AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA,
ADOPTED AS AN "URGENCY MEASURE", TO PROVIDE FOR HOUSING
LAW ENFORCEMENT SERVICES AS REQUIRED AND SPECIFIED BY
CALIFORNIA HEALTH AND SAFETY CODE SECTION 17961; AND,
TRANSFERRING RESPONSIBILITY FOR MOBILE HOME PARK IN-
SPECTIONS TO THE STATE OF CALIFORNIA DEPARTMENT OF
HOUSING AND COMMUNITY DEVELOPMENT; PURSUANT TO CALIFORNIA
HEALTH AND SAFETY CODE SECTION 18300 AND, RELATED ADMINIS-
TRATIVE MODIFICATIONS NECESSARY FOR THE IMPLEMENTATION OF
THESE ACTIONS.
WHEREAS, National City has a substantial inventory
of housing and mobile home parks that because of obsolesence,
poor maintenance, deterioration and neglect of sanitation
have exhibited need for immediate remedy and correction, and
WHEREAS, the probability of health hazard is high
and the city's ability to provide housing inspection services
has been curtailed by fiscal constraints, the need for im-
mediate action is essential, and
WHEREAS, the city is precluded by law from making
housing inspections with present staff personnel, and is
further unable to fund the expense of hiring the required
registered sanitarian to perform the needed work, it is
crucial to achieve a solution and put it into effect im-
mediately;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY DOES ORDAIN AS FOLLOWS:
SECTION I. All references in the National City
Municipal Code, hereinafter NCMC, to the "Department of
Building and Housing", are amended to read, "Department of
Building and Safety".
SECTION II. All references in the NCMC to the
"Director of Building and Housing" are hereby amended to
read, "Director of Building and Safety".
SECTION III. Section 15.16.020 of the National
City Municipal Code is hereby amended to read as follows:
"15.16.020 Section 201(a) amended --Authority.
Section 201(a) of the Uniform Housing Code
adopted by this chapter is amended to read as follows:
Section 201(a) Authority. The San Diego County Health
Department is designated as the agency responsible for
issuing housing permits, collecting fees therefor, and
making all housing inspections pursuant to this code.
The National City Department of Building and
Safety retains all other jurisdiction for the issuance
of building permits of all kinds, making building in-
spections and collecting fees thereunder."
SECTION IV. Annual Housing Permit fees shall be
billed and collected by the San Diego County Health Department.
SECTION V. The National City "Bureau of Housing"
is abolished herewith. Section 15.16.020 of the National
City Municipal Code is hereby repealed.
SECTION VI. Section 15.16.080 of the National City
Municipal Code is hereby amended to change "Director of Build-
ing and Housing" to read "County Health Officer", pursuant to
the agreement between the City of National City and the County
of San Diego entered as Document No. 159438 on June 16, 1953.
SECTION VII. Section 15.16.060 of the National City
Municipal Code is hereby amended to read as follows:
"A new Section 305 is added to the Uniform
Housing Code adopted by this chapter to read as follows:
All fees for housing permits and housing permit
inspections shall be set by resolution of the
city council and shall be in accordance with
the San Diego County fee schedule then in effect.
The city council may, from time to time, consider
amendments to the adopted fee schedule to main-
tain that accordance, which amendments may be
made by resolution of the city council."
SECTION VIII. National City hereby cancels its
assumption of enforcement of the State Mobile Homes Parks
Act pursuant to Section 18300(e) of the California Health and
Safety Code and returns to the State of California the enforce-
ment responsibility for the mobile home and mobile home park
law within all mobile home parks in the City of National City.
This ordinance is an urgency ordinance necessary
for the immediate preservation of the public peace, health
and safety within the meaning of the California Government
Code and shall go into immediate effect. In order for this
ordinance to properly implement the provisions of State
Mobile Homes Parks Act pursuant to Section 18300(e) of the
California Health and Safety Code, it is necessary that this
ordiance take effect immediately.

City, passed and adopted by the council of said City on
