HomeMy WebLinkAboutCC ORD 1977-1604 Rezone (Special)ORDINANCE NO. 1604 AN ORDINANCE PURSUANT TO LAND USE CODE OF THE CITY OF NATIONAL CITY, CALIFORNIA (ZC-20-77, to rezone from CL [Commercial Limited] to CBD-pD [Commercial Central Business District -Planned Development] the northeast corner of Euclid and Divison) WHEREAS, pursuant to the terms and provisions of the Government Code of California, proceedings were duly initiated for the rezoning of those parcels of real property hereinafter described, and for the amendment of the Land Use Code of the City of National City, and WHEREAS, pursuant to due and legal notice, hear- ings were held by the City Planning Commission of said City and also by the City Council of said City, and all persons interested were given opportunity to appear and be heard before said Planning Commission and said City Council, and WHEREAS, the City Planning Commission of National City has regularly and duly certified to the City Council its report and has recommended such rezoning and such amend- ment; NOW, THEREFORE, the City Council of the City of National City, California does ordain as follows: SECTION 1. All protests, if any, against said rezoning and said amendment to the Land Use Code, and each of them, be and hereby are denied and overruled. SECTION 2. That all the below described real property now zoned CL(Commercial Limited) is by this Ordinance rezoned to CBD-PD (Commercial Central Business District -Planned Development) the northeast corner of Euclid and Division: That portion of Lot 15 of Rancho Mission of San Diego, in the City of National City, County of San Diego, State of California, according to Map thereof made in the action entitled "Juan M. Luco, et al vs. The Commercial Bank of San Diego, et al" under Superior Court Case No. 348 filed in the Office of the County Clerk of San Diego County, described as follows: BEGINNING at the most Westerly corner of Lot 39 of National Vista No. 3 according to Map thereof No. 3210, filed in the Office of the County Recorder of San Diego County April 7, 1955; thence along the Southwesterly line of said Map No. 3210, South-18°.11'00" East, 452.95 feet to the Northwesterly line of the portion of Division Street as described in deed to the City of National City for street purposes, recorded September 13, 1956 in Book 6256, Page 34 of Official Records; thence along the boundary of Division Street and Euclid Avenue as described in said deed to the City of National City as follows: South 71°49'00" West 395.66 feet to the beginning of a tangent 30.00 foot radius curve, concave Northeasterly Northwesterly and Northerly along the arc of said curve through a central angle of 102°44'58" a distance of 53.80 feet to the beginning of a compound 960.00 foot radius curve; Northerly along the arc of said curve through a central angle of 05°47'02" a distance of 96.90 feet; tangent to said curve North 0°21'00" East, 334.55 feet to the beginning of a tangent 10.00 foot radius curve, concave Southeasterly; and Northeasterly along the arc of said curve through a central angle of 71°28'00" a distance of 12.47 feet to the point of Tangency in the Southeasterly line of Beta Street as shown on said Map No. 3210; thence along said Southeasterly line North 71°49'00" East, 283.31 feet to the Point of Beginning.
