HomeMy WebLinkAboutCC ORD 1984-1819 REZONING PROPERTIES LOCATED AT 2849, 2856, 2859, 2869 AND 2868 GROVE WAY AND PROPERTY LOCATED SOUTH OF PLAZA BOULEVARD AND EAST OF THE "L" AVENUE EXTENSIONORDINANCE NO. 1819 AN ORDINANCE REZONING PROPERTIES LOCATED AT 2849, 2856, 2859, 2869 AND 2868 GROVE WAY AND PROPERTY LOCATED SOUTH OF PLAZA BOULEVARD AND EAST OF THE "L" AVENUE EXTENSION (Case File Nos. ZC-2-84 and ZC-3-84) WHEREAS, pursuant to the terms and provisions of the Government Code of California, proceedings were duly initiated for the rezoning of those parcels of real property hereinafter described, and for the amendment of the Land Use Code of the City of National City; and WHEREAS, pursuant to due and legal notice, hearings were held by the City Planning Commission of said City and also by the City Council of said City, and all persons interested were given an opportunity to appear and be heard before said Planning Commission and said City Council; and WHEREAS, the City Planning Commission of National City has regularly and duly certified to the City Council its report and has recommended such rezoning and such amendment; NOW, THEREFORE, the City Council of the City of National City, California, does ordain as follows: SECTION 1: All protests, if any, against said rezoning and said amendment of the Land Use Code, and each of them, be and hereby are denied and overruled. SECTION 2: That all the below described real property is by this Ordinance rezoned as follows: 1. A change from General Plan Pre-Zone/Residential Single Family Small Lot (GP-PZ/RS-2) to General Plan Pre-Zone/General Commercial - Planned Development (GP-PZ/CG-PD): Those portions of Lots 5, 53, 54 and 55, Lincoln Acres, Map 1740, as recorded in the Recorder's Office of San Diego County, 6 December 1922, more particularly described as follows: Beginning at a point in the northerly line of aforesaid Lot 5, distant thereon 88.09 feet westerly from the northeasterly corner thereof, thence, Northeasterly along said line to the northeasterly corner of said Lot 5, thence, northeasterly in a straight line to the northwesterly corner of aforesaid Lot 55; thence, northeasterly along the northerly line of said Lot 55 to the northeast corner thereof; thence, southerly along the easterly line of said Lot 55 to the southeast corner thereof; thence westerly along the southerly line of said Lot 55 a distance of 88.75 feet; thence southerly in a straight line to the northeast corner of aforesaid Lot 53; thence, southerly along the easterly line of said Lot 53 a distance of 25 feet; thence, westerly along a line parallel with the northerly line of said Lot 53 to an intersection with the easterly line of Grove Street as said street is shown on aforesaid Map No. 1740; thence, northerly along said easterly line to an intersection with a radial line bearing South 820 52' east to a 250 foot radius curve; thence, north 820 52' West along said radial line to an intersection with the Westerly line of aforesaid Lot 5; thence, northerly along said westerly line to an intersection with an arc of a 275 foot radius curve concave northerly; thence, easterly along said arc to the Point Of Beginning. 2. A change from Heavy Commercial -Planned Development (CH-PD) to General Commercial -Planned Development (CG-PD): That certain Parcel II, Parcel Map No. 12079, Recorded in the Office of the San Diego County Recorder, 29 April 1982, more particularly described as follows: Beginning at the most easterly corner of aforesaid Parcel II and its intersection with the southerly line of Plaza Boulevard, thence, along the boundary of said Parcel II, South 710 05' 06" West a distance of 354.99 feet; thence, South 180 42' 53" East a distance of 330.96 feet; thence, South 18040'29" East a distance of 329.30 feet; thence, South 710 06' 33" West a distance of 361.68 feet; thence, South 180 43' 36" East a distance of 182.83 feet; thence, South 710 03' 24" West a distance of 131.88 feet; thence, North 180 41' 24" West a distance of 149.93 feet; thence, South 710 06' 36" West a distance of 130.08 feet; thence, North 180 41' 58" West a distance of 30.92 feet; thence, North 130 53' 36" West a distance of 444.39 feet to an intersection with a tangent curve concave to the East, having a radius of 167.50 feet; thence, northerly along the arc of said curve through an angle of 760 00' 00" a distance of 222.18 feet to a point of tangency; thence, North 620 06' 24" East a distance of 108.22 feet to an intersection with a tangent curve concave to the northwest, having a radius of 160.07 feet; thence, northerly along the arc of said curve through an angle of 510 52' 2 9" a distance of 144.92 feet to a point of tangency thence North 100 13' 55" East a distance of 148.18 feet to an intersection with a tangent curve having a radius of 29.50 feet; thence, northerly along the arc of said curve through an angle of 480 13' 29" to an intersection with a line bearing South 790 46' 05" East, said line also being the southerly line of Plaza Boulevard; thence, Easterly along the said southerly line of Plaza Boulevard and the Northerly line of aforesaid Parcel II to the Point of Beginning. 3. From Limited Commercial -Planned Development (CL- PD) to General Commerical -Planned Development (CG-PD): That portion of Lot 3, Lincoln Acres Map 1740, recorded in the Recorder's office of San Diego County, 6 December 1922, more particularly described as follows: Beginning at the southwesterly corner of aforesaid Lot 3, thence, northerly along the southerly line of said Lot 3 to an intersection with a radial line bearing South 820 52' East with a radius of 200 feet; thence North 820 52' West along said radial line a distance of 135.26 feet to the intersection with the Westerly line of said Lot 3; thence, southerly along the said westerly line to the Point Of Beginning. EXCEPTING THEREFROM that portion of Grove Street (Grove Way) as shown on aforesaid Map 1740 and as dedicated as Grove Way. 44 PASSED and ADOPTED this day of 777ezi-, , 1984.
