HomeMy WebLinkAboutCC ORD 1983-1794 ADOPTING PURSUANT TO GOVERNMENT CODE SECTION 658.58 AS AN URGENCY MEASURE ESTABLISHING STANDARDS FOR MOTEL DEVELOPMENTORDINANCE NO. 1794 AN INTERIM ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA, ADOPTED PURSUANT TO GOVERNMENT CODE SECTION 65858 AS AN URGENCY MEASURE ESTABLISHING STANDARDS FOR MOTEL DEVELOPMENT WHEREAS, certain motel units equipped with kitchen facilities are being used for other than transient use, in violation of City ordinances; and WHEREAS, certain existing motels generate a high level of criminal activity and demands for police services; and WHEREAS, adequate land use controls do not currently exist to protect residential neighborhoods from adjacent motel development; and WHEREAS, several applications to construct motels are currently pending building permit approval; and WHEREAS, in order to protect the health, safety, and welfare of the citizens of the City of National City it is essential to prohibit kitchen facilities in newly constructed motels, to subject all proposed motels to conditional use permit approval, and prohibit motels to be constructed further than 1500 feet from a freeway; and WHEREAS, the City Council intends to adopt, after appropriate study, zoning regulations governing motels throughout the City as soon as practicable and directs the Planning Commission of the City of National City to commence studies and procedures necessary for the adoption of such a permanent zoning ordinance; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of National City that: SECTION 1: It shall be unlawful to install kitchen or kitchenette facilities in any motel unit except for a single unit in each complex specified for the use of a resident manager. SECTION 2: Any proposal for a motel shall be subject to the approval of a conditional use permit by the Planning Commission of the City of National City. SECTION 3: No motel shall be permitted farther than 1500 feet from a freeway. SECTION 4: This ordinance is an urgency ordinance necessary for the immediate preservation of the public health, safety, and welfare within the meaning of the California Government Code and shall go into effect immediately. PASSED AND ADOPTED this 28th day of June, 1983.
