HomeMy WebLinkAboutCC ORD 1984-1835 ADOPTING THE UNIFORM BUILDING CODE, 1982 EDITION, AMENDING CHAPTER 70; AMENDING ORDINANCE NO 1713 AND CHAPTER 15.08 OF THE MUNICIPAL CODE OF THE CITY OF NATIONAL CITYc% e ORDINANCE NO. 1835 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA, ADOPTING THE UNIFORM BUILDING CODE, 1982 EDITION, AND APPENDIX, EXCEPT CHAPTER 12 THEREOF; AMENDING CHAPTER 70 ESTABLISHHING THE CITY ENGINEER AS THE ENFORCING OFFICER OF CHAPTER 70; THE UNIFORM BUILDING CODE STAN- DARDS 1982 EDITION; PROVIDING PENALTIES FOR THE VIOLA- TION THEREOF AND AMENDING ORDINANCE NO. 1713 AND CHAPTER 15.08 OF THE MUNICIPAL CODL OF THE CITY OF NATIONAL CITY. The City Council of the City of National City, California, does ordain as follows: SECTION 1. Ordinance No. 1713 and Chapter 15.08 of the Muni- cipal Code of the City of National City are hereby deleted and written to read as follows: 15.08.002 Finding and declaration. The city council speci- fically and expressly finds and declares that the nature and unique- ness of the climate, terrain, location, environment and rate of population growth of the city necessitates and demands specific changes in, and variations from the Uniform Building Code, 1982 Edition, which are noted in and made a part of this chapter. (Ord. 1713 1, 1980: Ord. 1587 1, 1977). 15.08.010 Adopted. There is adopted by the city council, for the purpose of prescribing regulations governing the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, use, height, area, fire resistance and maintenance of all buildings and/or structures, that certain code known as the Uniform Building Code, Appendix except Chapter 12 and U.B.C. Standards, published by the International Conference of Building Officials being particularly the 1982 edition thereof, save and except such portions as are deleted, modified, or amended in this chapter, of which code not less than three copies have been and are now on file in the office of the city clerk; and the same are adopted and incorporated as if fully set out at length herein, and from the date on which the ordinance codified herein takes effect, the provisions thereof shall be controlling within the limits of the city. (Ord. 1713 2, 1980: Ord. 1587 2, 1977; Ord. 1421 2, 1974). 15.08.015 Section 104(b) amend --Additions, alterations or repairs. Section 104(b) of the Uniform Building Code is amended to read as follows: "(b) Additions, Alterations or Repairs. Additions, %iterations or repair ',E. made to a nv hui ldin?, or structure the existing building or structure to comply with all the require- ments of this Code provided the addition, alteration or repair con- forms to that required for a new building or structure, Additions, alterations or repairs shall not cause an existing building or structure to become unsafe or overloaded. Any building so altered, which involves a change in use or occupancy shall not exceed the height, number of stories and area specified for new buildings. "Alterations or repairs to an existing building or structure which are not non-structural and do not adversely affect any struc- tural member or any part of the building or structure having required fire resistance may be made with the same materials of which the building or structure is constructed. "EXCEPTION 1. The installation or replacement of glass shall be as required for new installations. "EXCEPTION 2. The installation of wood shingle or shake roofing material for reroofing or repair shall be as required for new instal- lations." (Ord. 1787 1, 1982). 15.08.020 Section 201 amend --Department of Building and Safety. Section 201 of the code adopted by the ordinance codified herein is amended to read as follows: "Section 201. There is hereby established in the City of National City a Department of Building and Safety which shall be under the direction of the Director of Building and Safety designated by the appointing authority." (Ord. 1421 6, 1974). 15.08.030 Section 204 delete --Board of Appeals. Section 204 of the Uniform Building Code is hereby deleted. 15.08.035 Section 204 add --Advisory and Appeals Board. Section 204 is hereby added to read as follows: "The Advisory and Appeals Board is established by city ordinance #1324 adopted August 1, 1972. The Board shall have the jurisdiction to review the items as enumerated in Section 15.04.010(A) (B) (C) and (D) of this code. 15.08.040 Section 205 amend --Violations. Section 205 is hereby amended by adding a second paragraph to read as follows: "Section 205. ABANDONED CONSTRUCTION. Any abandoned building or structure or portion thereof in an incomplete condition inherently constitutes injury hazards and is otherwise dangerous to health, safety, "EXCEPTIONS" 1. One-story detached accessory buildings used as tool and storage sheds, play houses and similar uses, provided the projected roof area does not exceed 100 square feet. 2. Fences and free-standing walls not over six feet (6') in height located in residential zones, except when constructed of masonry and/or exceeds 6'-0" in height. 3. Oil derricks. 4. Cases, counters and partitions not over five feet (5') high. 5. Retaining walls and planter boxes which are not over four feet (4') in height measured from the top of the footing to the top of the wall unless supporting a surcharge or impounding flammable liquids. 6. Temporary motion picture, television and theater stage sets and scenery. 7. Window awnings supported by a exterior wall of Group R, Division 3, and Group M occupancies when projecting not more than 54 inches. 8. Prefabricated swimming pools accessory to a Group R, Division 3 occupancy in which the pool walls are entirely above the adjacent grade and if the capacity does not exceed 5,000 gallons. 9. Repairs which involve only the replacement of component parts of existing work with similar materials for the purpose of maintenance, and which do not aggregate over $500.00 in valuation in any twelve (12) month period, and which do not affect any electrical or mechanical in- stallations. Repairs exempt from permit requirements shall not include any addition, change, or modification in construction, exit require- ments, or permanent fixtures or equipment. Specifically excepted from permit requirements without limit to valuation are the following: I. Painting and decorating, exclude painting signs. II. Installation of floor covering. III. Cabinet work. IV. Outside paving. "Unless otherwise exempted by this code, separate plumbing, elec- trical and mechanical permits will be required for the above exempted items. "Exemption from the permit requirements of this code shall not he deemed to grant authorization for any work to he done it any manner in and the public welfare by reason of unprotected trenches and excava- tions, projecting structural elements, open pipe systems, exposed electrical conductors, and/or other conditions characteristic of construction projects. "(a) GENERAL. Whenever any building or structure, for which construction work has been authorized by a permit issued pursuant to this code, is abandoned in such an incomplete condition for a period in excess of 180 calendar days, said building or structure is, for the purpose of this section, an unsafe building and is hereby declared to be a public nuisance. Such public nuisance shall be abated in accor- dance with the procedures specified in Section 203 of the Uniform Building Code. (b) NOTICE TO PERMIT HOLDER. The Director of Building and Safety shall give notice to the permit holder of such abandoned construction as specified in Chapter 4 Abatement of Dangerous Buildings,Code. (c) RENEWAL PERMIT REQUIRED. Before construction work can be recommenced a renewal building permit shall be first obtained to do so, and the fees therefor shall be paid as specified in the schedule adopted by the city. (d) For the purpose of this section, the term "incomplete struc- ture" shall be interpreted to mean any building or structure described in paragraph (a) of this section and which is open to trespass by the public, or which constitutes a hazard to any official named in Section 202(a) and (b), any police/officer, fire official, or other authorized person entering upon the premises in the performance of any official duty required by this code or other ordinance or law. Fencing shall not be deemed as closing such premises to trespass as described herein." (Ord. 1421 5, 1974). 15.08.050 Section 301(a) delete and amend --Permits required. Section 301(a) is deleted and amended to read as follows: "Section 301(a). PERMITS REQUIRED. No person, firm or corpor- ation shall erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish any building, structure, or sign in the City of National City, or cause the same to be done, without first obtaining a separate building permit for each such building, structure or sign from the Director of Building and Safety. violation of the provisions of this code or any other laws or ordinances of this jurisdiction." (Ord. 1787 6, 1982: Ord. 1421 7, 1974). 15.08.060 Section 304 amend--Permits--fees. Section 304 of the code adopted by ordinance codified herein is amended by revising subsection (b) (d) and adding subsections (f) , (g) , (h) , (i) , and (j) to read as follows: "(b) Plan Review Fees. When a plan or other data are required to be submitted by Subsection (b) of Section 302, a plan permit filing fee per Section 15.08.060(h) and plan review fee as enumerated in the schedule prepared and adopted by the city shall be paid at the time of submitting plans and specifications to the Building and Safety Department. When plans are incomplete or changed so as to require additional plan review and additional fees shall be charged as enumerated in the schedule prepared and adopted by the city. (d) Investigation Fees: Work without a Permit. 1. Investigation. Whenever any work for which a permit is required by this code has been commenced without first obtaining said permit, a special investigation shall be made before a permit may be issued for such work. 2. An investigation fee of fifteen dollars ($15.00) in addition to the permit fee, shall be collected whether or not a permit is then or subsequently issued. The payment of such investigation fee shall not exempt any person from compliance with all other pro- visions of this code nor from any penalty prescribed by law. (f) Compliance Survey Fee. The fee for conducting a compliance survey of an existing building or structure shall be paid to the Director of Building 4 Safety at the rate of $.05 per square foot, with a minimum of fifty dollars ($50.00) for each unit located in buildings and/or structures. (g) Energy Plan Check Fee. The fee for state -mandated energy plan checking shall be ten cents per square foot for residential buildings and five cents per square foot for commercial and industrial buildings. (Ord. 1629 3(c), 1978). (h) Permit Filing Fee. A permit filing service fee of fifteen dollars ($15.00) shall be paid for each project submitted to the city for review. (i) Reinspection Fee: Whenever it shall be necessary to make an extra inspection to any project due to incorrect address and/or any reason enumerated in Section 305(g) a reinspection fee of fifteen dollars ($15.00) may be charged as determined by the Director of Building and Safety. (j) EXCEPTIONS. The United States, the State of California, the County of San Diego, the City of National City, and other public agencies shall not be required to pay any fees for filing an appli- cation for a building permit pursuant to this code. 15.08.070 Section 305 amend --Inspections. Section 305 of the code adopted by ordinance codified herein is amended by revising subsection (g) paragraph four (4) and by adding subsection (h). (g) To obtain a reinspection, the permittee shall file an appli- cation therefor in writing upon a form provided for that purpose, and pay the reinspection fee per schedule entitled building valuation multipliers. (h) Compliance Survey Inspection. Upon receipt of a written request for a compliance survey from the owner and after the fee speci- fied in section 304(f) has been paid, the Director of Building and Safety may inspect an existing building or structure to ascertain its compliance with the provisions of this code and other applicable laws and ordinances, and report his findings in writing to such owner. 15.08.075 Chapter 3 delete --Table 3-A Building Permit Fees. Delete Table 3-A--Building Permit Fees. 15.08.080 Chapter 3 add --Section 308--Building Permit Fees. Add Section 308, Building Permit Fees to read as follows: "When plans and other data are submitted to the city for plan review, fees as set forth in the schedule entitled, 'Building Permit Fees, effective July 1, 1980' shall be remitted." 15.08.085 Section 503(d) amend --Fire Rating for Occupancy Separations. Section 503(d) is amended by adding No. 6 to read as follows: "6. The kitchen serving the dining area of which it is a part." 15.08.090 Section 513 amend --Premises identification. Section 513 is amended to read as follows: Every principal building or structure located within the incor- porated limits of the City of National City shall be identified by a designated street number as issued by the Director of Building and Safety. Approved numbers, or addresses, shall be placed on all new and existing buildings adjacent to the principal entrance where the numbers posted at the entrance shall be posted on the building or at a point that is plainly visible and legible from the street on which is addressed. If necessary, directional signs shall be posted showing proper access to a given address, from the point where the Fire Department access roadway leaves the dedicated street, to the entrance of each addressed building. All such numbers shall be placed on a contrasting background. 15.08.095 Section 514 add --Fire Protection. Section 514 is added to the code adopted by the ordinance codified herein to read as follows: "Section 514. FIRE PROTECTION. All premises where buildings or portions of buildings are hereafter constructed shall comply with Part III of the currently adopted edition of the Uniform Fire Code." (Ord. 1421 12, 1974). 15.08.100 Section 705 amend --Light, Ventilation and Sanitation. Section 705 is amended by adding to 4th paragraph access to read as follows: ACCESS. Where there are two (2) or more places of business within a single building, with the exception of food handling establishments, common restrooms, one for each sex may be provided. The entrances for such restrooms shall open on a common accessway." (Ord. 1424 5, 1974). 15.08.105 Section 1102(c) add --Shade Structures --oversize. Section 1102(c) is amended by adding to read as follows: "EXCEPTION: Agricultural and nursery shade structures used only for the protection of live plants and vegetation, when covered with non—combustible or plasticized materials which are inherently flame retardant and which are approved for exterior use, may exceed 1,000 square feet in area." (Ord. 1421 13, 1974). 15.08.110 Section 1103 amend --Shade structures --Location on property. Section 1103 of the code adopted by the ordinance codified herein is amended by adding thereto as follows: "Agricultural and nursery shade structures used only for the pro- tection of live plants and vegetation, when covered with noncombustible or plasticized materials which are inherently flame retardant and which are approved for exterior use, and shall not be less than ten feet (10') from any adjacent property line if the covered area exceeds 1,000 square feet." (Ord. 1421 14, 1974). 15.08.115 Section 3203 delete --APPLICATION (G), (H). Section 3203 Application (G) and (H) is hereby deleted. 15.08.120 Section 3203(f) delete (5) and (6)--Ordinary Roof Covering. Amend (5) and (6) . Section 3203(f) is amended by deleting (5) and (6) and rewriting to read: "5. Wood Shingles: (a) New roofs. Treated wood shingles applied to solid sheathing and as specified in Tables 32A f B. (b) Reroofing. Treated wood shingles applied to solid sheathing or existing spaced sheathing as specified in Tables 32 A , B and Appendix Chapter 32 Reroofing. 6. Wood Shakes: (a) New Roofs. Treated wood shakes applied to solid sheathing and as specified in Tables 32 A F B. (b) Reroofing. Treated wood shingles applied to solid sheathing or existing spaced sheathing and as specified in Tables 32 A & B and Appendix Chapter 32 Reroofing. 15.08.125 Section 3203(g) delete --Special Purpose Roofs. Section 3203(g) Special purpose roofs is hereby deleted. 15.08.130 Section 3802(a) amend --Automatic Fire -extinguishing systems. Section 3802(a) of the Uniform Building Code adopted by this chapter is amended by adding a paragraph to read as follows: "Section 3802(a) In every building regardless of occupancy group or type of construction when such building is more than 40 feet or 4 stories in height." (Ord. 1421 23, 1974). 15.08.135 Section 715(c) Appendix -amend --Kiosks. Section 715(c) Kiosks. Kiosks and similar structures within the mall (temporary or permanent) shall meet the following requirements: 1. They must be constructed of noncombustible materials or fire retardant treated wood. 2. They are provided with automatic sprinklers if roofed over in such a manner as to obstruct sprinkler discharge from the building sprinkler system. 3. They are separated from each other by at least 20 feet. 4. They are pot over 300 square feet in area. 15.08.140 Section 1110 Appendix add --Exterior walls and openings. "Exceptions." Section 1110 exterior walls and openings "exceptions" to read as follows: "Exceptions" is enumerated in Chapter 11 Sections 1102(c) and 1103. 15.08.145 Chapter 12 Appendix delete --Requirements for Group R, Division 3 Occupancy. Chapter 12 Appendix is hereby deleted. 15.08.150 Chapter 70 Appendix amend --Excavation and Grading. Chapter 70 Appendix Excavation and grading is hereby amended to read: "The term 'Building Official' as contained therein is amended to read 'City Engineer of the City of National City.'"
