HomeMy WebLinkAboutCC ORD 1976-1501 Adopts specific plan for subdivision (Special)%. 01 ORDINANCE NO. 1501 AN ORDINANCE ESTABLISHING A SPECIFIC PLAN PROVIDING FOR CONTINUANCE OF LOT AREA, REAR YARD SETBACK, AND HEIGHT LIMIT REGULATIONS IN THE 0.D. N ARNOLD ESTATES SUWHEREAS, the Planning Commission of National City. on January 12, 1976, recommended to the City Council the adoption of a -Specific Plan providing for continuance of lot area, rear yard setback, and height limit regulations in the O.D. Arnold Estates Subdivision, and WHEREAS, the City Council of National City, on February 17, 1976, conducted a public hearing to consider the recommendation of the Planning Commission, and WHEREAS, at said public hearing all interested persons were given opportunity to appear and be heard before the said City Council, and WHEREAS, the City Council, at their meeting of February 17, 1976, did give first reading of an Ordinance for the adoption of the proposed National City Land Use Code, and WHEREAS, the City Council has determined that it is in the interest of the health, safety, and welfare of the citizens of National City to continue the lot area, rear yard setback, and height limit regulations in the O.D. Arnold Estates Subdivision, and WHEREAS, the Land Use Code provides for the continuation of the lot area, rear yard setback, and height limit regulations in the O.D. Arnold Estates Subdivision by adoption of a Specific Plan, and WHEREAS, the City Council has determined that said Specific Plan will be necessary and convenient to the implementation of the General Plan, and WHEREAS, the City Council has approved the recom- mendation of the City Planning Commission; NOW, THEREFORE, BE IT ORDAINED THAT pursuant to Government Code, Title 7, Article 8 (Authority for the Scope of Specific Plans), the City Council of the City of National City does adopt a Specific Plan for the "O.D. Arnold Estates Sub- division" recorded in Book 6802, Page 380, on file in the office of the Recorder, County of San Diego, specifically requiring that: The minimum building area shall be 10,000 square feet of lot area having a minimum lot width of fifth (50) feet. Any lot shown upon the official recorded maps of the subdivision, containing less than the minimum 10,000 square feet of lot area, shall be deemed a legal building site. No dwelling shall be located on any lot nearer to the rear lot line than twenty (20) feet, or nearer to the front lot line than the setbacks as established and as shown on the official recorded maps of the subdivision. All applications for building permits in excess of one story in height shall require a conditional use permit. PASSED AND ADOPTED this 9th day of March, 1976. KILE MORGAN Mayor ATTEST: lone M.
