HomeMy WebLinkAboutCC ORD 1979-1690 Adds §§ 18.14.240 and 18.128.040; and amends §§ 18.14.220, 18.14.300 C, 18.14.301, 18.14.470 and 18.58.240, zoning (18.14, 18.58, 18.128)ORDINANCE NO. 1690 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA AMENDING NATIONAL CITY MUNICIPAL CODE, TITLE 18, ZONING, REGARDING USE- ABLE OPEN SPACE, OFF-STREET PARKING, ACCESSORY STORAGE, SETBACKS, AND ARCHITECTURAL QUALITY FOR APARTMENTS AND RESIDENTIAL CONDOMIN- IUMS, AND DECLARING SAID ORDINANCE AN URGENCY ORDINANCE. BE IT ORDAINED by the City Council of the City of National City, California as follows': Section 1. This City Council, on May 22, 1979, adopted Ordinance No. 1684 as an interim/urgency measure declaring a Inoratorium" on the processing and issuance of permits for apartment and condominium projects. Section 2. The Planning Department has subsequently prepared a staff report and recommendation for amendments to the National City Land Use Code regarding minimunuseable open space requirements, and other condominium/apartment design standards. The Planning Commission has held a duly noticed public hearing on these proposed changes and has made recommendations to the City Council in regard thereto. Section 3. The City Council has held a duly noticed public hearing on these matters, reviewed the staff report and reccmmendations of the Planning Depart- ment, and the recommendations of the Planning Commission, and approved the amendments described below. Section 4. The City Council finds it to be in the public interest to repeal the moratorium established by Ordinance No. 1684 as amended by Ordinance 1687, and adopt amendments to the National City Municipal Code, Title 18, Zoning as follows: 1. Amend Section 18.14.301, Useable Open Space in apartment projects as follows: 18.14.301 Usable open space in apartment projects A. For projects of eight units or less, a minimum of four hundred square feet of useable open space, inclusive of re- quired yards and courts, shall be provided for each one - bedroom unit; six hundred square feet for each two -bedroom unit; and eight hundred square feet for each three -bedroom unit. Such spaces shall be improved for recreational uses with feasible and logical design. Covered recreation areas may be substituted for up to twenty-five percent of the re- quired open space. Swimming pool areas may be included in required areas. B. For projects of nine units or more, a minimum of four hundred square feet of useable open space, exclusive of required yards and courts, shall be provided for each one - bedroom unit; six hundred square feet for each two -bedroom unit; and eight hundred square feet for each three -bedroom unit. Such space shall be improved for recreational uses with feasible and logical design. Covered recreation areas may be substituted for up to twenty-five percent of the re- quired open space. Swimming pool areas may be included in required areas. (Ord. 1614 S7(part), 1978). C. The useable open space standards set forth above shall be allocated as follows: (1) Not less than 1/3 of such open space, with a minimum dimension of 10 feet, shall be shown as 'private open space,' fenced, screened and isolated for the exclusive use of the dwelling unit to which it is credited. Each dwelling unit shall have such a private open space adjacent thereto. (2) Not less than 1/3 of such open space, with a minimum dimension of 10 feet, shall be shown as 'common open space' used as playlots, picnic areas or similar spec- cialized use. Such common open space shall be screened and isolated for its specific purposes and shall be available for use by all the occupants of the project within which it is located. (3) The remaining open space may be used for landscaped areas, courts, walkways, porches and similar outdoor areas other than parking lots, required yards and setback areas or areas that cannot meet the specifica- cations of Land Use Code Chapter 18.102. (4) Yards and setbacks, except front yards, designed as abutting and integral parts of useable open space will be credited as contributing to the required minimum areas." 2. Amend Section 1-.58.240 Schedule of Parking Requirements - Residential Uses by adding under the column "Off -Street Parking Required", and opposite dwelling, multiple -family, and after the words" ... 2-bedroom or more unit" the following ", and conveniently located guest parking of 1/2 space per unit for 20 units or less, plus 1/4 space for each unit over 20. Half of the required guest parking spaces may include parallel curb parking spaces on dedicated public streets contiguous to the site." 3. Amend Section 18.58.240 Schedule of Parking Requirements - Residential Uses by inserting under the column "Structure and Uses", below "Dwelling, multiple -family", and above "Mobile home parks" the following: "Residential Condominiums", and under the column "Off -Street Parking Required" opposite "Residen- tial Condominiums" the following: "2 spaces per dwelling unit and conveniently located guest parking as required for "dwelling, multiple - family, specified above." 4. Amehd Section 18.14.470 Storage Space as follows: 18.14.470 Storage space. In all apartment house proj- ects, an accessory storage space of not less than 150 cubic feet for each unit plus 50 cubic feet for each additional bed- room more than one and a utility storage area of not less than five square feet shall be provided for each dwelling unit. Screened or enclosed trash areas with not less than thirty - gallon trash receptacles shall be provided not more than two hundred fifty feet from the farthest unit. Amend Section 18.14.220 Required Yards and Setbacks, Table IV, under the column "side yard" by changing from "4" to "5" the entries opposite RS-2, RT, RM-1**, RM-2**, and RM-3**; and under the column "front yard" by changing from "10" to "20" the entries opposite RM-1**, RM-2**, and RM-3**. 6. Amend Section 18.14.240 Front Yard Requirement Variations by adding a new paragraph C as follows: "C. _ Notwithstanding the provisions of 18.14.240 8, the front yard depth in the RM-1, RM-2, and RM-3 zones need not be more than the front yard of an adjoining interior lot in a substantially developed block, but may not be less than ten feet. 7. Amend Section 18.14.300 Yards and Courts in Apartment House Projects, paragraph "C", as follows: "C. An additional five feet shall be added to all side yards, rear yards, and courts for each story above the first floor. Zero side yards may be allowed when two lots are developed as one with a common wall separating units. (Ord. 1614 S7(part), 1978: Ord. 1503 §1(part, 1976: NCLUC g970-6.03:08). 8. Amend Section 18.128.040 Plan Review to add a new item "A.8" as follows: "8. Consistency with adopted guideline standards for architectural quality".' Section 5.
