HomeMy WebLinkAboutCC ORD 1982-1770 REGULATING USE OF PRIVATE VIEWING ROOMS IN ESTABLISHMENTS VWHICH SELL OR RENT PRE-RECORDED VIDEO TAPES, MOVIES, TRANSPARENCIES, FILMS, PROJECTABLES MOTION PICTURES OR EQUIPMENT.ORDINANCE NO. 1770 AN INTERIM ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA, ADOPTED PURSUANT TO GOVERNMENT CODE SECTION 65858 AS AN URGENCY MEASURE REGULATING THE USE OF PRIVATE VIEWING ROOMS IN ESTABLISHMENTS WHICH SELL OR RENT PRE-RECORDED VIDEO TAPES, MOVIES, TRANSPARENCIES, FILMS, PROJECTABLE MOTION PICTURES OR EQUIPMENT USED FOR SHOWING ANY OR ALL OF THESE ITEMS WHEREAS, it has been brought to the City Council's attention the showing of pre-recox.ded video tapes, movies, transparencies, films, projectable motion pictures or equipment in a private viewing room could lead to the sale or display of sexually oriented materials in violation of the National City Municipal Code. WHEREAS, the City Council finds the showing of the aforementioned materials in a small private viewing rooms could be a fire hazard if not properly constructed, a health hazard if not properly ventilated or lit, and could promote criminal activity due to the possible subject matter viewed and the enclosed private nature of said rooms; WHEREAS, the City Council finds it essential to protect th.e public's health, safety and welfare of the citizens of the City of National City by placing a temporary moratorium on the installation and use of private viewing rooms in conjunction with establishments which sell or rent the aforementioned materials; and WHEREAS, this City Council intends to adopt, after appropriate study, zoning regulations governing these establishments throughout the City as soon as practicable and directs th.e Planning Commission of this City to commence studies and procedures necessary for the adoption of such a permanent zoning ordinance; NOW, THEREFORE, BE IT ORDAINED as follows: SECTION 1. It shall be unlawful for any business establishment which sells or rents pre-recorded video tapes movies, transparencies, films, projectable motion pictures or equipment used for showing any or all these items to offer or allow the viewing of these materials in private viewing rooms. A private viewing room is an area separated from the sales or display area of the establishment by a curtain, wall, door, shade or similar obstruction thus allowing the private viewing of video tapes, movies, transparencies, films or projectable motion pictures by customers at said establishments. This ordinance is an -urgency ordinance necessary for the immediate preservation of the public peace, health, or safety within the meaning of the California Government Code and shall go into mmediate effect. PASSED AND ADOPTED this llth day of May, 1982.
