HomeMy WebLinkAboutCC ORD 1977-1584 Amends §§ 6.42.020(b), 6.42.030, 6.42.040(c), 6.42.050, 6.42.070 and 6.42.080, bingo games (6.42)ORDINANCE NO. 1584 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA AMENDING SECTION 6.42.020, SUBSECTION b, SECTION 6.42.030, SECTION 6.42.040, SUBSECTION c, SECTION 6.42.050, SECTION 6.42.070, SECTION 6.42.080 OF ORDINANCE NO. 1522 RELATING TO BINGO GAMES AND ADOPTING SAID ORDINANCE AS AN URGENCY ORDINANCE BE IT ORDAINED by the City Council of the City of National City that the following sections of Ordinance 1522 be amended to read as follows: SECTION 6.42.020, SUBSECTION b. An ELIGIBLE ORGANIZATION is an organization exempted from the payment of the bank and corporation tax by Sections 23701a, 23701b, 23701d, 23701e, 23701f, 23701g, and 237011 of the Revenue and Taxation Code and by Mobilehome park associations and senior citizens organizations; and provided that the proceeds of such games are used only for charitable purposes. SECTION 6.42.030. It shall be unlawful for any person to conduct any bingo games in the incorporated area of the City of National City unless such person is a member of and acting on behalf of an ELIGIBLE ORGANIZATION described in Subsection b of Section 4.42.020 and has been issued a license as provided by this chapter. SECTION 6.42.040, SUBSECTION c. Proof that the organization is an ELIGIBLE ORGANIZATION as defined by this chapter. SECTION 6.42.050. The fee for a bingo license shall be fifty dollars ($50) . The fee for renewal shall be fifty dollars ($50) . The appropriate fee shall accompany the submission of each application. If an application for a license is denied, one-half of any license fee paid shall be refunded to the applicant. SECTION 6.42.070. Each license issued hereunder shall be issued to a specific person on behalf of a specific ELIGIBLE ORGANIZATION to conduct a bingo game at a specific location and shall in no event be trans- ferable from one person to another nor from one location to another. SECTION 6.42.080. An applicant shall .prove that the organization is an ELIGIBLE ORGANIZATION. an ELIGIBLE ORGANIZATION shall conduct a bingo game only on property owned or leased by it, and which property is used by such organization for an office or for per- formance of the purposes for which the organization is organized. Nothing in this subdivision shall be con- strued to require that the property owned or leased by the organization be used or leased exclusively by such organization. This ordinance is an urgency ordinance necessary for the immediate preservation of the public peace, health, or safety within the meaning of the California Government Code and shall go into immediate effect. The facts constituting such necessity are: In order for this Ordinance to properly implement the constitutional amendment to Section 19 of Article IV of the Constitution, permitting Bingo, which the people of California approved at the June 1976 primary, it is necessary that this Ordinance take effect immediately.
