HomeMy WebLinkAboutCC ORD 1981-1744 Interim limitation on use of mechanical and or electronic video game machines (Not codified)1744 ORDINANCE NO. 1744 AN INTERIM ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA ADOPTED PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 65858 AS AN EMERGENCY MEASURE LIMITING THE NUMBER OF MECHANICAL AND/OR ELECTRONIC VIDEO GAME MACHINES THAT MAY BE PLACED IN A BUSINESS AS AN INCIDENTAL USE. WHEREAS, several inquiries regarding the use of mecnanical and/or electronic video game machines as an incidental use have come into the Planning Department; and, WHEREAS, the National City Police Department has continually voiced concern over traffic that businesses employing game machines generate, and the strain that such uses put on police services; and, WHEREAS, the National City Land Use Code gives no definition regarding the number of mechanical and/or video game machines that constitute a primary use versus an incidental use; and, WHEREAS, a need has clearly been shown for limita- tions on th.e use of mechanical and/or electronic video game machines; NOW, THEREFORE, the City Council of the City of National City does ordain as follows: SECTION 1. For th.e duration of this ordinance the use of mechanical and/or electronic video game machines, as an incidental use, shall be limited to two (2) machines or the area of use shall be limited to 49% of the gross floor area of the business. SECTION 2. The Planning Commission is directed to commence the necessary proceedings, and to prepare pro- posed zoning regulations for the future regulation of mechanical and/or electronic video machines as an incidental use, Municipal Code Chapter 18.16.100, Accessory Uses. SECTION 3. This, ordinance is adopted as an interim ordinance as an urgency measure for these reasons set forth herein, in the interest of preserving th.e health, safety and general welfare o.f the people of the city. SECTION 4. This ordinance will become effective immediately upon adoption. PASSED AND ADOPTED this 28th Day of April, 1981.
