ORDINANCE AMENDING TITLE 18 (ZONING)
OF THE NATIONAL CITY MUNICIPAL CODE
TO PROHIBIT THE ESTABLISHMENT OF SECOND
UNITS IN SINGLE FAMILY RESIDENTIAL ZONES
WHEREAS, the City is required by California
Government Code Section 65852.2 to prepare an ordinance
regulating second units; and
WHEREAS, the City's adopted General Plan
specifically discourages the establishment of second units in
single family residential zones; and
WHEREAS, the prospect of limiting housing
opportunities in the region by prohibiting second units in
single family zones is mitigated by National City's abundance
of low and moderate -income housing as documented by the San
Diego Association of Governments; and
WHEREAS, this prospect is further mitigated by the
construction of Morgan Towers Senior Citizens' complex, as
well as the housing rehabilitation and assistance programs
administered by the National City Community Development
Commission; and
WHEREAS, allowing second units in single family
neighborhoods will have the following specific adverse impacts
on the public health, safety and welfare:
1. Existing neighborhood patterns will be
disrupted.
2. Existing conditions of blight and
deterioration will proliferate.
3. Health and psychological problems will be
created due to overcrowding.
4. Excessive demands will be placed upon
police and fire protection services.
5. In light of decreasing State subventions,
an added fiscal drain would be placed on
the City to enforce a permissive second
unit ordinance.
6. Further strain will be placed on an aging
sewer system, leading to possible future
capacity problems.
7. Additional traffic congestion will be
caused on major streets currently
functioning above design capacity during
rush hour.
8. Aesthetic impacts on neighborhoods will
result from unplanned residential
construction.
9. An increase in neighborhood noise levels
and demands for noise ordinance
enforcement will occur.
10. New construction in private, open space
areas would deprive existing residences
of adequate natural light and air
circulation.
NOW, THEREFORE, BE IT ORDAINED by the City Council
of the City of National City that Section 18.14.160 of the
National City Land Use Code be amended to add the
following:
G. Second units, or granny flats, as defined in
Section 65852.2 of the Government Code, are prohibited in
the RS-1 and RS-2 zones. Second units are permitted in
all other residential zones provided they comply with all
development standards of the zone.

with by a vote of not less than a majority of the members elected to the
Council and that there was available for the consideration of each mem-

or printed copy of said ordinance.
