HomeMy WebLinkAboutCC ORD 1976-1509 Swimming pools; repeals Ord. 1477 (15.40)ORDINANCE NO. 1509 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA ESTABLISHING REQUIREMENTS FOR AN ANNUAL PERMIT TO OPERATE PUBLIC SWIMMING POOLS, PROVIDING A FEE THEREFOR, PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ORDINANCE NO. 1477 AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH BE IT ORDAINED by the City Council of the City of National City, California as follows: SECTION 1. That Ordinance No. 1477 and all other ordinances and parts of ordinances in conflict with this Ordinance are hereby repealed. SECTION 2. PERMIT REQUIRED. No person shall maintain or operate any swimming pool except a private swimming pool unless an annual operating permit is issued therefor by the Director of Building & Housing. An annual operating permit issued by the Director of Building &Housing is required for the operation of any public swimming pool. SECTION 3. SWIMMING POOL DEFINED. a. PRIVATE SWIMMING POOL is a swimming pool maintained by an individual for the exclusive use of his family and friends and pools for swimming instruction of short duration which are conducted by or sponsored by the American Red Cross. b. PUBLIC SWIMMING POOL includes, but is not limited to, all commercial pools, real estate and community pools, pools at hotels, motels, resorts, auto and trailer parks, mobilehome parks, auto courts, apartment houses, clubs, public or private schools and gymnasiums, and health establishments. SECTION 4. INSPECTION FEE. Every person apply- ing for a permit as required by Section 2 of this Ordinance shall, at the time of making application for such permit, pay an annual inspection fee of forty dollars ($40.00) for the first pool under one ownership and on the same property, and a fee of twenty dollars ($20. 00) for each additional pool on the same property and under the same ownership. EXCEPTION: This section shall not be applicable to any public swimming pool maintained and operated by the City of National City. SECTION 5. FAILURE TO OBTAIN A PERMIT - PENALTY. in any case where the operator of a public swimming has failed for a period of 30 days to file the required application and obtain an annual permit required by Section 2 of this Ordinance, there shall be added to and collected with the inspection fee a penalty equal to 10 percent of the fee; and for each additional month or fraction of a month after the expiration of said 30-day period that the operator fails to file such application and obtain such permit, there shall be added to and collected with the inspection fee an additional penalty equal to 10 percent of the inspection fee; provided, however, in no event shall the total penalty added to the inspection fee be more than 60 percent of the inspection fee. The imposition or payment of the penalty imposed by this section shall not prevent the imposition of any other penalty prescribed by State Law, or City Ordinance, nor shall it prevent a criminal prosecution for violation of this Ordinance. SECTION 6. RENEWAL OF PERMIT - PENALTY FOR DELINQUENCY. A permit issued pursuant to this Ordinance shall be renewed annually. made to the Director application is made, Building and Housing Application for the renewal shall be of Building and Housing. At the time there shall be paid to the Director of the annual fee prescribed by Section 4 of this Ordinance. The annual fee, if unpaid longer than 30 days after the expiration of the previous permit, is delinquent and thereafter a penalty shall be imposed in the manner prescribed in Section 5 of this Ordinance.
