HomeMy WebLinkAboutCC ORD 1991-2015 Enacts moratorium on construction of industrial and commercial buildings in the Westside area (Repealed by 2019)ORDINANCE NO. 9 1 - 2 015 AN INTERIM ORDINANCE OF THE CITY OF NATIONAL CITY ADOPTED PURSUANT TO GOVERNMENT CODE SECTION 65858 AS AN URGENCY MEASURE ENACTING A MORATORIUM ON THE CONSTRUCTION OF INDUSTRIAL AND COMMERCIAL BUILDINGS IN THE WESTSIDE AREA WHEREAS, the City of National City has been experiencing the demolition of older residences in the Westside area and their replacement by industrial and commercial buildings; and WHEREAS, these industrial and commercial buildings and uses have contributed to worsening neighborhood quality for remaining residents of the area, with regard to on -street parking problems, noise and environmental pollutants, as well as disharmony of architectural design between older and newer structures; and WHEREAS, the specific area negatively affected by the transition of use from residential to industrial or commercial is bordered by I-5 on the west, Eighth Street on the north, Roosevelt Avenue on the east and 24th Street on the south, and is in the ML, Light Manufacturing zone; and WHEREAS, new industrial and commercial buildings, when remaining vacant, result in a blighting effect on surrounding property and an atmosphere of instability; and WHEREAS, examples of new, vacant industrial and commercial buildings have been cited; and WHEREAS, several additional new industrial and commercial buildings may be proposed, consistent with the zoning of the area; and WHEREAS, existing land use controls do not adequately address the potential adverse effects of industrial and commercial buildings on residential uses and neighborhood institutions, i.e. churches and schools; and WHEREAS, the City Council finds that there is a current and immediate threat to the public health, safety, and welfare by the continued construction or expansion of industrial and commercial buildings in the area and that the continued issuance of building permits and other entitlements for use for industrial and commercial buildings in the area would result in a threat to the public health, safety, and welfare; and WHEREAS, the City Council finds it essential to protect the health, safety, and welfare of the citizens of the City of National City to enact a moratorium for a period of 45 days on the development or approval of industrial or commercial buildings in the area; and Ordinance No. 91- 2 015 Page Two WHEREAS, the City Council intends to adopt, after appropriate study, zoning regulations governing construction of new industrial or commercial buildings or the expansion of such buildings in the area as soon as practicable and directs the Planning Commission of this City to commence studies and procedures necessary for the adoption of such regulations. NOW, THEREFORE, the City Council of National City does ordain as follows: Section 1. For a period of 45 days from the effective date of this Ordinance, no building permits nor entitlements for use shall be issued for and no construction shall take place relating to new industrial or commercial buildings or expansion of such buildings for properties zoned ML, Light Manufacturing, in the area bordered by I-5 on the west, Eighth Street on the north, Roosevelt Avenue on the east and 24th Street on the south. Section 2. The City Council hereby directs the Planning Commission to commence studies and procedures necessary for the adoption of regulations governing construction of new industrial or commercial buildings and expansion of such buildings in the area. Section 3. This Ordinance shall not apply to projects where prior to August 13, 1991 a building permit or other entitlement for use has been issued. Section 4. This Ordinance is adopted as an urgency ordinance necessary for the immediate preservation of the public health, safety, and welfare within the meaning of the Government Code and shall take effect immediately.
