ORDINANCE NO. 1458
AN ORDINANCE AMENDING ORDINANCE NO. 962, ZONING
ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA
TO PROVIDE LOCATIONAL CRITERIA, DEVELOPMENT STANDARDS,
AND OPERATIONAL STANDARDS FOR OFF-STREET
PARKING LOTS OPEN TO THE PUBLIC
WHEREAS, pursuant to the terms and
provisions of the Government Code of
California, proceedings were duly
initiated for the amendment of Or-
dinance No. 962, Zoning Ordinance of
the City of National City, and
WHEREAS, pursuant to due and legal
notice, hearings were held by the City
Planning Commission of said City and
also by the City Council of said City
and all persons interested were given
opportunity to appear and be heard
before said Planning Commission and
said City Council, and
WHEREAS, the City Planning Com-
mission of the City of National City
has legally and duly certified to the
City Council its report and has recom-
mended such amendments, and
WHEREAS, the City Council has ap-
proved the recommendation of the City
Planning Commission;
NOW, THEREFORE, THE CITY
COUNCIL OF THE CITY OF NATIONAL
CITY, CALIFORNIA, DOES ORDAIN AS
FOLLOWS:
SECTION 1. All protests, if any,
against said amendments to Ordinance
No. 962 and each of them be and
hereby are denied and overruled.
SECTION 2. There is hereby added to
Section 10-D of Ordinance No. 962 a
new sub -paragraph 6 as follows:
6. Abatement
It is the purpose of these regula-
tions that off-street parking fa-
cilities open for public use shall be
designed, operated and maintained
in a manner consistent with reason-
able standards of public conven-
ience and safety. The Planning
Director shall advise the City Coun-
cil whenever the design, operation
or maintenance of any such facility
fails to fulfill the purpose(s) of
this ordinance. Upon receiving such
advice, the City Council may
schedule a Public Hearing thereon.
The City Clerk shall give ten (10)
days written notice of such an
abatement hearing to the property
owner (to consider abatement of
the objectionable features) of any
such facility. 'Upon finding cause
for abatement, after the hearing,
the City Council may order speci-
fied improvements in the design,
operation or maintenance of such a
parking facility to be accomplished
within a period of not more than
180 days of the date of such order,
the exact time of abatement to
set by the City Council as a pa
of the abatement order. A propert
owner's failure to comply with any
such order of abatement shall be
a violation of these zoning regula-
tions (Ordinance 962, as amended)
and may be cause for a finding by
the City Council that the use of
such property is a public nuisance.
All parking facility improvements
shall comply with the provisions of
Ordinance 1306 for "Site Plan
Review". Improvements subject to
review include, but are not limited
to driveways, access to streets and
alleys, arrangement of parking
stalls, aisles and maneuvering
areas, signs and traffic control
devices, striping, surfacing, light-
ing, landscaping pedestrian walk-
ways, fire access ways, obstruc-
tions, traffic flow and protective
barriers.
The City Council may, as a part
of such proceedings, order the
closure and/or relocation of drive-
way openings to public or private
streets or alleys.

until seven calendar days had elapsed
between the day of its introduction and
the day of its final passage, to wit, on
February 18, 1975 and on February 25,
1975.

said ordinance in full was dispensed
with by a vote of not less than a ma-
jority of the members elected to the
Council, and that there was available
for the consideration of each member
of the Council and the public prior to
