AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY, CALIFORNIA
ADOPTING A SPECIFIC PLAN FOR A
ROADWAY INTO THE CANYON AREA NORTHWEST
OF E. 30TH STREET AND D AVENUE
APPLICANT: CITY -INITIATED
CASE FILE NO. SP-1-90
WHEREAS, the City Council of the City of National City at their
meeting of February 2, 1989 directed according to California Government
Code Section 65450 (et.seq.) that a Specific Plan be prepared for the
subject canyon area; and,
the City Council held public hearings on July 11, 1989 and
July 25, 1989 and took no action on a proposed specific plan which
incorporated recommendations in the design concept report prepared by Land
Studio for the canyon area; and,
the City Council denied without prejudice an application for
a variance on September 5, 1989 which would have allowed development of one
of the properties in the canyon without direct access to a public street,
since the variance will not be needed when the roadway is extended into the
canyon; and,
WHEREAS,
the City Engineering department prepared plans for a proposed
roadway alignment into the canyon extending west and southwest from D
Avenue (approximately 300 ft. north of 29th Street) toward 30th Street
(approximately 250 ft. east of A Avenue); and,
WHEREAS, the Planning Commission of the City of National City
considered plans (Exhibit A, dated 2/20/90) at a public hearing held on
April 2, 1990, at which time the Planning Commission considered oral and
documentary evidence, and the entire contents of Case File Nos. SP-1-90 and
IS-89-14, which are incorporated herein by reference; and,
WHEREAS, the Planning Commission recommended approval of said plans
with modification to relocate the terminus of the cul-de-sac further south,
as incorporated into revised plans (Exhibit A revised, dated 5/10/90); and,
the Planning Commission did consider the proposed Negative
Declaration (No. IS-89-14) together with comments received during the
public review process and all evidence and testimony presented at the
public hearing; and,
WHEREAS, the Planning Commission has determined that Specific :Plan SP-
1-90 is consistent with the National City General Plan policies regarding
planned and orderly development and encouraging single-family housing
construction on vacant lots within established neighborhoods; and,
WHEREAS the City Council of the City of National City considered the
recommendation and findings of the Planning Commission for approval of the
proposed specific plan, along with evidence and testimony presented at a
public hewing held on June 26, 1990; and,
WHEREAS, Specific Plan SP-1-90 is in compliance with government Code
Section 65451 pertaining to the content of specific plans; and,
WHEREAS, this action is taken pursuant to all applicable procedures
required by State Law and City Ordinance.
NOW, 0 m 40RE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ORDAINS
AS FOLLOWS:
Section 1. The City Council adopts Specific Plan No. SP-1-90 subject
to the following conditions:
a. A soils report shall be submitted in conjunction with any future
building or roadway construction.
b. A minimum 32 ft. of roadway width shall be provided with 20 ft.
of unobstructed roadway width maintained at all times.
c. Fire lanes shall be provided as deemed necessary by the Fire
Department.
d. Two fire hydrants shall be required. The location shall be as
required by the Fire Department.
e. The maximum roadway grade shall not exceed 15%.
f. Parking shall be restricted to one side of the street.
g. The alignment and configuration of the roadway shall be in
accordance with Exhibit A -revised, Case File No. SP-1-90, dated
5/10/90, which relocated the cul-de-sac approximately 35 ft.
southwesterly from that indicated in Exhibit A, SP-1-90, dated
2/20/90, except as amended through approved parcel or subdivision
maps or boundary adjustment plats.
h. No parking zones (red curbing) shall be installed along the
property frontage on the west side of D Avenue as deemed
necessary by the Traffic Safety Committee.
Section 2. The City Council has considered the proposed Negative
Declaration (No. IS-89-14) together with comments received during the
public review process and finds on the basis of the Initial Study and any
comments received that there is no substantial evidence that the project
will have a significant effect on the environment, approves the proposed
Negative Declaration, and authorizes the filing of Notice of
Determination.
Section 3. The City Council finds that the proposed specific plan is
consistent with General Plan policies regarding planned and orderly
development and encouraging single-family housing construction on vacant
lots within established neighborhoods.
