CITY COUNCIL OF THE CITY OF NATIONAL CITY ADDING CHAPTER 11.68 TO THE NATIONAL CITY MUNICIPAL CODE RELATING TO CRUISING WHEREAS, pursuant to Vehicle Code Section 21100(k), the City Council of the City of National City is authorized by state law to enact an ordinance regulating the congestion of city streets caused by persons who engage in an activity commonly known as cruising; and WHEREAS, undue congestion on city streets causes air and noise pollution, prevents ingress and egress to residential and commercial properties, and impedes the movement of emergency vehicles; and WHEREAS, the activity of operating motor vehicles repetitively over city streets with others so engaged creates, directly and indirectly, conditions which make local residents and business owners unable to enjoy normal opportunities to freely travel, associate with friends and neighbors, and utilize and enjoy their property; and WHEREAS, cruising activity has precipitated traffic congestion, numerous calls for police service, and disturbances of the public peace, health and safety as reported to the police department. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of National City that Chapter 11.68 is hereby added to the National City Municipal Code, to read as follows: Section: Chapter 11.68 CRUISING 11.68.010 Cruising defined 11.68.020 Signs 11.68.030 Cruising - Traffic control point 11.68.040 Cruising - Written notice 11.68.050 Cruising prohibited 11.68.060 Exceptions 11.68.070 Penalty for violation Continued on Page Two Ordinance No. Page 2 of 3 11.68.010 Cruising defined. "Cruising" shall be defined as the repetitive driving of a motor vehicle two or more times within a four hour period, in the same direction, past a traffic control point in traffic which is congested at or near the traffic control point as determined by the ranking police officer on duty within the affected area, and after the vehicle operator or passenger has been given an adequate written notice that further driving past the control point will be a violation. 11.68.020 Signs. Signs shall be placed at the beginning and end of the portion of any street determined to be subject to cruising controls which briefly and clearly state the appropriate provisions of Section 11.68.050 of this Code, and of Section 21100(k) of the California Vehicle Code. 11.68.030 Cruising - Traffic control point. The ranking police officer on duty within an area affected by traffic congestion may establish one or more traffic control points at or near the area of traffic congestion. 11.68.040 Cruising - Written notice. Any person who, as the operator of, or passenger in, any motor vehicle driven in a particular direction past a traffic control point established pursuant to Section 11.68.030 may be given written notice that further driving past the control point within a four hour interval will be a violation of Section 11.68.050. 11.68.050 Cruising prohibited. It shall be unlawful for any person, as a driver or a passenger of a motor vehicle, to engage in the activity known as "cruising," as defined in Section 11.68.010, on the public streets or alleys of the City of National City in any area which has been posted pursuant to Section 11.68.020. Each successive trip within a four hour period past the traffic control point established pursuant to Section 11.68.030 shall constitute a separate violation, and no additional written notice shall be required for such separate violation. This section shall not apply to persons who, according to DMV records, reside within a designated no -cruising area; nor to authorized emergency vehicles as defined in Section 165 of the California Vehicle Code; nor to vehicles licensed for public transportatio; nor to publicly owned vehicles of any city, county, district, state or federal agency. 11.68.070 Penalty for violation. Any person violating any provision of this Chapter is guilty of an infraction. PASSED and ADOPTED this 3 r d day of MARCH , 1992.
