HomeMy WebLinkAboutCC ORD 1985-1861 TO AMEND AND REPEAL PORTIONS OF ORDINANCE NO.1705, AND TO AMEND AND REPEAL PORTIONS OF CHAPTER 15.30 OF TITLE 15 OF THE NATIONAL CITY MUNICIPAL CODEORDINANCE NO. 1861 AN ORDINANCE OF THE CITY OF NATIONAL CITY TO AMEND AND REPEAL PORTIONS OF ORDINANCE NO. 1705, AND TO AMEND AND REPEAL PORTIONS OF CHAPTER 15.30 OF TITLE 15 OF THE NATIONAL CITY MUNICIPAL CODE BE IT ORDAINED by the City Council of the City of National City as follows: Section 1. That Ordinance No. 1705 and Chapter 15.30 of Title 15 of the National City Municipal Code are hereby amended to read as follows: CHAPTER 15.30 REIMBURSABLE EXPENSES Sections: 15.30.010 Circumstances under which reimbursement may be sought. 15.30.011 Definitions. 15.30.020 Determination to charge costs. 15.30.030 Calculation of costs incurred. 15.30.010 Circumstances under which reimbursement may be sought. The City may impose upon the responsible person or entity the reasonable cost of fire prevention, suppression, investigation or the protection of the public from fire and other hazardous conditions that result from any of the following conditions or activities: A. Negligent manufacture, transportation, storage, handling, burning, or release of hazardous or toxic chemicals or substances, flammable liquids, materials or substances, or any material or substance which creates a health hazard (as defined in the currently adopted Uniform Fire Code, Health & Safety Code, Labor Code, or other related codes or ordinances); B. Negligent use of welding equipment, cutting torch or tar pot; C. Negligently creating, permitting, or maintaining a fire or other hazardous condition; D. Failure to correct a hazardous condition for which a "Notice of Correction" has been previously given by the National City Fire Department; E. Setting of a fire negligently or in violation of any ordinance, law, regulation, or statute of the City of National City, County of San Diego or State of California. 15.30.011 Definitions. The meaning of all terms used in this chapter not otherwise defined, shall be as set forth in the currently adopted Uniform Fire Code and Health and Safety Code. 15.30.020 Determination to Charge Costs. Whenever the Fire Chief of the City determines that the City or its agent has incurred costs for fire prevention, suppression, investigation or protection of the public safety, when a fire or other hazardous condition has resulted from the activities specified in Section 15.30.010, he shall: A. Calculate the costs incurred; B. Identify the person or persons responsible, and; C. Send, by certified mail, an invoice of all appropriate charges. 15.30.030 Calculation of costs incurred. The "costs incurred" shall include all necessary expenditures to correct the hazardous condition, or extinguish the fire, including, but not limited to: A. The cost of manpower; B. The cost of extinguishing agents; and C. The reasonable value of the use of equipment by the agency in- curring costs in the use of that equipment. Section 2. That Sections 15.30.040, 15.30.050 and 15.30.060 of the National City Municipal Code, as set forth in Ordinance No. 1705, are hereby repealed. PASSED and ADOPTED this 23rd day of July, 1985.
