That Title 15 of the National City adding al Chapters hereby 34, amended by HISTORICAL BUILDINGS, to read as follows: SECTION 15.34.010. PURPOSE AND SCOPE. The purpose of this Chapter is to establish alternate building regulations for the relocation, preservation re- habilitation, and f buildings or structures designated as Historical Buildings. Such alternate building regulations are for the pur- pose of facilitating the restoration and/or change of occupancy of Historical Buildings to preserve their original architectural features while providing for the health, safety, and welfare of the building occupants and the public. SECTION 15.34.020. LIMITATIONS. No provision of this Chapter shall be construed to authorize the develop- ment, use, or occupancy of any property in violation of the pro- visions of the Zoning Ordinance. SECTION 15.34.030. DEFINITIONS. For the purpose of this Chapter, certain terms are defined as follows: (a) HISTORICAL BUILDING is a building or structure designated by the City Council as a Historical Site. (b) AUTOMATIC SPRINKLER SYS- TEM shall mean an automatic fire extinguishing system of a type con- forming with Uniform Building Standard No. 38-1 and supervised theby a central station approved Fire Chief. SECTION 15.34.040. REQUIREMENTS FOR RELOCATION, RESTORATION, REHABILITATION, OR REPAIR OF HISTORICAL BUILDINGS. (a) General. Relocation, Restoration, Rehabilitation, or repair of His orical Buildings shall comply with f the provisions of this Title except as provided herein. (b) Fire Zone. Regardless of the lo- cation of a Historical Building, all requirements of this Title pertaining to floor area, height, and fire - resistive construction, where applic- able to such building, shall be those appropriate to buildings located in Fire Zone No. 3. (c) Fire Protection. An approved automatic sprinkler system shall be installed throughout the building. 1. The automatic sprinkler system may be used as alternate protection to one -hour fire -resistive exterior or court wall construction and fire - protected openings therein, in loca- tions where exterior wall openings are permitted by this Title, provided the sprinkler system includes sprinkler heads on the exterior of the building. 2. Projections beyond an exterior wall ‘7711 ./A < ORDINANCE NO. 1456 AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA AMENDING TITLE 15 OF THE CODE BYRELATING TO SPECIAL REGULATIONSICIPAL PERTAINING TOADDING THE RELOCAT ON1CHAPTER5.34 REHABILITATION, AND PRESERVATION OF HISTORICAL BUILDINGS such as balconies, exterior stairways, and roof overhangs, may extend into any yard or court where fire - protected openings in exterior walls are allowed, provided the automatic sprinkler system includes sprinkler heads on the exterior of the building in such locations. 3. On street -front facades, balconies, canopies, columns, doors, windows, signs and all miscellaneous trim may be constructed of wood. 4. Wood windows and plain glass may be used in locations where exterior wall openings are required to be fire - protected by this Title, and the window area need not be limited. 5. Parapet walls which would violate the historic authenticity of the building, may be omitted. 6. An approved product of combustion detection system, other than heat, shall be installed throughout the building. (d) Attics. If mechanical equipment is installed in an attic area of a Historical Building, such attic area shall be enclosed by means of materials approved for one -hour fire - resistive construction on the equip- ment side. Access doors shall be self - closing, tight -fitting, and of solid wood of 13/8 inch minimum thickness. Ducts piercing this enclosure shall be constructed of not less than No. 26 gauge galvanized steel. (e) Stairways. All existing stairways which do not comply with the re- quirements of this Title shaft be well lighted and be provided with ap- proved handrails on each side. Such stairways, however, shall not be used to satisfy the exit requirements of this Title. Additional complying stair- ways shall be provided. (f) Safety Glazing. All existing glazing in Historical Buildings which is subject to human impact and does not comply with the safety glazing requirements of this Title shall be provided with an approved protective device. (g) Change in Occupancy. Existing one and two-story residential build- ings may be used for certain com- mercial occupancies without making such buildings comply with all re- quirements of this Title applicable to new commercial buildings, provided all of the following conditions are met. 1. The commercial use shall be of a type which entails an average com- bustible loading of ten pounds per square -foot of floor area or less. 2. The commercial use shall entail occupancy by generally able-bodied persons who are awake and active. 3. The commercial use shall not in- volve any hazardous operations or the handling or use of highly flammable or explosive materials. 4. The commercial use shall entail no addition to, or enlargement of such building. 5. Requirements of this Title pertain- ing to exits, toilet facilities, and ventilation in commercial occu- pancies, shall be complied with. 6. The floor structure of such build- ing shall be shown to be adequate for the live load appropriate to the com- mercial use as specified in this Title. 7. The commercial use shall be com- patible with the zoning for the area in which the building is located. (h) Facilities for physically handi- capped persons shall be provided as set forth in this Title and California State regulations. SECTION 15.34.050. PROCEDURE (a) Compliance Survey. An applicant requesting approval for the reloca- tion, restoration, rehabilitation, or repair of a Historical Building pur- suant to this Chapter, prior to sub- mission of a building permit applica- tion plans, and specifications, shall request a Compliance Survey inspec- tion as provided in this Title. (b) Report of Structural Survey. A report of structural survey shall be submitted to the Director of Building and Housing at the time of applica tion for a building permit. Su report shall indicate clearly wheth or not the building is an unsafe structure, and shall indicate any corrective measures, where appro- priate. (c) Submission of Plans. Building plans and specifications definin work necessary to make the Hist Building comply with the re ments of this Title shall also be submitted to the Director of Building and Housing with the permit applica- tion. (d) Completion of the Project. Upon satisfactory completion of all work required for rehabilitation pursuant to this Chapter, the Director of Building and Housing may issue a Certificate of Occupancy. (e) Appeals. Appeals from decisions of the Director of Building and Housing or Fire Chief in the applica- tion of this Chapter may be made to the Advisory and Appeals Board, in accordance with the provisions of this Title.
