HomeMy WebLinkAboutCC ORD 1993-2050 Amends Ch. 15.10, Uniform Code For the Abatement of Dangerous Buildings (15.10)ORDINANCE NO. 93-2050 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, 1991 EDITION, AND AMENDING ORDINANCE NO. 1979 AND CHAPTER 15.10 OF THE NATIONAL CITY MUNICIPAL CODE BE IT ORDAINED by the City Council of the City of National City as follows: Section 1. The City Council of the City of National City hereby adopts the Uniform Code for the Abatement of Dangerous Buildings, 1991 Edition. Section 2. The City Council of the City of National City hereby amends and deletes certain sections of the Uniform Code for the Abatement of Dangerous Buildings, 1991 Edition, and amends Ordinance No. 1979 and Chapter 15.10 of the National City Municipal Code, to read as follows: CHAPTER 15.10 UNIFORM CODE FOR THE ABA'1EMENT OF DANGEROUS BUILDINGS Section: 15.10.005 15.10.010 15.10.015 15.10.020 15.10.025 15.10.030 15.10.035 Code adopted. Section 201(c)..Right of Entry..Amended. Section 203..Violations..Amended. Section 205(a)..Board of Appeals..Amended. Section 501..General..Deleted. Section 502..Effects of Failure to Appeal..Amended. Chapter 6..Appeal procedure..Amended. 15.10.005 Code adopted. There is adopted by the city council, for the purpose of prescribing regulations governing hazards to life and property from substandard housing conditions, that certain code known as the Uniform Code for the Abatement of Dangerous Buildings, as copyrighted by the International Conference of Building Officials, being particularly the 1991 Edition, save and except such portions as are hereinafter deleted, modified or amended, of which code one copy is now on file in the office of the city clerk; and the same is adopted and incorporated as fully as if set out at length in this chapter and from the date on which the ordinance codified in this chapter takes effect, the provisions thereof shall be controlling within the limits of the city. 93-2050 15.10.010 Section 201(c)..Right pf Entry. Section 201(c) of the Uniform Code for the Abatement of Dangerous Buildings is amended to read: When necessary to make an inspection to enforce any of the provisions of this code or reasonable cause to believe that there exist in any building or upon any premises a condition or code violation which makes such building or premises unsafe, dangerous or hazardous, the Building Official, San Diego County Health Department and/or their authorized representatives may request entry as specified in Chapter 1.12 of the National City Municipal Code. 15.10.015 Section 203..Violations. Section 203 of the Uniform Code for the Abatement of Dangerous Buildings is amended to read: Violations of any provisions of this code shall be punishable as a misdemeanor and shall carry the penalties as prescribed in Chapter 1.20 of the National City Municipal Code. 15.10.020 Section 205..Board of Appeals. Section 205 of the Uniform Code for the Abatement of Dangerous Buildings is amended to read as follows: The Advisory and Appeals Board is established by City Ordinance No. 1834 adopted October 9, 1984. The Board shall have jurisdiction to review the items as enumerated in Chapter 15.04 of the National City Municipal Code. 15.10.025 Section 501..General. Section 501 of the Uniform Code for the Abatement of Dangerous Buildings is deleted in its entirety. 15.10.030 Section 502..Effects of Failure to Appeal. Section 502 of the Uniform Code for the Abatement of Dangerous Buildings is amended to read: Failure of any person to file an appeal in accordance with the provisions of Section 15.04.060 of the National City Municipal Code shall constitute a waiver of his right to an administrative hearing and adjudication of the Notice and Order or any portion thereof. 15.10.035 Chapter..amended..Appeal procedure. Chapter 6 of the Uniform Code for the Abatement of Dangerous Buildings is hereby amended to read as follows: Appeal procedures shall be as set forth in Section 15.04.060 and Section 15.04.070 of the National City Municipal Code. 2 93-2050 PASSED and ADOP'1'ED this 9th day of February , 1993.
