AN ORDINANCE AMENDING TITLE 18 (ZONING) OF THE
NATIONAL CITY MUNICIPAL CODE TO REQUIRE GASOLINE
SERVICE STATIONS TO PROVIDE AIR, WATER AND
RESTROOM FACILITIES FOR SERVICE STATION CUSTOMERS

BE IT ORDAINED by the City Council of
National City, California, as follows:
SECTION 1.

Ordinance No. 1773 is hereby repealed in
its entirety.
Chapter 18.98 of the National City
Municipal Code is hereby amended by adding
a new sub -section 18.98.190 to read as
follows:
18.98.190 Supplying services generally required by
motorists.
A. New gasoline service stations shall provide free
air, water and restroom facilities for service
station customers.
B. Existing gasoline service stations that currently
have these facilities shall continue to maintain
them for use by customers.
C. Existing gasoline service stations that previously
offered these facilities but no longer do, shall
re -install and once again provide them within a
five (5) year abatement period of the adoption
of this ordinance.
SECTION 3.
Chapter 18.04 (Definitions) of the National
City Municipal Code is hereby amended and
changed as follows:
18.04.068 Automobile service station. "Automobile
service station" means a retail place of business
engaged in the sale of motor fuels and in supplying
goods and services generally required in the operation
and maintenance of automotive vehicles and the
fulfilling of motorist needs. These shall include
free air, water and restroom facilities for service
station customers, and may include any of the items
included under "major automobile repair" or "minor
automobile repair", as defined in Sections 18.04.064
and 18.04.066 respectively.
SECTION 4. Chapter 18.108 of the National City
Municipal Code is hereby amended by adding a new sub-
section 18.108.152 to read as follows:
18.108.152 Abatement of nonconforming service stations
lacking facilities.
Service stations, as described in Section 18.98.190 (C),
found to have had free air, water and restroom
facilities for service station customers, but which
have been modified to remove any of these facilities
shall reinstall and again provide them within a
period of five (5) years.

and the days of its final passage, to wit, on June 22? 1982

with by a vote of not less than a majority of the members elected to the
Council and that there was available for the consideration of each mem-
ber of the Council and the public prior to the day of its passage a written
or printed copy of said ordinance.
