HomeMy WebLinkAboutCC ORD 1614ORDINANCE NO. 1614 ORDINANCE AMENDING NATIONAL CITY LAND USE CODE TO INCLUDE NEW DEFINITIONS, CORRECT TYPOGRAPHICAL ERRORS, REORGANIZE CERTAIN SECTIONS, DELETE INCONSISTENT OR DUPLICATED PROVISIONS .AND REINSTATE CERTAIN PROVISIONS THAT WERE REPEALED THROUGH THE ADOPTION OF TITLE 18 (A-7-77) BE IT ORDAINED by the City Council of the City of National City as follows: That the Land Use Code be amended as follows: SECTION 1. That to Chapter 18.04 (Definitions), a new Section 18.04.193 be added to read: "18.04.193. Development. 'Development' means the design, construction and related use of real property in any manner requiring compliance with this code." SECTION 2. That to Section 18.04.326 which defines "Hotel," add the word "transient" to line 6; to read: "...accommodations for transient guests." SECTION 3. That to Section 18.14.100 which lists accessory uses permitted in "R" zones, eliminate Subsection B and replace with a new Section 18. 14. 101 to read: "18. 14. 101. Accessory uses, conditions thereon. Accessory uses are subject to the conditions set out in Sections 18.14.110 through 18.14.150, which are listed below." SECTION 4. That to Section 18.16.101 which lists accessory uses permitted in "C" zones, eliminate Subsection B and replace with a new Section 18.16.101 to read: "18.16.101. Accessory uses, conditions thereon. Accessory uses and the conditions of their use are set out in Sections 18.16.110 through 18.16.240, which are listed below." SECTION 5. That to Section 18.18.070 which lists accessory uses permitted in "M" zones, eliminate Subsection B and replace with a new Section 18.18.071, to read: "18.18.071. Accessory uses, conditions thereon. Accessory uses and conditions of their uses are set out in Sections 18.18.080 through 18.18.130, which are listed below." SECTION 6. That to Section 18.14.210 which regulates required frontage in "R" zones, additional language second sentence to read: "All lots in the residential zones shall have a minimum width of fifty feet and a minimum frontage of fifty feet on a dedicated street,..." and, to Section 18.14.210.A, which regulates required frontage in RS-1 zones, the addition of same minimum width requirement to read: "All lots in the RS-1 zone shall have a minimum width of 60 feet and a minimum frontage of 60 feet...." SECTION 7. That to Section 18.14.300, Yards and Courts in Apartment House Projects, delete Section 18.14.300.D and replace with a new Section 18.14.301, to read: "18.14.301. Useable Open Space in Apartment Projects. A. For projects of eight units or less, a minimum of 200 square feet of useable open space, INCLUSIVE of required yards and courts, shall be provided for each one -bedroom unit; three hundred square feet for each two - bedroom unit; and four hundred square feet for each three -bedroom unit. Such spaces shall be improved for recreational uses with feasible and logical design. Covered recreation areas may be substituted for up to twenty-five percent of the required open space. Swimming pool areas may be included in required areas. B. For projects of nine units or more, a minimum of two hundred square feet of useable open space, EXCLUSIVE of required yards and courts, shall be provided for each one -bedroom unit; three hundred square feet for each two - bedroom unit; and four hundred square feet for each three -bedroom unit. Such space shall be improved for recreational uses with feasible and logical design. Covered recreation areas may be substituted for up to twenty-five percent of the required open space. Swimming pool areas may be included in required areas." SECTION 8. That to Section 18.14.340, which regulates building height in "R" zones, addition of a new sentence to read: "Building height limits do not apply to signs; height limit of signs is regulated by Appendix 'A' of this Code." SECTION 9. That to Section 18.16.090, Table V (Use Groups permitted in Commercial Zones), correc- tion of the following entries: Use Groups 9, 10 and 11 - delete letter "C" in the column labeled "CSC" and replace with "-". For the same Use Groups 9, 10 and 11, in the column labeled "CBD", delete current symbols and replace with the letter "Y" to read: CSC CBD 9 - Y 10 - Y 11 - Y To footnote section at bottom of table, add the following: "Y see Section 18.16.271." In Use Groups 4, 5, 7, 14 and 21, transpose all entries in columns labeled "CSC" and "CBD", to read: CSC CBD 4 C 5 - C 7 C - 14 - X 21 C X SECTION 10. That to Section 18.16.310, Table VII, Required Yards and Setbacks in "C" zones, change text of Footnote "f" to read: "f--maximum in CBD zone. See Zoning Map 2 for lesser front yard setbacks that are established by Specific Plan; also see Section 18. 16. 400 of this Title." SECTION 11. That to Section 18.20.030, Table XII, Use Groups Permitted in Institutional Zones, relabel to"Table XIII." SECTION 12. That to Section 18.18.170, Uses Requiring a Conditional Use Permit in the Industrial Zones, delete entire section (section numbers will then read 18.18.160, 18.18.180, etc.) . SECTION 13. That to Section 18.20.100, Required Yards and Setbacks in "I" Zones, delete Section 18.20.100.B and reinstate as a new Section 18.20.101 to read: "18.20.101. Accessory Buildings in Yard Setbacks Prohibited. Accessory buildings shall not be located within any yard setbacks." SECTION 14. That to Section 18.32.010.C, which describes the intent and purpose of the Planned Development Combining Zone, to the second line, change third word to "than", line 3 to read: ..., or industry than would be possible through..." SECTION 15. That to Chapter 18.44 (General Design and Development Regulations) add a list of Chapter titles, to read: "Accessory Structures Chapter 18.46 Drainage Chapter 18.48 Fences, Walls, Hedges Chapter 18.50 Future Street Setbacks Chapter 18.52 Landscaping Chapter 18.54 Lots Chapter 18.56 Off -Street Parking & Loading Chapter 18.58 Outdoor Lighting Chapter 18.60 Signs & Outdoor Advertising Chapter 18.62 Underground Utilities Chapter 18.64 Yards, Courts, Setbacks Chapter 18.66" That to Chapter 18.68 (Specific Use Regulations) , add a list of Chapter Titles, to read: "Automobile Impound Storage Yards See Chapter 18.70 Automotive and Allied Services Uses Chapter 18.72 Condominiums and Community Apartment Projects Chapter 18.74 Conversions to Non-residential Uses Chapter 18.76 Electroplating Chapter 18.78 Helicopter Operations Chapter 18.80 Hide Curing Chapter 18.82 Liquefied Petroleum Gas Facilities Chapter 18.84 Mechanical Equipment Chapter 18.86 Mobile Homes Chapter 18.88 Model Homes Chapter 18.90 Outdoor Display or Sale of Merchandise Chapter 18.92 Outdoor Storage Chapter 18.94 Scrap Metal Processing Chapter 18.96 Service Stations Chapter 18.98 Veterinary Hospitals and Clinics Chapter 18.100" SECTION 16. That to Section 18.58.310, Table XV (Parking Table) , add the following notes: To the top column (above "B") labeled "stall width" add: "(See Sections 18.58.330 and 18.58.340.)" To the top column (above "D") labeled "aisle width," add: "(See G for Public Parking Facilities.) " SECTION 17. That to Section 18.58.490.B, which describesrequired setbacks for parking facilities, add a new phrase to final sentence, to read: "(Except apartment projects of eight units or less pursuant to Section 18.14.400.B.)" SECTION 18. That to Section 18.58.490.C, which describes required setbacks for parking facilities, revise line one to read: "Where a parking facility is on a lot not in an R District but which adjoins an R District along the same street..." SECTION 19. That to Section 18.62.030 (Design Criteria for Signs and Outdoor Advertising), line six, delete the references to Sections 18.134.030 through 18.134.080 in line six. Change to read: "...manner prescribed in Section 18.134.020." SECTION 20. That to Section 18.74.020, add the word "not" to line 14, to read: ....this title will not be approved by the Planning Department." SECTION 21. That to Section 18.76.030, Removal of residential facilities in conversions to non-residential uses, add to last sentence: "....except for employee dining facilities." SECTION 22. That to Section 18.92.020, which lists permitted outdoor displays of merchandise, add following parenthesis to line 5: ....flower shops, building material yards and similar uses (as determined by Planning Director per Section 18.104.030)..." SECTION 23. That to Section 18.94.050, which regulates outdoor storage of materials, from sentence one, delete the words "of a planned development" to read: "During construction and for sixty days there- after..." and, that to Section 18.94.050, change section title to read: "18.94.050. Materials storage during construction." SECTION 24. That to Section 18.108.070, uses made nonconforming by off-street parking, Subsection B-1, change word s even ("equip") to read: "equal" SECTION 25. That to Section 18.108.140, non- conforming uses, termination of operation of law, reword section title to read: "18.108.140. Termination by Operation of Law." SECTION 26. That to Section 18.136.130, which describes the appendices to the Land Use Code, add a new last sentence to read: "The following appendices to the Land Use Code have been adopted or are held in reserve pending adoption: A. Standards for on -premise signs. B. Site development plan check list. C. Guidelines for on -site landscaping. D. Use groups with their respective lists of typical uses. F. Guidelines for Architectural Review (Reserved) G. Guidelines for Aesthetic Qualities and Materials (Reserved) H. Guidelines for Security Lighting in All Zones (Reserved) I. Guidelines for Gradient Selection (Reserved) J. Guidelines for Fence and Wall Construction (Reserved) K. Performance Standards for Noise and Vibration (Reserved) O. Approved Home Occupations (Reserved) T. Specific Plans (Those Affecting Private Property) (Reserved) Z. Criteria for Zone Changes (Reserved)" PASSED AND ADOPTED this l0th day of January, 1978.
