HomeMy WebLinkAboutCC ORD 1992-2028 Adds subsection (C) to § 18.108.030; § 18.108.051; amends § 18.108.040, zoning (18.108)ORDINANCE NO. 92-2028 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING TITLE 18 (ZONING) OF THE NATIONAL CITY MUNICIPAL CODE REGARDING EXPANSION AND RECONSTRUCTION OF NONCONFORMING, SINGLE-FAMILY DWELLINGS BE IT ORDAINED by the City Council of the City of National City as follows: Section 1. Subsection C of Section 18.108.030 is added to the National City Municipal Code to read as follows: C. A single-family detached dwelling may be reconstructed or remodeled in accordance with the standards of the existing structure, i.e. in the same building location on the lot, the same size of the existing structure, and the same height as the existing structure; however, different materials and architectural details may be used. Section 2. Section 18.108.040 of the National City Municipal Code is amended to read as follows: 18.108.040 Partially destroyed structures. A. A nonconforming building or structure which is damaged or destroyed by fire, explosion, or natural disaster may be restored and the occupancy or use of such structure or part thereof existing at the time of such partial destruction may be continued or resumed provided: 1. Such restoration is of an equal or lesser degree of nonconformity; 2. The total cost of such restoration for structures other than single-family detached dwellings does not exceed one-half the replacement cost of the structure at the time of such damage (the replacement cost will be calculated by the department of building and housing); 3. Such restoration is started within a period of one year and is carried out diligently to completion; 4. Such damage or destruction of structures other than single-family detached dwellings is not intentionally caused by the owner; 5. In the event such damage or destruction exceeds one-half the replacement cost of such nonconforming structure, other than a single-family detached dwelling, it shall not be reconstructed. CONTINUED ON PAGE 2 Page 2 of 3 Ordinance No. Section 3. Section 18.108.051 is added to read as follows: 18.108.051 Single-family detached dwellings. Single-family dwellings which became nonconforming uses at the time of adoption of the National City Land Use Code or of amendments to the Code may be continued, reconstructed, structurally altered, extended or enlarged in conformance with the following: A. The reconstruction or remodeling shall conform to the standards of the existing structure, i.e. the same location on the lot, the same size of the existing or previously existing structure, and the same height as the existing structure; however, different materials and architectural details may be used; otherwise, the reconstruction or remodeling shall conform to the standards of the zone in which the use is located. B. Enlargement or extension of a single-family detached dwelling shall conform to the standards of the zone which applies to the property. C. No increase in parking over that previously provided shall be required, but may be permitted, in conformance to development standards of the zone which applies to the property, except that the number of parking spaces specified by Section 18.14.390 for the RS-2 zone shall be provided for reconstruction of a nonconforming single-family residential use in a different location from the previously constructed building, on lots of 5,000 sq.ft. in size or greater. Section 4. The City Council has considered Negative Declaration No. IS-1991-22, previously approved for related amendments concerning design standards and procedural requirements for new development, along with additional information, and finds that the additional amendments to the Municipal Code do not require important revisions of previously adopted Negative Declaration No. IS-1991-22 and will not have a significant effect on the environment, since they do not result in new significant environmental impacts not considered in the Negative Declaration, and no new information that could not have been known at the time the Negative Declaration was adopted identifies mitigation measures or alternatives, not previously considered or found feasible, which would substantially reduce a significant effect on the environment.
