HomeMy WebLinkAboutCC ORD 1985-1873 ADOPTING THE BONITA VALLEY SPECIFIC PLAN (APPLICANT: ODMARK DEVELOPMENT COMPANY AND VALLEY LAND COMPANY) (SP-1-85)ORDINANCE NO. 1873 AN ORDINANCE OF THE CITY OF NATIONAL CITY CALIFORNIA ADOPTING THE BONITA VALLEY SPECIFIC PLAN. (APPLICANT: ODMARK DEVELOPMENT COMPANY AND VALLEY LAND COMPANY) (SP-1-85) BE IT ORDAINED by the City Council of the City of National Cityfollows: as llo ws: WHEREAS, the City Council of the City of National City at their meet ing of February 19, 1985 directed according to California Government Code Sect ion 65450 (et. seq.), that a Specific Plan be prepared for the subject property; P y; and WHEREAS, application was made for approval of the Bonita ValleySpecific Plan p for the development of 184 condominium units on 11.5 acres of ro ert P p y and 17 estate residences on approximately 17 acres of property, located south of the Sou th Bay Freeway (SR 54) on both sides of Valley Road, north of Lomacitas Lane and west of Avenida San Miguel; and WHEREAS, the Planning Commission said application at a public hearing held on Planning Commission considered oral and of the City of National City considered October 21, 1985 at which time the documentary evidence, and the entire contents of Case File Nos. SP-1-85 and IS-85-45, which is incorporated herein by reference; and WHEREAS, at the time of the public hearing the Planning Commission considered the Valley Road Annexation EIR certified by the City Council on May 28, 1985 and the addendum to the EIR which was prepared October 10, 1985 to incorporate technical revisions and additions describing the subject project; and WHEREAS, the City Council of the City of National City considered said application at a public hearing held on November 12, 1985 at which time the City Council considered oral and documentary evidence, and the entire contents of Case File No. SP-1-85 and IS-85-45, which is incorporated herein by reference; and WHEREAS, at the time of the public hearing the City Council considered the Valley Road Annexation EIR certified by the City Council on May 28, 1985 and the addendum to the EIR which was prepared October 10, 1985 to incorporate technical revisions and additions describing the subject project; and; WHEREAS, this action is taken pursuant to all applicable procedures required by State law and City Ordinance; and WHEREAS, the Planning the Bonita Valley Specific Plan 65451 pertaining to the content Commission and City Council have determined that is in compliance with Government Code Section of Specific Plans; and WHEREAS, the Planning Commission and City Council have determined that the Bonita Valley Specific Plan is in compliance with the National City General Plan; NOW, THEREFORE, BE IT ORDAINED that the Bonita Valley Specific Plan, a copy of which is on file in the Planning Department, and incorporated herein by reference, is hereby adopted subject to the following conditions: 1. All provisions and statements in the specific plan submitted to the City on October 10, 1985 by the Odmark Development Company shall be binding on the currently proposed development and all future development of the project site. 2. A detailed landscape plan, including plant types, method of planting, irrigation system, etc., showing the method for revegetation of the southern slope in the estate lot subdivision shall be submitted to the Planning Department for approval. The plan shall demonstrate that the revegetation will blend in with the natural vegetation in the immediate area. 3. Prior to recordation of the subdivision map for the project site Covenants, Conditions and Restrictions (CC&Rs) in compliance with the Specific Plan shall be recorded for the multi -family element and the single family estate lot element of the specific plan. The CC&Rs shall be subject to the a roval of the City Attorney prior to recordation. pp 4. All improvements (grading, landscaping, street improvements, etc.) for the estate lot subdivision shall be completed prior to occupancy of phase one of the multi -family development. 5. A detailed grading plan shall be submitted to the City Engineer prior to issuance of a grading permit. The grading plan shall incorporate all grading related mitigation measures identified in the Valley Road Annexation Environmental Impact Report and addendum. 6. School impact fees will be paid to the Chula Vista Elementary School District and the Sweetwater Union High School District per the agreement executed between Jon and Earl Jentz and the respective school districts dated March 22, 1985 and attached to the Specific Plan, prior to issuance of building permits for the multi -family development.
