AN ORDINANCE PURSUANT TO LAND USE CODE OF THE
CITY OF NATIONAL CITY, CALIFORNIA
(ZC-3-78, to rezone the residential zoned area bounded
by 4th Street, "R" Avenue, 8th Street, and Palm Avenue,
excluding the half block fronting on 4th Street between
"Q" and "R" Avenues, to add H-15 (Height Limit Combining
Zone, 15' maximum)
WHEREAS, pursuant to the terms and provisions
of the Government Code of California, proceedings were
duly initiated for the rezoning of those parcels of real
property hereinafter described, and for the amendment
of the Land Use Code of the. City of National City, and
WHEREAS, pursuant to due and legal notice,
hearings were held by the City Planning Commission of
said City and also by the City Council of said City,
and all persons interested were given opportunity to
appear and be heard before said Planning Commission and
said City Council, and
WHEREAS, the City Planning Commission of
National City has regularly and duly certified to the
City Council its report and has recommended such rezon-
ing and such amendment;
NOW, THEREFORE, the City Council of the City
of National City, California does ordain as follows:
SECTION 1. All protests, if any, against
said rezoning and said amendment to the Land Use Code,
and each of them, be and hereby are denied and overruled.
SECTION 2. That all the below described real
property is by this Ordinance rezoned to add H-15 (Height
Limit Combining Zone, 15' maximum) to the residential zoned
area bounded by 4th Street, "R" Avenue, 8th Street, and
Palm Avenue, excluding the half block fronting on 4th
Street between "Q" and "R" Avenues:
All of Lots 1 through and including Lot 10
of Block 4 of Bach and Schaule's Subdivision
per Map thereof Number 1072, filed with the
Office of the County Recorder of San Diego
County, California; TOGETHER WITH a strip
of land 10 feet in width lying adjacent to
the Westerly line of said Lot 1, Block 4, being a
portion of vacated "Q" Avenue; TOGETHER with all
of Lots 1 through and including Lot 38 of Block
3 of said Map 1072; TOGETHER WITH a strip of land
10 feet in width lying adjacent to the Westerly
line of said Lots 1 through and including Lot 19,
Block 3, being a portion of vacated "Q" Avenue;
TOGETHER WITH all of Lots 1 through and including
Lot 10 of Block 2 of said Map 1072; TOGETHER WITH
a strip of land 10 feet in width lying adjacent
to the Westerly line of said Lot 1, Block 2, being
a portion of vacated "Q" Avenue; TOGETHER WITH
that portion of said Map 1072 described as follows:
Commencing at the Southeasterly corner of Lot 10,
Block 1 of said Map 1072; Thence Northerly in a
straight line to the Southeasterly corner of Lot
10, Block 2; Thence Westerly along the Southerly
lines of Lots 10 through 1 Block 2, to a point
on the Westerly prolongation of said line, said
point being 10 feet Westerly of the Westerly line
of said Lot 1, Block 2; Thence Southerly, parallel
with the Westerly line of said Lot 1, Block 2, 60
feet; Thence Westerly, at right angles, 30 feet
to a point on the centerline of "Q" Avenue,as
vacated for street purposes; Thence Southerly
along said centerline., parallel with the Westerly
line of Lots 22 and 1, Block 1, to a point of
intersection with the Northerly right-of-way
line of 8th Street as shown on said Map 1072;
Thence at right angles, Easterly in a straight
line through the Southwesterly corner of Lot 1,
Block 1 to the Southeasterly corner of Lot 10,
Block 1, being the point of commencement; TOGETHER
WITH all that portion of the Westerly Half of
the Westerly Half of the Westerly Half of 80
Acre Lot 2, Quarter Section 130, Rancho De La
Nacion, per Map thereof Number 166, on file in
the office of said San Diego County Recorder,
May 11, 1869, described as follows: Commencing
at the Southwesterly corner of said 80 Acre Lot_.
2; Thence North 19° West, along the Westerly
line of said 80 Acre Lot 2, 250 feet; Thence
North 71° East, 30 feet to the TRUE POINT OF
BEGINNING; Thence North 19° West, 50 feet; Thence
North 71° East, 300 feet; Thence South 19° East,
100 feet; Thence South 71° West, 160 feet; Thence
North 19° West, 50 feet; Thence South 71° West,
140 feet to the TRUE POINT OF BEGINNING; Thence
from said TRUE POINT OF BEGINNING; North 19°
West, 110 feet; Thence North 71° East, 260 feet;
Thence North 19° West, 215 feet; Thence North
71° East, 10 feet; Thence North 19° West, 705
feet more or less to a point on a line which
is parallel with and 40 feet Southerly of the
Northerly line of said 80 Acre Lot 2; Thence
South 71° West, along said parallel line, 170
feet; Thence South 19° East, 186 feet; Thence
South 71° West, 100 feet; Thence South 19° East,
in a straight line to the TRUE POINT OF BEGINNING.
PASSED AND ADOPTED this 1st day of August, 1978.

I HEREBY CERTIFY that the foregoing ordinance was not finally adopted
until seven calendar days had elapsed between the days of its introduction
and the days of its final passage, to wit, on

I FURTHER CERTIFY THAT said ordinance was read in full prior to its
final passage or that the reading of said ordinance in full was dispensed
with by a vote of not less than a majority of the members elected to the
Council and that there was available for the consideration of each mem-
ber of the Council and the public prior to the day of its passage a written
or printed copy of said ordinance.
