HomeMy WebLinkAboutCC ORD 1996-2110 Adds §§ 15.04.060(G) and 15.04.080; amends § 15.04.010, advisory and appeals board (15.04)ORDINANCE NO. 96-2110 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING SECTION 1 OF ORDINANCE NO. 1834 AND SECTIONS 15.04.010 AND 15.04.060, AND ADDING SECTION 15.04.080 TO THE NATIONAL CITY MUNICIPAL CODE BE IT ORDAINED by the City Council of the City of National City as follows: Section 1. Section 15.04.010 of the National City Municipal Code and Section 1 of Ordinance No. 1834 are amended to read as follows: 15.04.010 Established -- Jurisdiction. There is established an advisory and appeals board consisting of seven members. The advisory and appeals board shall have the following jurisdiction: A. Alternate Materials and Methods of Construction. The advisory and appeals board may approve such alternate materials and/or method of construction provided they find that the proposed materials and/or method of construction, for the purpose intended, is at least equivalent of that prescribed in the code in suitability, strength, effective- ness, fire resistance, durability, safety and sanitation. B. Refusal to Issue Permits. The refusal of the director of building and safety or fire chief to issue any permit required by the city may be appealed by the applicant to the advisory and appeals board. C. Notice to Abate Public Nuisances. The action of the director of building and safety or fire chief in issuing a correction notice or a notice to abate a public nuisance may be appealed to the advisory and appeals board. D. Interpretation of City Codes. The decision of the director of building and safety or fire chief in interpreting provisions of the building code, housing code, electrical code, plumbing code, mechanical code and fire code of the city may be appealed to the advisory and appeals board. Section 15.04.060 of the National City Municipal Code and Section 1 of Ordinance No. 1834 are amended by adding Subsection G thereto, to read as follows: G. Effect of Failure to Appeal. Failure of any person to file an appeal in accordance with the provisions of this section shall constitute a waiver of all rights to an administrative hearing and adjudica- tion of any notice and order, code interpretation, or other administrative act of the director of building and safety. Section 3. Section 15.04.080 is added to the National City Municipal Code, to read as follows: 15.04.080 Disabled Access Regulations. All appeals regarding the interpretation or application of the disabled access regulations contained in Chapter 7 (commencing with Section 4450) of Division 5 of Title 1 of the Government Code pursuant to Health and Safety Code Section 19957.5 and the disabled access regulations contained in Title 24 of the California Code of Regulations shall be within the sole jurisdiction of the City Council.
