AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY
AMENDING TITLE 18 (ZONING) AND APPENDIX D (USE GROUPS) OF THE
MUNICIPAL CODE RELATING TO SPECIFIC USES, REGULATIONS AND PROCEDURES
follows:
BE IT ORDAINED by the City Council of the City of National City as
Section 1. That Section 18.126.030 is added to Chapter 18.126 of the
Municipal Code to read as follows:
"18.126.030 In conjunction with conditional use permit. Where a
Planned Development Permit and a Conditional Use Permit are required
for the same project prior to development of the property, only the
Planned Development Permit shall be required to be processed.
Conditional uses applied for anytime thereafter shall be required to
obtain a separate Conditional Use Permit."
Section 2. That Section 18.116.090 of the Municipal Code is amended
to read as follows:
"18.116.090 Notice of planning commission's decision. Not later
than seven days following the rendering of a decision ordering that a
conditional use permit be granted or denied, a copy of the resolution
shall be mailed to the applicant at the address shown on the
application filed with the planning commission and to any other
person requesting a copy. A copy of the planning commission
resolution granting or denying such applications shall be given to
the city clerk who shall then transmit it to the City Council unless
an appeal is filed, in which case the provisions of section
18.116.100 shall apply."
Section 3. That the title of Section 18.116.100 of the Municipal
Code is amended to read as follows:
"18.116.100 Appeal Procedure"

Section 4. That Subsection E of Section 18.94.070 of the Municipal
Code is amended to read as follows:
"E. No material, equipment, or goods of any kind shall be stored on
the roof of any building in any zone . "
Section 5. That subsection H is added to Section 18.14.160 of the
Municipal Code to read as follows:
"H. Semi trucks and trailers, dump trucks, moving vans and other
heavy duty commercial vehicles shall not be parked on any
residentially zoned lot for a period longer than 8 hours."
Section 6. That Section 18.16.198 is added to Chapter 18.16 of the
Municipal Code to read as follows:
"18.16.198 Automobile sales lots. Lots used for the sale of
automobiles, trucks, recreational vehicles or other similar vehicles
shall have a minimum area of 10,000 square feet."
Section 7. That Section 18.18.150 of the Municipal Code is amended
to read as follows:
"18.18.150 Prohibited uses and structures--ML zone. In the ML
(light manufacturing) zone, the following uses are prohibited:
A. Drilling for gas, oil, etc.;
B. Drop hampers;
C. Canneries;
D. Food processing plants;
E. Plastics manufacture;
F. Liquefied petroleum gas storage;
G. Petroleum storage;
H. Petroleum processing;

I. Scrapyards;
J. Foundries;
K. Meat packing plants;
L. Auto wrecking and dismantling yards;
M. Refuse disposal or incineration."
Section 8. That Subsection C is added to Section 18.122.030 of the
Municipal Code to read as follows:
"C. Any applicant for a home occupation permit who is not the legal
owner of the subject real property shall provide a written statement
from the legal owner consenting to the application."
Section 9. That Section 18.122.010 of the Municipal Code is amended
to read as follows:
"18.122.010 Purpose. The purpose of a home occupation permit shall
be to insure that an occupation conducted within a dwelling is
compatible with the character of the area in which the dwelling is
located and that it is clearly a secondary use to the primary
residential use of the dwelling."
Section 10. That Subsection A of Section 18.62.110 of the Municipal
Code is amended to read as follows:
"A. Pole signs or freestanding signs shall be limited to one per
street frontage and may include cluster signs to identify businesses
therein."
Section 11. That Section 18.92.030 of the Municipal Code is amended
to read as follows:
"18.92.030 Special promotions. A. All other businesses in the
commercial and industrial zones may have special promotions at which
outdoor display and sales are allowed, limited to three days each,
which shall include all set up time. No business shall have more
than two sales in a calendar year. There shall be a period of at
least 30 days between sales.

B. For special promotions lasting more than three days, or for
more than two such sales in one calendar year, a conditional use
permit must first be obtained. All such sales shall be limited to
the site approved for such a business or on an adjacent (contiguous)
lot.
C. No business shall conduct a special promotion with outdoor
display on a property when said business does not have a permanent
business address on the same property. This restriction shall not
apply to sales conducted entirely indoors.
Section 12. That Subsection A.5 is added to Section 18.108.040 of
the Municipal Code to read as follows:
"A.
5. In the event such damage or destruction exceeds one half the
replacement cost of such nonconforming structure, it shall not be
reconstructed."
Section 13. That Subsection B of Section 18.108.040 of the Municipal
Code is repealed.
Section 14. That Section 18.108.060 of the Municipal Code is
repealed.
Section 15. That the following sections of Chapter 18.108 of the
Municipal Code are renumbered as follows: The present section number
18.108.070 is renumbered 18.108.060; the present section number 18.108.080 is
renumbered 18.108.070; the present section number 18.108.090 is renumbered
18.108.080; the present section number 18.108.100 is renumbered 18.108.090;
the present section number 18.108.110 is renumbered 18.108.100.
Section 16. That Section 18.16.140 of the Municipal Code is amended
to read as follows:
"18.16.140 On site sales of alcoholic beverages in public eating
places. Sales of alcoholic beverages for consumption on the
premises, entertainment and dancing may be permitted as an incidental
use to a public eating place subject to issuance of a conditional use
permit and the following conditions:
A. Such establishments shall be no closer than six hundred
sixty feet from any school within the boundaries of the city.
B. Alcoholic beverage sales shall be incidental to food
service.
C. Live entertainment shall be limited to a single entertainer
performing musical work (piano bars, etc.) where there is no dancing,
audience participation, or other live entertainment activities.
D. There shall be no sale of alcoholic beverages after
midnight."
Section 17. That Section 18.16.150 of the Municipal Code is
repealed.
Section 18. That the following sections of Chapter 18.16 of the
Municipal Code are renumbered as follows: The present section number
18.16.141 is renumbered 18.16.145; the present section number 18.16.142 is
renumbered 18.16.150.
Section 19. Subsection H is added to Section 18.94.070 of the
Municipal Code to read as follows:
"H. Shipping containers and truck trailers shall not be used for
storage purposes in any zone, except as approved on a temporary basis
by the City Council."
Section 20. Section 18.16.430 is added to Chapter 18.16 of the
Municipal Code to read as follows:

"18.16.430 Uses to be adequately housed in completely enclosed
buildings. All uses in the commercial zones shall be adequately
housed in completely enclosed buildings; provided, however, that
businesses such as auto and truck dealers, nurseries, gas stations,
and similar uses (as determined by the planning director per Section
18.104.030) that customarily include outdoor use, may be permitted
outside of a completely enclosed building. This section shall not
restrict incidental loading, property maintenance, or special
promotions as provided by Section 18.92.030 of this Title."
Section 21. Subsection J is added to Section 18.62.190 to read as
"J. Inflatable displays are prohibited in all zones."
Section 22. Subsection B of Section 18.108.110 is amended to read as
"B. In the CA zone where there exists commercial retail shopping
facilities which became nonconforming at the time of the adoption of
the National City Land Use Code, such facilities may be continued and
may continue to lease commercial retail space to uses typical of such
facilities but not otherwise permitted in the CA Zone."
Section 23. That Section 18.134.100 is added to Chapter 18.134 of
the Municipal Code to read as follows:
"18.134.100 Violations --Misdemeanors and infractions (Wobblers). It
shall be unlawful for any person to violate any provision or fail to
comply with any of the requirements of this Title. A violation of
any of the provisions or failure to comply with any of the mandatory
requirements of this Title shall constitute a misdemeanor; except
that notwithstanding any other provision of this Code, any such
violation constituting a misdemeanor under this Title may in the
discretion of the City Attorney be charged and prosecuted as an
infraction."

Section 24. That the following amendments are made to Appendix D
(Use Groups) of the Municipal Code:
a) Delete "Recording Studio" from Use Group 27, add to Use Group 22.
(Typical Permitted Uses).
b) Delete from Use Group 16 and add to Use Group 4 (Typical
Permitted Uses) :
Accessory Gas Sales
Drive-Thru Tune -Up and Lubrication
Liquified Petroleum Gas Dispensing
c) Delete from Use Group 16:
Automobile Emission Control Inspection Station (no repair work)
Automobile Repair - personal automobile (the repairing of an
individual's own vehicles on their private property other than
residential property)
Automobile Repairing (general)
Automobile Static Inspection
Car Oil Change and Lubrication
Automobile Service Stations
Gasoline Sales (as accessory use)
Mobile Carburetor Repair
Tire Shops
Auto repair minor, including installation of tires, batteries and
accessories as an incidental use; and as an accessory and/or
incidental use to a major department store.
d) Change "Blood Plasma Collection Center" in Use Group 19 from a
permitted use to a conditional use.
e) Add "Mdical Offices" to Use Group 8 (Typical Permitted Uses).
f) Add "Mobile Home" to Use Groups 9, 10, and 11 (Typical Permitted
Uses) .
g) Delete "Sock -Hop (Dance)" from Use Group 6.
h) Delete "Preaching the message of Good news by way of drama"
(Conditional Use Permit) from Use Group 27.
