AN ORDINANCE OF THE CITY OF NATIONAL CITY
AMENDING PORTIONS OF ORDINANCE NOS. 1712 AND
1820, AND AMENDING TITLE 18 (ZONING) OF
THE NATIONAL CITY MUNICIPAL CODE
BE IT ORDAINED by the City Council of the City of National City as
follows:
Section 1. That Section 53 of Ordinance No. 1712, and Section
18.16.140 of Chapter 18.16 of the National City Municipal Code are amended to
read as follows:
18.16.140 On -site sales of alcoholic beverages. Sales of alcoholic
beverages for consumption on the premises, entertainment and dancing may be
permitted as an incidental use, subject to issuance of a conditional use permit,
provided that such establishments shall be located no closer than five hundred
feet apart and no closer than six hundred sixty feet from any school within the
boundaries of the city. Live entertainment, limited to a single entertainer
performing musical work (piano bars, etc.) where there is no dancing, audience
participation, or other live entertainment activities, is a permitted accessory use
to permitted on -site alcoholic beverage establishments and restaurants without
requiring a conditional use permit.
Section 2. That Section 1 of Ordinance No. 1820, and Section
18.16.141 of Chapter 18.16 of the National City Municipal Code are amended to
read as follows:
18.16.141 Sale of alcoholic beverage as an accessory use. The sale of
alcoholic beverages as an accessory and/or incidental use to a permitted use,
may be permitted in any commercial zone, light or medium industrial zone
subject to issuance of a conditional use permit, provided that where the sale of
alcoholic beverages is for consumption on the premises, such establishments shall
be located no closer than five hundred feet apart, and no closer than six
hundred sixty feet from any school within the boundaries of the city.
Section 3. That Section 1 of Ordinance No. 1820, and Section
18.16.142 of Chapter 18.16 of the National City Municipal Code are amended to
read as follows
18.16.142 Sale of alcoholic beverages as a principal use. The sale of
alcoholic beverages as a principal use, whether for consumption on or off the
premises, may be permitted in all commercial zones, except CA, subject to
issuance of a conditional use permit. Where the sale of alcoholic beverages is
for consumption on the premises, such establishments shall be located no closer
than one thousand feet apart and no closer than six hundred sixty feet from any
school within the boundaries of the city. Where the sale of alcoholic beverages
is for consumption off the premises, such establishments shall be located no
closer than five hundred feet apart and no closer than six hundred sixty feet
from any school within the boundaries of the city.
Section 4. That Section 53 of Ordinance No. 1712, Section 3 of
Ordinance No. 1820, and Section 18.16.150 of Chapter 18.16 of the National
City Municipal Code are amended to read as follows:
18.16.150 On -site sales of alcoholic beverages in public eating places.
Sales of beer and wine and alcoholic beverages for consumption in a bona fide
public eating place may be permitted, subject to issuance of a conditional use
permit and the following conditions:
A. Alcoholic beverage sales shall be incidental to food service.
B. There shall be no bar or counter over which the on -sale alcoholic
beverages shall be served to the public.
C. All live entertainment and dancing shall be prohibited.
D. There shall be no sale of alcoholic beverages after midnight.
E. Live entertainment limited to a single entertainer performing
musical work (piano bars, etc.) where there is no dancing, audience participation,
or other live entertainment activities, is a permitted accessory use to permitted
on -site alcoholic beverage establishments and restaurants without requiring a
conditional use permit.
F. Such establishments shall be located no closer than five hundred
feet apart and no closer than six hundred sixty feet from any school within the
boundaries of the city.
Section 5. That this Ordinance shall not be applicable to any
establishment selling alcoholic beverages where an application for a conditional
use permit to operate that establishment has been filed with the Planning
Department prior to July 16, 1985.

until seven calendar days had elapsed between the days of its introduction

I FURTHER CERTIFY THAT said ordinance was read in full prior to its
final passage or that the reading of said ordinance in full was dispensed
with by a vote of not less than a majority of the members elected to the
Council and that there was available for the consideration of each mem-
ber of the Council and the public prior to the day of its passage a written
or printed copy of said ordinance.
