AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY APPROVING AND ADOPTING
AMENDMENT III, NATIONAL CITY DOWNTOWN
REDEVELOPMENT PROJECT, NATIONAL CITY, CALIFORNIA
WHEREAS, the City Council of the City of National
City, by adoption of Ordinance No. 1762 on December 1, 1981,
approved the Redevelopment Plan and the Feasibility of
Relocation for the National City Downtown Redevelopment
Project, National City, California; and
WHEREAS, the City Council, by adoption of Ordinance
No. 1821 on May 22, 1984, approved Amendment I to said
Redevelopment Plan; and
WHEREAS, the City Council, by adoption of Ordinance
No. 1851 on April 16, 1985, approved Amendment II to said
Redevelopment Plan; and
WHEREAS, the City Council wishes to further amend
said Redevelopment Plan by adoption of an Amendment III; and
WHEREAS, Notice of Public Hearing on Amendment III
was sent to each property owner within the National City
Downtown Redevelopment Project Boundary and to the County
Auditor, the Assessor, the Tax Collector, the State Board of
Equalization, and to the governing bodies of all taxing
agencies which levy taxes within the Project Area; and
WHEREAS, the CDC has made its Report on Amendment
III, National City Downtown Redevelopment Project, to the City
Council for the Public Hearing on Amendment III, which was
held Tuesday, June 11, 1991, inthe City Council Chamber,
Civic Center, 1243 National City Blvd., National City,
California; and
WHEREAS, the City Council considered the Report of
the CDC and considered all testimony, both written and oral,
and considered the environmental documents, the proposed
expenditure of CDC tax increment funds for the acquisition of
land and the construction of a police facility and for the
construction of public improvements within the National City
Downtown Redevelopment Project.
NOW, THEREFORE, BE IT ORDAINED by the City Council
of the City of National City, as follows:

Section 1: It is hereby found and determined that
Amendment III, National City Downtown Redevelopment Project,
is necessary to effectuate the public purposes set forth in
the California Community Redevelopment Law, hereinafter called
"the Law," and that the carrying out of the Redevelopment Plan
for the Project would promote the public peace, health,
safety, and welfare of the community and would effectuate the
purposes and policies set forth in said Law.
Section 2: The Redevelopment Plan for the National
City Downtown Redevelopment Project adopted by City Council
Ordinance No. 1762 on December 1, 1981, and recorded December
4, 1981, Official Records, San Diego County, California, as
File/Page No. 81-381665 is hereby amended to read as follows:
(a) Section F.2.d. Estimates of Total Project
Cost, Project Revenue and Bond Issues: (page
16 of the Plan) .
The estimated total cost to complete this
Project is $250 million, which is the maximum
number of dollars of taxes which may be divid-
ed and allocated to the CDC. The taxes allo-
cated to the Project are by far the major
source of Project Revenue. Estimates of Bond
Issues are Bonds III, January, 1992, $21.1
million, and Bonds IV, January, 1998, $11.5
million.
Section F.2.e. Other Financial Provisions:
(page 16 of the Plan) .
(1) Pursuant to Section 33333.2, paragraph
(1) of the Law, the limitation on the number
of dollars of taxes which may be divided and
allocated to the CDC pursuant to Section 33670
of the Law in connection with this Redevelop-
ment Plan is $250 million.
(2) Pursuant to Section 33333.2, paragraph
(2) of the Law, the time limit on the estab-
lishing of loans, advances and indebtedness to
finance in whole or in part this Redevelopment
Plan and this Redevelopment Project is to and
including the Fiscal Year 2014-2015.

(3) Pursuant to Section 33334.1 of the Law,
the limit of bonded indebtedness that can be
outstanding at one time is $100 million.
(4) Pursuant to Section 33334.2 of the Law,
not less than 20 percent of all taxes which
are allocated to the CDC pursuant to Section
33670 shall be used by the CDC for the purpos-
es of increasing, improving, and preserving
the community's supply of low and moderate -
income housing available at affordable housing
cost, as defined by Section 50052.5, to per-
sons and families of low or moderate income,
as defined in Section 50093, and very low
income households, as defined in Section
50105.
Section E - Project Proposals: (pages 11
through 14 of the Plan).
Section E.7. is added to provide as follows:
"7. Police Facility
Pursuant to Section 33445 of the Law,
Community Development Commission tax
increment revenues shall be utilized to
pay for one-half the cost of the
acquisition of land for and the cost of
installation and construction of a new
police facility for the City of National
City within the Redevelopment Project
Boundary. For this purpose, the
Community Development Commission shall
pay $4 million in cash in June, 1991, and
$1 million in cash in December, 1991, to
the National City Joint Powers Financing
Authority, and shall make such further
payments from time to time as requested
by the Auditor and Treasurer of the
Authority."
Section E.8. is added to provide as follows:
"8. Capital Improvement Projects
Beginning July 1, 1992, the greater of
$320,000.00 or 10 percent of the amount
of CDC funds allocated annually for
neighborhood improvement and for
commercial and industrial redevelopment,

shall be devoted each year during the
the duration of the Redevelopment Plan to
capital improvement projects to be
constructed by the City of National City
within the Redevelopment Project
Boundary."
Section 3: It is hereby found and determined that
the financing method set forth in the Redevelopment Plan for
the Project, as amended by this Amendment III, is necessary to
enable the Project to be completed. The carrying out of the
Redevelopment Plan as amended by this Amendment III, is hereby
found and determined to be economically sound and feasible.
Section 4: Amendment III, National City Downtown
Redevelopment Project, having been duly reviewed and
considered, is hereby approved and adopted and all objections
written or oral, are hereby overruled. '
PASSED and ADOPTED by the City Council of the City
of National City, California, this 18th day of June, 1991.
