HomeMy WebLinkAboutCC ORD 1976-1546 Interim emergency zoning ordinance (Special)ORDINANCE NO. 1546 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA, ADOPTED AS AN INTERIM ORDINANCE AS EMERGENCY MEASURE" PURSUANT TO SECTION 65858 OF THE CALIFORNIA GOVERNMENT CODE TO AMEND SECTION 18.32.030 OF THE NATIONAL CITY MUNICIPAL CODE TO PROVIDE THAT SINGLE FAMILY RESIDENTIAL STRUCTURES MAY BE CONSTRUCTED ON PARCELS BEARING THE "PD- Planned Development" ZONING DESIGNATION ON THE ZONING MAP, AND WHICH ARE OTHERWISE CORRECTLY ZONED FOR SUCH USE, WITHOUT THE NECESSITY OF COMPLYING WITH THE REQUIREMENTS APPLICABLE TO SUCH "PD" ZONED AREAS. WHEREAS Ordinance #1503, adopted by the City Council on March 16, 1976, requires all new buildings in the "PD" (Planned Development combining zone) zone be subject to compliance with an approved "planned development permit"; and, WHEREAS said Ordinance, now codified as Section 18.32.030, National City Municipal Code, now seems to inadvertently require planned development permits for new single family dwellings in a manner contrary to City policy; and, WHEREAS this Council only intends to require planned development permits for land usage of heavier characteristics than single family dwellings, and finds that no practical purpose can be achieved by strict and literal interpretation of said Section; and, WHEREAS several requests for single family dwelling projects have been frustrated by said requirement; and WHEREAS it is in the public interest to abrogate that frustration forthwith, NOW, THEREFORE, BE IT ORDAINED that pursuant to Section 65858 of the California Government Code, this Council adopts as an "interim ordinance as emergency measure" this Ordinance amending Section 18.32.030 of the National City Municipal Code, to read as follows: 18.32.030 General conditions and use limitations. Wherever the -PD combining zone is shown on the zoning map of the city, the uses of land hereafter commenced therein shall be designed and maintained in compliance with an adopted planned development permit therefor. This shall not require planned development permits for single family dwellings on vacant Zots. Planned development permits are those permits described in Chapter 18.126. Said permits, when adopted in the manner specified herein, shall have precedence over any conflict- ing rules or regulations of this title and shall be subject to enforcement as though they were part of this title. No such use shall be commenced until a planned development permit has been issued therefor as provided herein. -2- BE IT ORDAINED that the Planning Commission be instructed to prepare recommendations for making this interim action permanent, and submit them to the City Council within four months of the date of adoption of this Ordinance. BE IT ORDAINED that this Ordinance shall be effective immediately upon adoption. PASSED AND ADOPTED this ATTEST: ((--7 CITY CLER 14th day of December, 1976.
