HomeMy WebLinkAboutCC ORD 1674ORDINANCE NO. 1674 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA PROHIBITING VANDALISM TO PUBLIC PROPERTY; PROHIBITING THE PLACEMENT OF LITTER IN ANY PUBLIC PLACE; PROHIBIT- ING CERTAIN OTHER ACTS ON CITY -OWNED PUBLIC PROPERTY, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF The City Council of the City of National City, California does ordain as follows: SECTION 1. PUBLIC PLACE DEFINED. Forthe purpose of this Ordinance, "Public Place" shall include all City - owned buildings, public parks, and playgrounds, recreational facilities, City public streets and park ways. SECTION 2. LITTER DEFINED. The term "litter" means all improperly discarded waste material including, but not limited to convenience food, beverage, and other product packages or containers constructed of steel, alum- inum, glass, paper, plastic and other natural or synthetic materials, thrown or deposited in any public place. SECTION 3. CITY MANAGER DEFINED. The term "City Manager" as used herein shall mean any officer, employee or other person authorized by the City Manager to carry out and enforce the provisions of this Ordinance. SECTION 4. EXCEPTIONS TO APPLICATION OF REGULA- TIONS. Nothing in this Ordinance shall be construed to prevent any employee of the City of National City from doing anything that, in the opinion of the City Manager, may be thought necessary or proper for maintenance, improve- ment or betterment of any public place. SECTION 5. LITTERING PROHIBITED. It shall be unlawful for any person to leave, discard, deposit or throw any convenience food package or container, glass container, metal container, waste food, garbage, papers or any other refuse or rubbish in any public place. All such litter shall be deposited in litter receptacles provided for that purpose. SECTION 6. LITTER RECEPTACLES. (a) It shall be .nlawful for any person to paint, burn, damage, deface, gouge, knock down, or mis- use any litter receptacle located in any public place so as to interfere with its proper function or to detract from its proper appearance. (b) It shall be unlawful for any person to deposit any household or commercial refuse or garbage in any litter receptacle located in any public place. (c) It shall be unlawful for any person to deposit leaves, clippings, prunings, or other garden refuse in any litter receptacle located in any public place. (d) It shall be unlawful for any person to move, remove, or relocate any litter receptacle or to remove any liner, lid, cap, or any part or portion of any litter receptacle located in any public place, except- ing authorized employees of the City, employees of the City's rubbish collection contractor, or other persons authorized by the City Manager. SECTION 7. TAMPERING PROHIBITED. (a) It shall be unlawful for any person to move, remove, or relocate from one place to another, or to damage or destroy any equipment, tools, implements or materials used by City maintenance personnel in any public place, excepting any authorized City employee while in the performance of his duties. (b) It shall be unlawful for any person to open or close any valve controlling any water system, or to open or close any switch controlling any electrical system in any public place, excepting any City employee while in the performance of his duties and excepting others having prior approval of the City Manager. SECTION 8. BUILDING FIRES PROHIBITED. It shall be unlawful for any person to build a fire in any public place, except in a fire circle or barbeque provided by the City for that purpose, or except as otherwise pro- vided herein. It shall be permissible to build a fire in a portable barbeque or similar approved device in any designated place, provided, however, that any such barbeque or device shall not burn, scorch or otherwise damage grass, turf, tables, equipment or landscaping, and provided further that the coals from said barbeque or similar device shall not be deposited in any litter receptacle or in any public place. Fire circles and barbeques, provided by the City, and private barbeques and similar devices shall be used for cooking and/or warmth, and it shall be unlawful to use the same as an incinerator to burn rubbish, trash or any other waste matter. SECTION 9. DAMAGE TO STRUCTURES PROHIBITED. It shall be unlawful for any person to cut, break, deface, paint, or damage any building, monument, cage, gate, fence, bench, back stop, sign, light fixture, playground equip- ment, or any other building, structure, facility, apparatus or property located in any public place. SECTION 10. DAMAGE TO PLANTS PROHIBITED. It shall be unlawful for any person to carve, cut, prune, remove, relocate or damage any tree, plant, or to drive upon, burn, or damage any turf or grass located in any public place. SECTION 11. MISTREATING, INJURING, OR KILLING OF ANIMALS OR BIRDS PROHIBITED. (a) It shall be unlawful for any person to take, wound, disturb, mistreat, or harrass in any way any City zoo animal or bird whether such animal or bird is caged or uncaged. (b) It shall be unlawful for any person to take, kill, wound, disturb, or mistreat any animal or bird, either wild or domesticated, or to disturb or destroy the nest of any bird in any public place. (c) It refuse to cease an hall be unlawful for any person to desist or to otherwise fail to follow or comply with any lawful order or direction of a zoo keeper or any other authorized City employee. SECTION 12. WORKING ON VEHICLES PROHIBITED. It shall be unlawful for any person to wash, clean, or polish, or to change motor oil or to make other than emergency repairs upon any automobile, truck, motor- cycle, or other self-propelled vehicle in any public place. SECTION 13. PENALTIES. Notwithstanding Section 1.20.010 any person, firm, association, organ- ization, or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction, shall be punishable as set forth in the National City Municipal Code.
