AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA AMENDING ORDINANCE NO. 1684 MODIFYING MORATORIUM ON THE PROCESSING AND ISSUANCE OF CERTAIN PERMITS FOR APARTMENTS AND CONDOMINIUMS AND DECLARING SAID ORDINANCE AN URGENCY ORDINANCE BE IT ORDAINED by the City Council of the City of National City, California as follows: SECTION 1. This City Council, on May 22, 1979, adopted Ordinance No. 1684 as an interim/urgency measure declaring a "moratorium" on the processing and issuance of permits for apartment and condominium projects. SECTION 2. The Planning Department has subsequently prepared and distributed certain amendments to the Land Use Code, as set forth below. SECTION 3. This City Council finds it to be in the public interest to relax the provisions of said Ordinance No. 1684 for any projects that are designed to meet or exceed those proposed amendments. SECTION 4. The provisions of Ordinance No. 1684 are hereby amended to add: "Projects found by the Director of Planning to meet the following guideline standards may be processed and will be eligible for approval of planned development or planned unit developmentor condominium development or community apartment project permits; "Guideline Standard, Usable Open Space. "The Usable Open Space Standards, set forth in Section 18.14.300 D, increases by a multiplier of 2 (100% increase) and allocated as follows: (1) Not less than 1/3 of such open space, with a minimum dimension of 10 feet, shall be shown as 'private open space,' fenced, screened and isolated for the exclusive use of the dwelling unit to which it is credited. Each dwelling unit shall have such a private open space adjacent thereto. (2) Not less than 1/3 ofsuch open space, with a minimum dimension of 10 feet, shall be shown as 'common open space' used as playlots, picnic areas or similar spe- cialized use. Such common open space shall be screened and isolated for its specific purposes and shall be available for use by all the occupants of the project within which it is located. (3) The remaining open space may be used for landscaped areas, courts, walkways, porches and similar outdoor areas other than parking lots, required yards and setback areas or areas that cannot meet the specifications of Land Use Code Chapter 18.102. (4) Yards and setbacks, except front yards, designed as abutting and integral parts of usable open space will be credited as contributing to the required minimum areas." SECTION 5. BE IT ORDAINED that this Ordinance is adopted as an interim ordinance as an emergency measure for the reasons set forth above and for a period of four months from the date of adoption (unless extended pursuant to Government Code Section 65858).
