HomeMy WebLinkAboutCC ORD 1990-1994 Adopts local coastal program implementation and rezones property (Special)ORDINANCE NO. 1994 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, ADOPTING THE LOCAL COASTAL PROGRAM -IMPLEMENTATION N AND REZONING CERTAIN PARCELS OF REAL PROPERTY PURSUANT TO THE LAND USE CODE APPLICANT: CITY OF NATIONAL CITY CASE FILE NO. LCP-1-90 ZC-1-90, ZC-2-90, ZC-3-90 ZC-4-90, ZC-5-90, ZC-6-90 ZC-7-90, ZC-8-90 WHEREAS, pursuant to Division 20 Section 3000 et. seq. of the California Public Resources Code, the California Coastal Act, a Local Coastal Program was prepared, and WHEREAS, the Land Use Plan of the Local Coastal Program was adopted by the City and certified by the California Coastal Commission, and MIMS", regulations, procedures and zone changes consistent with or necessary to carry out the Land Use Plan are described in the document entitled National City Local Coastal Program Implementation, and WHEREAS, pursuant to Section 30503 of the Public Resources Code and Section 65854 of the California Government Code, the Planning Commission and City Council held duly advertised public hearings on those regulations procedures and zone changes for implementation of the Local Coastal Program, and WHEREAS, the Planning Carnnission and City Council have caused and duly held studies and proceedings for the proposed zone changes pursuant to Section 18.112.040 of the Municipal Code and. Title 7, Chapter 4, of the Government Code; and ` MS, the Planning Commission and City Council did consider all evidence and testimony at said hearings; and WHEREAS, the Planning C mmission and City Council considered written comrents from the California Coastal Commission and San Diego Unified Port Authority, and appropriate changes were made to the draft Local Coastal Program Implementation document as well as to proposed categorical exclusions, in response to comments received; and the proposed zone changes are consistent with the designations of the City's Local Coastal Program, Land Use Plan, and with the General Plan; and WHEREAS, the Planning Commission has determined that the zone boundary for the coastal zone (CZ) overlay applies to properties in the coastal zone established by the State of California, including I-5, Rt. 54 and San Diego Trolley right-of-ways, and private property on the east side of National City Y Boulevard at the southerly City limits, as further explained by proposed zone changes maps 5 of 6, and 6 of 6, in the Local Coastal Program Implementation document, and the Combined General Plan/Zoning Map shall be changed g to reflect the Planning Commission's determination; and WHEREAS, the preparation and adoption of the Local Coastal Program are statutorily exempt from the California Environmental Quality Act pursuant to Section 21080.9 of the Public Resources Code; and WHEREAS, the City Council has considered the recommendation of the Planning Commission regarding approval of the Local Coastal Pr ogram Implementation and the findings of the Planning Cnission regarding the relationship of the Local Coastal Program Implementation with the Local coastal Program, Land Use Plan, and of the proposed zone changes with the General Pla n; and WHEREAS, the City Council finds the proposed regulations, procedures and zone changes for implementation of the Local Coastal Program, as described in the Local Coastal Program Implementation document, are consistent wit h and carry out the Local Coastal Program, Land Use Plan, and the City's General Plan. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ORDAINS AS FOLLOWS: Section 1. All protests, if any, against said rezoning be and hereby are denied and overruled. Section 2. The City Council adopts the proposed p � regulations, procedures and zone changes for implementation of the Local Coastal Program as described in the Local Coastal Program Implementation document on file in the office of the City Clerk as Ethibit "A". Section 3. All the real property described below is hereby rezoned as follows: a. from MM CZ (medium manufacturing -coastal zone) to CT -CZ (commercial tourist -coastal zone) for approximately 2 acres in the area easterly of Tidelands Avenue and north of 32nd Street, as further described in proposed zone changes map 1 of 6 in the Local Coastal Program Implementation document (ZC-1-90); b. from OSR-CZ (open space reserve -coastal zone) to CT -CZ (commercial tourist -coastal zone) for approximately 6 acres in the area west of Paradise Marsh, including the S.D. & A.E. railroad and area between the railroad and the existing CT -CZ zone boundary, north of the Sweetwater River flood control channel, as further described in proposed zone changes map 1 of 6 in the Local Coastal Program Implementation document (ZC-2-90); c. from OS (open space) to CH -CZ (heavy commercial -coastal zone) for approximately 1 acre in the area north and south of 35th Street at National City Boulevard, as further described in proposed zone changes map 2 of 6 in the Local Coastal Program Implementation document (ZC-3-90); d. from OSR-CZ (open space reserve -coastal zone) to MM-CZ (medium manufacturing -coastal zone) for approximately 2 acres in the area south of the southerly terminus of Harrison Avenue, west of Paradise Marsh, including the S.D. & A.E. railroad and area between the railroad and existing NM-C2 zone boundary, as further described in proposed zone changes map 1 of 6 in the Local Coastal Program Implementation document (ZC-4-90); from OSR-CZ (open space reserve -coastal zone) to ML-CZ (light manufacturing -coastal zone) for approximately 5 acres in the area adjacent to the wetland area located south of 30th Street, east of I-5, west of Hoover Ave., and north of 33rd St., as further described in proposed zone changes map 4 of 6 in the Local Coastal Program Implementation document (ZC-5-90); f. from OSR-CZ (open space reserve -coastal zone) to OS -CZ (open space -coastal zone) for approximately 2 acres of freeway right- of-way on the east side of I-5, in the area south of 30th Street, as further described in proposed zone changes map 4 of 6 in the Local Coastal Program Implementation document (ZC-6- 90); g. from OSR-CZ (open space reserve -coastal zone) and from MT-10S-CZ- UPD (tidelands manufacturing -open space -coastal zone -unified port district) to OS -CZ (open space -coastal e. approximately 3 control channel zone) for acres in the area of the Sweetwater River flood west of I-5, as further described in proposed of 6 in the Local Coastal Program Implementation document (ZC-7-90). zone changes map 1 h. from ML-CZ (light manufacturing -coastal zone) to CA -CZ (commercial automotive -coastal zone) for approximately 4.7 acres on the east side of National City Blvd., northeast of 33rd St. and State Highway 54, at the southerly City limits, as further described in proposed zone changes map 3 of 6 in the Local Coastal Program Implementation document (ZC-8-90). Section 4. The categories of development as listed in the proposed categorical exclusions, on file in the office of the City Clerk as Exhibit "B", shall be excluded from coastal development permit requirements, pursuant to Public Resources Code Section 30610(e) and approval of the categorical exclusion order by the State Coastal Cbmmission. Section 5. The Director of Planning is authorized to submit copies of this ordinance and necessary exhibits and information to the California Coastal Commission for approval and certification of the Local Coastal Program - Implementation.
