The minimum width of this red striping shall be 8 inches with white lettering. 4. Fire Department access areas for appliances, such as hydrants, standpipe inlets, sprinkler valves, etc., shall only require marking per Item #3. 6 (d) Permissible Modifications. Clearances or widths required by this section may be increased when, in the opinion of the Chief, minimum clearances or widths are not adequate to provide fire apparatus access. For high piled combusitble storage, see Section 81.109. (e) Buildings over 35 Feet High. Required access roadways shall be kept a minimum of 26 feet in width in the immediate vicinity of any building over 35 feet in height above natural grade. Required access roadways shall be located within a minimum of 15 feet and a maximum of 25 feet from the building, and shall be positioned parallel to one entire side of the building. (f) Vertical Clearance is deleted. (g) through (k) : no changes. (1) Signs is deleted. 15.28.150 Section 10.208. Amended. Premises Identification. "Approved numbers, or addresses, shall be placed on all new and existing buildings adjacent to the principle entrance. Where the numbers posted at the entrance are not easily visible from the street, additional numbers shall be posted on the building or at a point that is plainly visible and legible from the street on which is addressed. If necessary, directional signs shall be posted showing proper access to a given address, from the point where the Fire Department access roadway leaves the dedicated street, to the entrance of each addressed building. All such numbers shall be placed on a contrasting background." 15.28.160. Section 10.301(d). Amended. Fire Hydrant Markers. Existing subsection (d) shall read: (d) Fire Hydrant Markers. When required by the Chief, hydrant locations shall be identified by the installation of reflective blue -colored markers affixed to the roadway surface adjacent to the hydrant. The use of reflective blue -colored markers for any other purpose shall be prohibited. Existing subsection (d) and (e) are to be retained, but redesignated as subsections (e) and (f) respectively. 15.28.165. Section 10.308. Amended. Automatic Fire Extinguishing Systems. (a) All occupancies except single family dwellings and Group M related occupancies shall have an automatic fire extinguishing system installed: 1. Throughout all buildings four (4) stories or more in height. 2. Throughout all buildings which have a needed fire flow in excess of 2500 gallons per minute (GPM). 3. In every story or basement which exceeds 1500 square feet in floor area and any portion of which is located more than 75 feet from an opening 20 square feet in area with a minimum dimension of not less than 30 inches. Such openings shall be in the exterior wall of the building entirely above adjoining ground level and shall be accessible to the fire department and shall not be obstructed in a manner that firefighting and rescue cannot be accomplished from the exterior. 4. At the top of rubbish and linen chutes in their terminal room. 5. In rooms where nitrate film is stored or handled. 6. In protected combustible fiber storage vaults as defined in the Uniform Fire Code. (b) Conflicts with the Uniform Building Code. Where the provisions of this chapter conflict with the currently adopted Uniform Building Code, the more stringent provisions shall apply, this is to say, the provisions offering the greatest fire and life safety protection shall apply. Where automatic sprinkler systems are provided throughout buildings, required fire flows may be reduced by as much as 50%. All such reductions should be predicated on recognized standards and recommendations of the public fire protection grading and rating agencies providing that service. All required fire flows are to be available at a minimum 20 pounds per square inch (PSI) residual operating pressure. 15.28.170 Section 10.309. Amended. Sprinkler System Alarms. (a) When serving more than 100 sprinklers, shall be supervised by an approved central station service or local alarm which will constantly attended location. automatic sprinkler systems station, proprietary or remote give an audible signal at a (b) When deemed necessary by the Chief, sprinkler systems serving less than 100 heads with a special hazard, shall be supervised by an approved central, proprietary or remote station service or local alarm which will give an audible signal at a constantly attended location. 15.28.175 Section 10.314(d). Amended. Portable Fire Extinguishers. (d) Portable Extinguishers. In addition to the fixed system, a dry chemical (sodium bicarbonate or potassium bicarbonate base) portable fire extinguisher which has a rating of not less than 40-B shall be installed near the food processing equipment. For additional portable fire extinguishers, see UFC Std. #10-1. 15.28.180 Section 10.315 Added. Pre -Fire and Emergency Planning. Owners, operators, tenants, administrators and managers of: educational and institutional occupancies; hotel and apartment occupancies containing 15 or more units and all high-rise buildings, shall when requird by the Fire Chief or his designated representative, establish pre -fire and emergency procedures and plans which shall include but not be limited to the following: 1. Designation of a responsible person as Safety Director who shall work with the Fire Chief in the establishment, implementation and maintenance of pre -fire emergency plans. 2. Preparation of pre -fire and emergency plans which shall be designed and implemented in accordance with the approval of the Fire Department. 15.28.185 Section 11.105. Amended. Types and Construction of Incinerators.a. Every incinerator used shall comply with the provisions of this section. b. Commercial or industrial incinerators, when permitted, shall be constructed in accordance with the provisions of the Building and Mechanical Codes and shall be located a minimum of 20 feet from any buildings and/or property line and shall not obstruct any required path of exit travel. c. Every incinerator shall be equipped and maintained with a spark arrester constructed of iron, heavy wire mesh or other noncombustible material, with openings not larger than 1/2 inch. d. Every incinerator shall be constructed and maintained in accordance with the requirements of any air pollution district having jurisdiction. 15.28.190 Section 11.106. Amended. Residential Incinerators. Residential incinerators are strictly prohibited. 15.28.200 Section 11.107. Amended. Incinerators. Incinerators in a trailer camp, mobile home park or permanent camping park are strictly prohibited. 15.28.210 Section 11.110. Deleted. Restricted Use of Incinerators. 15.28.220 Section 11.111. Amended. Chimney Spark Arresters. Each chimney used in conjunction with any fireplace or any heating appliance in which solid or liquid fuel is used, upon any cabin house, hotel, building or structure shall be maintained with a spark arrester as required for incinerators. 15.28.230 Section 11.112. Amended. Hours of Burning. Delete "Exceptions." 15.28.240 Section 11.115. Amended. Attendant for Fire. Except in an approved incinerator, open burning shall be strictly prohibited. 15.28.250 Section 11.204. Amended. Flammable Decorative Materials. a. Existing language is hereby labeled (a).b. Cut Trees. 1. No person shall flameproof or apply fire resistive treatment to any cut tree required to be flameproofed by this section unless such person has been issued a permit. 2. The Chief may give an examination to determine that the applicant possesses the necessary qualifications required to perform a satisfactory job of flameproofing or fire resistive treatment. - 10 - J 3. In the flameproofing or fire resistive treatment of any cut tree, only such chemicals or compounds or methods of treatment as are approved by the Chief shall be used. 4. Following the flameproofing or fire tree, there shall be firmly affixed thereto, resistive treatment of any cut on the base of the tree, a tag or label, which shall contain the following information: i. Name of the person performing the treatment. ii. Firm or business name and address. iii. Name or description of chemical or compound used for treatment. iv. Date of application. v. Each tag or label shall be serially numbered and a record kept thereof. 5. Each person, firm or corporation giving flameproofing or fire resistive treatment shall maintain a written list of all such work performed giving the serial number of the tag or label attached to the tree, and the name and address of the person, firm or corporation for whom the work was performed and the date of treatment and location where the tree is to be placed. EXCEPTION: Cut trees three (3) feet or less in height when approved by the Chief. 15.28.260 Section 11.210. Added. Vehicles Leaking Fuel. When any vehicle is leaking, and such the Chief may order public or private owner's expense. leaking fuel and it is impracticable to stop such leaking creates a fire hazard as defined in this Code, the removal of the vehicle from a highway or from property and take action to mitigate the hazard at the 15.28.270 Section 11.302. Amended. Cost Recovery for False Alarms. Add new subsection (e): The Chief shall adopt and assess such fees as he may deem necessary to recover the costs of false alarms received due to the action of any mechanical or electrical alarm device, when the frequency of such false activations is beyond five (5) a month and prior notification by the Fire Department has been issued. 15.28.280 Section 11.303. Added. Reporting of Hazardous Materials Releases. Section 11.303. Reporting of Hazardous Materials Releases. (a) In the event of a release or threatened release of any hazardous material on any property the owner or occupant shall immediately upon discovery, report such release or threatened release to the Fire Dept. (b) For this purpose, hazardous material shall mean any material that because of its quantity, concentration, or physical or chemical characteristics, poses a significant present or potential hazard to human health and safety or to the environment if released into the workplace or the environment. (c) A release shall mean any spilling, leaking, pumping, pouring, emitting, emptying, discharging, injecting, escaping, dumping, or disposing into the environment, unless permitted or authorized by the Fire Chief. 15.28.290 Section 11.404. Amended. Unvented Fuel Burning Appliances. Add new subsection (e): Unvented fuel burning appliances shall not be installed, used, maintained, or permitted to exist in any occupancy. Fuel burning appliances shall be installed in accordance with all provisions of the Uniform Mechanical Code. 15.28.295 Section 11.412. Amended. Vacant Buildings. Existing language is hereby labeled (a). (b) Right to Secure. In the event the owner shall fail, neglect, or refuse to remedy any condition which renders a structure unsecured, the Chief may order the owner of such structure prosecuted as a violator of the - 12 - provisions of these Sections and/or may proceed to cause the accomplishment of the necessary remedial work or demolition. A record of the cost of all such work performed shall be transmitted to the City Council, who shall cause the same to be paid and levied as a special assessment against the property. 15.28.300 Section 12.104. Amended. Doors. Change "building official" to "enforcing authority" in part (b) Exceptions, last sentence. 15.28.310 Section 25.119. added. Requirements for Exhibits, Fairs, Trade Shows or Vehicle Displays Inside Buildings. (a) Permits. A permit shall be required to operate an exhibit, fair, trade show or vehicle display inside a building. (b) Aisles of a minimum of ten feet in width must be maintained at all times. The line of travel to an exit door by an aisle shall be not more than 150 feet. (c) Exhibits, fairs, trade shows, or vehicle displays shall not be placed in lobbies, foyers or the required width of an exit way. (d) The display in any public building, other than those constructed and classified by the Building Code for such use, of automobiles, motorcycles, scooters, or other fuel operated vehicles shall meet the following requirements: 1. The battery shall be disconnected and the battery cable placed or tied in a position to prevent accidental battery contact. 2. Fuel tanks shall be equipped with a key -locking cap or other devices (duct tape) approved by the Fire Marshal. Fill caps that are inaccessible may be approved without a key or other locking devices by the Fire Marshal. 3. For vehicle shows the following shall be required: a. Vehicle gas tanks shall not contain more than one gallon of fuel. b. Vehicles shall be pushed into display area and pushed out of display area upon termination of exhibit unless otherwise approved by the Fire Marshal. 15.28.315 Section 45.207. Deleted. Limited Spraying Areas. Section 45.207, Limited Spraying Areas, shall be deleted in its entirety. 15.28.320 Section 61.106(c). Amended. Portable Unvented Oil -Burning Heating Appliances.(c) Where Permitted. Portable unvented oil -burning heating appliances shall not be installed, used, maintained or permitted to exist in any occupancy. 15.28.330 Section 79.114(e). Amended. Abandonment and Status of Tanks. Any underground tank which has been abandoned for a period of one year shall be removed from the ground and the hole properly filled. In circumstances where tank removal will cause structural damage to surrounding buildings, the tank shall be filled in place in accordance with the San Diego County Dept. of Health Services, Hazardous Materials Management Unit. 15.28.340 Section 79.201 (g-2) . Amended. Storage Cabinets. 2. Quantities. The quantity of Class I or Class II liquids shall not exceed 60 gallons and the total quantities of all liquids in a storage cabinet shall not exceed 120 gallons. EXCEPTION: Quantities shall not exceed those amounts listed in Table 9-A of the Uniform Building Code. 15.28.350 Section 79.702. Amended. Corrosion Protection. Delete the words "coated or" in the first sentence. 15.28.360 Section 80.103(c). Added. General Requirements. "Hazardous materials or hazardous waste products shall not be discharged into or upon any street, highway, drainage canal or ditch, storm drain, sewer or flood control channel, lake or tidal waterway, or upon the ground" after ...allowed to accumulate on floors or shelves." 15.28.370 Appendix I-A(1.b). Amended. Life Safety for Existing Buildings. Add EXCEPTION to end of paragraph: EXCEPTION: All smoke detectors shall be installed immediately upon notification in accordance with Appendix I -A (6) . - 14 - J 15.28.380 Appendix I A(5) . Amended. Standpipes. 5. Standpipes. Any building four (4) stories or more in height shall be provided with an approved Class I or III standpipe system. Section 8: 15.28.390 Appeals. Section 2.302 of the Uniform Fire Code is hereby amended as follows: The Board of Appeals shall determine the suitability of alternate materials and methods of construction; provide reasonable interpretations of the provisions of the code; and shall recommend to the City Council such new legislation as is consistent therewith. The decisions of the Fire Chief and/or Fire Marshal in interpreting the provisions of this code; the refusal to issue any permit required by the code; and any action in issuing correction notices or notice to abate a public nuisance of fire hazard may be appealed to the Board of Appeals. Section 9: 15.28.400 New Materials, Processes or Occupancies which may require Permits. The City Manager, the Chief of the Fire Department and the Fire Marshal shall act as a committee to determine and specify, after giving effected persons an opportunity to be heard, any new materials, processes or occupancies which shall require permits in addition to those now enumerated in said code. The Fire Marshal shall post such list in a conspicuous place in his/her office and distribute copies thereof to interested parties. Section 10: 15.28.410 Penalties. Any person who shall violate any of the provisions of the Uniform Fire Code hereby adopted or fail to comply therewith or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the City Council or by a court of competent jurisdiction, is guilty of a misdemeanor. Section 11: 15.28.420 Repeal of Conflicting Ordinances. All former ordinances or parts thereof conflicting or inconsistent with the provisions of this ordinance or of the Code or Standards hereby adopted are hereby repealed. Section 12: 15.28.430 Validity. The City Council of the City of National City hereby declares that should any section, paragraph, sentence or word of this ordinance or of the Code or Standards hereby adopted be declared for any reason to be invalid, it is the intent of the City Council of the City of National City that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid.
