HomeMy WebLinkAboutCC ORD 1992-2040 Prezone and rezone (Special)ORDINANCE NO. 92-2040 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY PREZONING CERTAIN REAL PROPERTY PURSUANT TO THE LAND USE CODE AS RS-2-PUD AND REZONING ADJACENT CALTRANS RIGHT-OF-WAY FROM RS-1 TO RS-2-PUD AT THE PROPOSED ROUTE 54/REO DR. INTERCHANGE APPLICANT: CITY OF NATIONAL CITY CASE FILE NOS. GP-1992-4/ZC-1992-2 WHEREAS, pursuant to the terms and provisions of the Government Code of the State of California, proceedings were duly initiated for the prezoning and rezoning of the parcels of real property, hereinafter described, and for the amendment of the General Plan of the City of National City; and, WHEREAS, pursuant to legal notice, hearings were held by the Planning Commission of National City and also by the City Council of National City, and all persons interested were given the opportunity to appear and be heard before said Planning Commission and City Council; and, WHEREAS, the Planning Commission of National City has regularly and duly certified to the City Council its report and has recommended such prezoning and rezoning and such amendment; and, WHEREAS, the City Council found that on the basis of the Initial Study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment and adopted a proposed Negative Declaration which addresses said General Plan amendment, prezoning and rezoning; and, WHEREAS, the City Council finds the prezoning and rezoning consistent with and necessary to implement the General Plan, since the proposed prezoning and zoning designations are identical with the land use designations of the General Plan, and the proposed PUD overlay zone will provide discretionary review to ensure higher quality housing and compatibility with adjacent single-family residential neighborhoods. NOW, THEREFORE, the City Council of the City of National City, California does ordain as follows: Section 1. All protests, if any, against said prezoning and rezoning and said amendment to the General Plan, and each of them be and hereby are denied and overruled. That all the real property described below is hereby prezoned as follows: From undesignated zone to GP-PZ (RS-2-PUD) (General Plan Prezone, Single -Family Residential Small Lot - Planned Unit Development) for approximately one acre at 3402 Valley Road as described by case file exhibit (GP-1992-4/ZC-1992-2) on file in the office of the City Clerk as Exhibit "A"; and Section 3. That all the real property described below is hereby rezoned as follows: From RS-1 (Single -Family Residential -Large Lot) to RS-2-PUD (Single -Family Residential Small Lot -Planned Unit Development) for Caltrans right-of-way remaining south and east of proposed Reo Drive and Valley Road, as described by case file exhibit (GP-1992-4/ZC-1992-2) on file in the office of the City Clerk as Exhibit "A". Section 4. That a Notice of Determination shall be filed indicating that the prezoning and rezoning will not have a significant effect on the environment.
