AN ORDINANCE AMENDING SECTION 11.32.400 OF THE
NATIONAL CITY MUNICIPAL CODE, INCREASING PARKING
VIOLATION PENALTIES AND FIXING THE TIME AND
PLACE FOR APPEARANCE TO ANSWER THE NOTICE
OF PARKING VIOLATION
BE IT ORDAINED by the City Council of the City of
National City that Section 11.32.400 of the National City Municipal
Code is amended to read as follows:
11.32.400 Parking Violation -- Penalties.
A. The registered owner, lessee or renter of a vehicle
cited for violation of the provisions of Chapter 7.18 or 11.32 of
this code or the California Vehicle Code shall, within twenty one
(21) days of the date of issuance of the notice of parking
violation, pay to the City in person or through the mail a parking
penalty consistent with the then current Uniform Traffic Bail
Schedule, (published by The Judicial Council of California, State
Building, 350 McAllister Street, San Francisco, California, 94102)
and consistent with the schedule in Table I, following this
section. Those National City Municipal Code violations not
described in Table I shall carry a penalty of $20.00.
B. If payment of the parking penalty is not received
within twenty one (21) days of the date of issuance of the notice
of parking violation, the City shall serve or mail to the
registered owner a notice of delinquent parking violation.
C. The failure of the registered owner, lessee or
renter of the cited vehicle to pay the original parking penalty
within 10 court days after the mailing of the notice of delinquent
parking violation shall result in the parking penalty being
increased to double the amount of the original penalty, i.e.,
penalty x 2.
D. The failure of the registered owner, lessee or
renter of the cited vehicle to pay the parking penalty within an
additional fifteen (15) days after ten (10) court days from the
mailing of the notice of delinquent violation shall result in the
parking penalty being increased to quadruple the amount of the
original penalty, i.e., penalty x 4.
E. If, after thirty (30) days from the mailing of the
notice of delinquent parking violation, the registered owner served
with the notice of delinquent violation does not appear in person
or fails to respond by mail, or if service was attempted by mail
and is returned unserved, or if any mailed response to service of
a notice of delinquent parking violation does not provide
satisfactory evidence of nonliability and an affidavit of
nonliability, and notice of that fact is mailed to the respondent,
the City shall file an itemization of unpaid parking penalties,
including administrative fees, and the amount of costs of the City
for costs of service, with the Department of Motor Vehicles for
collection with the registration of the vehicle pursuant to Section
4760 of the Vehicle Code.
