A of land use code; amends §§ 18.62.020 and 18.62.080, zoning (18.62)ORDINANCE NO. 95-2098 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, AMENDING TITLE 18 (ZONING) OF THE NATIONAL CITY MUNICIPAL CODE PERTAINING TO SIGNS, INCLUDING TEMPORARY SIGNS, ADVERTISING BANNERS, FLAGS, BUNTING AND PAINTED WALL SIGNS, AS WELL AS APPEAL RIGHTS FOR SIGN -RELATED VIOLATIONS, AND AMENDING APPENDIX A OF THE NATIONAL CITY LAND USE CODE. CASE FILE NO. A-1995-2 BE IT ORDAINED by the City Council of the City of National City as follows: Section 1. follows: Section 18.62.020 of the National City Municipal Code is amended to read as 18.62.020 Permits required. All signs permitted by this title shall require a site plan review (see Chapter 18.128) and the issuance of a building permit by the City, provided that painted walls signs, banners, flags, bunting, etc., shall require a site plan review only. If, in the opinion of the Planning Director, any such sign would not be in keeping with the design criteria outlined in Appendix A of the National City Land Use Code, he shall disapprove such sign. This action may be appealed pursuant to the provisions of Chapter 18.128, and sections 18.134.010 and 18.134.020. Section 2. follows: Section 18.62.080 of the National City Municipal Code is amended to read as 18.62.080 Flags, banners, and bunting, etc. A. Flags, banners, and bunting, etc., may be used on automobile lots, provided that: 1. Such displays are being properly maintained; 2. Displays of pennants and banners shall be limited to the perimeter of the lot; 3. Displays of pennants and banners shall not exceed twenty feet above the ground; 4. Flags shall not exceed twenty-five feet above the ground. B. Other businesses and real estate uses may utilize flags, banners, and bunting, etc., for a period of 60 days within a calendar year. The time limit on flags, banners, and bunting, etc., shall commence at the time the permit is issued. The 60 day period may be divided into two occasions per calendar year provided the total time the flags, banners, and bunting, etc., are utilized may not exceed 60 days per calendar year. C. The following shall apply to all banners, flags, and bunting, etc.: 1. The planning commission may order the removal of any flags, banners, and bunting, etc., within 15 calendar days of a finding by the planning commission that such displays are not being properly maintained. CONTINUED ON PAGE 2 Ordinance No. 95-2098 Page 2 of 3 2. Flags, banners, and bunting, etc., shall not be permitted in lieu of a permanent sign. 3. A site plan review shall be obtained for any flags, banners, and bunting, etc., prior to installation. 4. A site plan review fee, and administrative fee representing City costs in causing the applicant to remove such banner, flags and bunting, etc., shall be paid to the City Treasurer at the time of application for site plan review. The administrative fee shall be returned upon the verified removal of the flag, banner, or bunting, etc., by the specified deadline. The site plan review fee and administrative fee shall be established from time to time by resolution of the City Council. 5. A violation of the time limits as established by section 18.62.080.B. of this title shall cause the applicant to be ineligible for approval of a banner, flag, or bunting, etc., for a period of one year from the date that the violation is abated. Section 3. follows: 9. Banners Appendix A of the National City Land Use Code is amended by adding Section 9 as 1. Banners should not exceed 40 square feet in size. 2. Banners should be limited to the exterior walls of the building or suite of the business the banner is intended to advertise. 3. A business may have no more than one banner, except that a business that has frontage on more than one street may have an additional banner for each additional street frontage. 4. Banners may only be displayed along the exterior walls of the building that is occupied by the tenant the banner advertises. Banners may not be placed within any required setback area, in, on, or attached to landscaping, or upon any roof. 5. The banner shall be affixed to the building in such a manner that it does not extend past the building or suite occupied by the tenant the banner is intended to advertise. 6. The design of all banners shall be compatible with the building to which it is affixed. Fluorescent colors shall not be permitted.
