HomeMy WebLinkAboutCC ORD 1983-1801 ACCOMDATE NEW COMBINED GENERAL PLAN/ZONING MAPORDINANCE NO. 1801 de_d 4,1 ti 4,?) )57 (- I AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA AMENDING THE MUNICIPAL CODE OF THE CITY OF NATIONAL CITY RELATING TO ZONE CATEGORIES TO ACCOMMODATE THE NEW COMBINED GENERAL PLAN/ZONING MAP BE IT ORDAINED by the City Council of the City of National City as follows: SECTION 1: Section 18.10.130 of the National City Municipal Code is amended to read as follows: 18.10.130 Zones established. See Section 18.14.200. SECTION 2: Repeal Chapter 18.12 Residential Density Map in its entirety. SECTION 3: Section 18.14.035 is hereby added to read as follows: 18.14.035 Purpose of the Single Family Extendable (RS-3) Zone. The purpose of the RS-3 zone is to provide for areas of single family detached homes on lots which cannot be subdivided in accordance with the Land Use Code. Permits one detached single family dwelling for each full 5,000 square feet of lot area. SECTION 4: Section 18.14.050 is amended to read as follows: 18.14.050 Purpose of the Multi -Family (RM-1) Residential Zone. The purpose of the RM-1 zone is to provide, in accordance with the General Plan for multi -family residential development areas allowing one dwelling unit for the first full 5,000 square feet of lot area, a second unit for the next full 4,000 square feet, and an additional unit for each full 3,000 square feet of lot area. SECTION 5: Section 18.14.060 is amended to read as follows: 18.14.060 Purpose of the Multi -Family existing (RM-2) Zone. Regulates existing large-scale multi -family complexes and allows their continued presence. SECTION 6: Section 18.14.070 is amended to read as follows: 18.14.070 Purpose of the Senior Citizens Housing Zone. Regulates government sponsored senior citizen housing projects. SECTION 7: Section 18.14.090 - Table II is amended to read as follows; 18.14.090 Principal Uses and Structure Permitted. SECTION 8: Section 18.14.092 is hereby added to read as follows: 18.14.092 Number of dwelling units allowed. RM-2 Per existing development RM-3 Determined by Planned Development Permit SECTION 9: Section 18.14.160 (F) is amended to read as follows: 18.14.160 Prohibited Uses and Structures. •F. Churches are prohibited in the RS-1, RS-2, RS-3 and RMH zones. SECTION 10: Section 18.14.200 is amended to read as follows: 18.14.200 Lot area. The following minimum lot areas are established for residential zones. Adjacent to each single family unit in the RS-3 Zone, there shall be a usable open space area with a minimum dimension of 20 feet. SECTION 13: Section 18.14.310 (A) is amended to read as follows: 18.14.310 Spacing of buildings. A. If two or more dwellings are placed on the same lot in the RT, RM, or RS-3 zones, they shall be at least ten feet apart if placed side by side, and at least fifteen feet apart if located in any other manner. SECTION 14: Section 18.14.350 is amended to read as follows: 18.14.350 Building floor area ratio --RM zones. In the RM zones, each lot or parcel of land shall have a maximum floor area ration (F.A.R.) as follows: Zone RM-1 RM-2 RM-3 F.A.R. 1 2 Determined by Planned Development Permit SECTION 15: Section 18.14.360 is amended to read as follows: 18.14.360 Building floor area requirements. SECTION 16: Section 18.14.390 is amended to read as follows: 18.14.390 Off-street parking --minimum requirements. In the residential zones, the minimum requirements for off-street parking are as follows: Zone Minimum Requirements RS-1 An attached or detached private garage or carport or combination thereof for not less than two cars. RS-2 & RS-3 Two spaces per dwelling unit, one of which shall be in an an attached or detached private garage or carport. RT 0ne and one half spaces per dwelling unit. RM-1 & RM-2 0ne and three tenths spaces per one bedroom unit and studio unit and one and one-half spaces per two bedroom or more unit. RM-3 Per Planned Development Permit RMH Two spaces per unit SECTION 17: The title of Section 18.16.040 is amended to read as follows: 18.16.040 Purposes of the Medium Commercial (CM) zone. The purposes of the CM zone are to: SECTION 18: Section 18.16.091is amended to read as follows: 18.16.050 Purpose of the General Commercial (CG)zone. The CG zone is intended for high intensity commercial and complimentary development along major roadways and in community shopping complexes; also allows residential development in certain situations (See Section 18.16.271) SECTION 19: Table V (Use Groups Permitted in Commercial Zones) of 18.16.090 is amended as follows: 18.16.090 Principal Uses and structures Permitted. Add Use Group 22 (Light Manufacturing in Appendix D under CH. (Attached is Exhibit "A" a part hereof) SECTION 20: Portions of Table VI (Accessory Uses Permitted in Commercial Zones) of 18.16.100 are amended to read as follows: 18.16.100 Accessory Uses Table VI Accessory Uses in Commercial Zones Auctions with antique or used furniture sales, conditional use permit required Catering services Automobile body and paint shop, accessory to new car agency CM, CG, CH CM, CG, CH All zones except CL, CT and CG 18.16.190 18.16.200 18.16.210 SECTION 21: Section 18.16.250 (B) is amended to read as follows: 18.15.250 Prohibited uses and structures. B. Residential uses are prohibited in all C zones, except the CG zone. (See Section 18.16.271) SECTION 22: Section 18.16.271 is amended to read as follows: 18.16.271 Residential uses in the CG zone. A. New residential develop- ment shall be allowed in the CG zone if approved by the issuance of a condi- tional use permit, and provided such residential development is shown on a redevelopment plan adopted by the City Council. B. Notwithstanding the provisions contained in subsection A, all residential uses permitted in the RS-2 zone are permitted in the CG zone; provided that new residential development shall be limited to those blocks that are sub- stantially in residential use. The issuance of a conditional use permit for such use shall be required. SECTION 23: Section 18.16.310 is amended to read as follows: 18.16.310 Required yards and setbacks. All structures hereafter designed or erected in the commercial zones, and existing buildings which may be reconstructed, altered, moved, or enlarged in the commercial zones, may not exceed the height, floor area ratio (F.A.R.) or lot coverage as indicated in Table VIII for the zone in which the buildings are or may be located. Pursuant to Govern- ment Code, Title 7, Article 8 (Authority for and Scope of Specific Plans), there is adopted a specific plan for the CG zone, specifically requiring that: A. Upon adoption of the National City Land Use Code, all that property formerly zoned C-3-B by Ordinance 962, and made a part of the CBD zone, and subsequently CG, shall maintain minimum front yard setback of five feet; provided, however, all properties abutting Highland Avenue shall maintain a minimum ten -foot setback. (See SP-3-75) B. Upon adoption of the National City Land Use Code, all that property formerly zoned C-3-C by Ordinance 962, and made a part of the CBD zone and subsequently CG, shall maintain a minimum front yard setback of zero feet; provided, however, all properties abutting Highland Avenue shall maintain a minimum ten -foot setback. (See SP-3-75) SECTION 26: Chapter 18.21 Open Space Reserve (OSR) Zone is added to read as follows: Sections: 18.21.010 Intent and Purpose 18.21.020 Applicability 18.21.030 Principal Uses Permitted 18.21.010 Intent and Purpose. The purpose of the Open Space Reserve (OSR) zone is to provide a use category to include public and private lands, play- grounds, salt marsh and coastal wetlands, water areas, uninhabited agricultural lands, recreational lands, public utility areas, flood control channels, and other scenic and open space areas shown in the "Open Space and Conservation Element" of the City's General Plan and Local Coastal Program. It is also the intent of this zone to provide for permanent open space use in the City by restricting development in such areas as designated on the zoning map. 18.21.020 Applicability. When any property on the Zoning Map bears the symbol OSR, the provisions of this chapter shall apply. 18.21.030 Principal Uses Permitted. The principal uses permitted in the Open Space'Reserve Zone are separated into Open Space Reserve (Water Areas) and Open Space Reserve (Land Areas). These uses are designated by use groups. The use groups are collections of individual uses of a similar character and are fully described in Chapter 18.104. Establish Use Group 38 in Appendix D - Open Space Reserve (Water Areas). Typical permitted uses: Minor public facilities; Restorative measures; Nature study. Establish Use Group 39 in Appendix D - Open Space Reserve (Land Areas) Typical permitted uses: Open space; Open space recreation: Landscaped areas; Bikeways, paths, and trails; Hiking trails; Equestrian trails: Public recreation and educational facilities; Picnic areas; Public access; Playgrounds; Bay access; Utility easements; Railroad rights -of -way Freeway rights -of -way Aquaculture SECTION 27: The following list is hereby added to Section 18.22.020: 18.22.020 Effect of Regulations. -CL Coastal Zone -UPD -D GP-PZ GP-TZ Unified Port District Residential Density Pre -Zone Tentative Zone SECTION 28: Section 18.23 is added See Chapter 18.39 See Chapter 18.41 See Chapter 18.23 See Chapter 18.33 See Chapter 18.35 to read as follows: Chapter 18.23 Residential Density Combining Zone. Sections: 18.23.010 Intent and Purpose 18.23.020 Applicability 18.23.030 Regulations 18.23.010 Intent and Purpose. The intent and purpose of the residential density combining zone is to designate specific densities development for residential properties. 18.23.020 Applicability. When a property bears on the zoning map of the City, in addition to its zone designation the symbol "D" followed by a numerical figure, the provisions of this Chapter shall apply. 18.23.030 Regulations. No property shall be used for a total number of dwelling units in excess of the number obtained by multiplying the total area, in square feet, of such property by the density figure shown on the zoning map, divided by the area of one acre (forty-three thousand five hundred sixty square feet). SECTION 29: Section 18.33 General Plan Pre -Zone GP-PZ ( ) is hereby added to read as follows: Sections: 18.33.010 18.33.020 18.33.030 Intent and Purpose Applicability Regulations generally 18.33.010 Intent and Purpose. The intent and purpose of the Pre -Zone designation is to enable the City to pre -zone unincorporated territory adjoining the City for the purpose of determining the zoning that will apply to such property in the event of subsequent annexation to the City per California State Government Code Section 65859. 18.33.020 Applicability. This overlay symbol will be preceeded on the General Plan/Zoning Map by a zoning symbol representing the underlying zone designation. 18.33.030 Regulations Generally. The zoning symbol shown in parentheses ( ) within the General Plan - Pre -Zone GP-PZ ( ) overlay symbol will convert to permanent status and the GP-PZ symbol will be removed from the General Plan/Zoning Map when the property is annexed to the City; which annexation orders such permanent status. SECTION 30: Chapter 18.35 General Plan -Tentative Zone: GP-TZ ( ) is hereby added to read as follows: Chapter 18.35 General Plan - Tentative Zone - GP-TZ ( ) 18.35.010 Intent and Purpose 18.35.020 Applicability 18.35.030 Regulations generally 18.35.010 Intent and Purpose. The purpose of the General Plan Tentative Zone is to apply a temporary zone to a property until such time as a Specific Plan has been adopted. 18.35.020 Applicability. This overlay symbol will be preceeded on the General Plan/Zoning Map by a zoning symbol representing the underlying zone designation. 18.35.030 Regulations Generally. The zoning symbol shown in parentheses ( ) within the General Plan - Tentative Zone GP-TZ ( ) overlay symbol will convert to permanent status and the GP-TZ symbol will be removed from the General Plan/Zoning Map when a Specific Plan for that property has been adopted, which plan orders such permanent status. Until such permanent status is achieved, the property will be subject to the pertinent regulations of the underlying zone shown on the Map. SECTION 31: Chapter 18.39 Coastal Zone (-CZ) is hereby added to read as follows: Chapter 18.39 Coastal Zone ( -CZ) Sections: 18.39.010 Intent and Purpose 18.39.020 Applicability 18.39.030 Regulations generally 18.39.010 Intent and Purpose. The intent and purpose of the Coastal Zone is to identify and give notice that properties within this zone are affected by the City's Local Coastal Program. 18.39.020 Applicability. When any property bears on the zoning map of the City, in addition to its zone designation, the symbol -CZ, the provisions of this Chapter shall apply. 18.39.030 Regulations generally. In addition to meeting the requirements of the underlying zone, any use on a property bearing the symbol -CZ on the Zoning Map must in addition meet the provisions of the City's Local Coastal Program. SECTION 32: Chapter 18.41 Unified Port District Zone (UPD) is hereby added to read as follows: Chapter 18.41 Unified Port District ( -UPD) Sections: 18.41.010 Intent and Purpose 18.41.020 Applicability 18.41.030 Regulations generally 18.41.010 Intent and Purpose. The intent and purpose of the UPD Zone is to identify and give notice that properties within this zone are contained within the San Diego Unified Port District. 18.41.020 Applicability. When any property bears on the Zoning Map of the City, in addition to its zone designation the symbol "UPD" the provisions of this chapter shall apply. 18.41.030 Regulations generally. In addition to meeting the requirements of the underlying zone, any use on a property bearing the symbol UPD on the Zoning Map must comply with the zoning regulations outlined in document 32405 on file with the City Clerk.
