AN ORDINANCE OF THE CITY COUNCIL OF NATIONAL CITY,
IMPOSING AN INTERIM MORATORIUM ON THE CONSTRUCTION OR
USE OF OFFICE BUILDINGS FOR GOVERNMENTAL SERVICE IN
ALL ZONES THROUGHOUT THE CITY, AND DIRECTING THE
PLANNING COMMISSION TO INITIATE APPROPRIATE PROCEED-
INGS TO CONSIDER LAND USE CODE AMENDMENTS AND DECLAR-
ING SAID ORDINANCE AN URGENCY ORDINANCE.
WHEREAS, it has been brought to the attention of this City Council
that Title 18 of the Municipal Code of the City of National City ("The
National City Land Use Code") does not seem to adequately recognize and
provide for the concerns of public health and safety, traffic control,
protection of pedestrians, personal safety and security, crowd control
and environmental qualities affecting public users of those government
service agency buildings and facilities wherein large aggregations of
people are probable; and, does not stipulate or impose criteria for
evaluating possible adverse impacts upon the use of neighboring properties;
and,
WHEREAS, this City Council deems it essential to preserve the public
health, safety and general welfare of this community by immediately under-
taking action necessary for the adoption of local legislation dealing with
zoning regulations as they relate to government service agency uses; and,
WHEREAS, by specifically regulating the intensity, location and
design of new structures or new use of existing structures and related
facilities for government service agencies, especially those such as
employment offices, public assistance offices, motor vehicle registration
and licensing services and similar activities commonly accustomed to having
sizeable assemblages of people queuing, tarrying, biding or waiting for
service, whether pedestrian or vehicular, the above stated objectives can
be fulfilled; and,
WHEREAS, it is recognized that government service agencies .... when
appropriately located and designed ... are vital to the general welfare of
the community; and,
WHEREAS, the City Council intends to adopt zoning regulations govern-
ing the subject businesses throughout the City as soon as is convenient; and
herewith directs the Planning Commission of this City to commence studies and
procedures necessary for adoption of such a permanent zoning regulation; and
WHEREAS, this City Council has learned that development of new
government service agency facilities are imminent;
NOW, THEREFORE, BE IT ORDAINED as follows:
SECTION 1. For the duration of this Ordinance, as provided by
California Government Code Section 65858, new buildings or new use of
existing buildings for government service agencies are prohibited.
SECTION 2. The Planning Commission is directed to commence the
necessary proceedings, and to prepare proposed zoning legislation for the
future regulation of government service agencies.
SECTION 3. This ordinance is adopted as an interim ordinance as
an urgency measure for the reasons set forth herein, pursuant to California
Government Code Section 65858.
SECTION 4. This ordinance will become effective immediately upon
adoption.
