HomeMy WebLinkAboutCC ORD 1975-1472 Establishes setback plan (Special)1472 ORDINANCE NO. 1472 AN ORDINANCE ESTABLISHING A SPECIFIC PLAN FOR A SETBACK ON PALM AVENUE BETWEEN DIVISION STREET AND 4TH STREET WHEREAS, the Planning Commission of National City on May 19, 1975 adopted its Resolution No. 4-75 recom- mending to the City Council the estab- lishment of a 25' building setback from the street right-of-way along the east- erly side of Palm Avenue between Division Street and 4th Street, and WHEREAS, the City Council of Na- tional City on June 24, 1975 held a public hearing to consider the recom- mendation of the Planning Commission, and WHEREAS, at said public hearing the City Council took the testimony of interested parties and heard and con- sidered the recommendations of the Planning Commission and other members of the City staff; NOW, THEREFORE, BE IT ORDAINED that: SECTION 1. Findings. The City Council of National City finds and determines that it is in the best interest of the public health, safety and welfare to establish a building setback on Palm Avenue be- tween Division Street and 4th Street, and the City Council finds and deter- mines that the establishment of said setback line is necessary to prevent further encroachments within the right- of-way necessary for future street improvements, and the City Council finds and determines that traffic safety and proper traffic management require the future widening of Palm Avenue between Division Street and 4th Street, and the City Council finds and deter- mines that future widening will neces- sitate a minimum 25' building setback from the street right-of-way along the easterly side of Palm Avenue between Division Street and 4th Street, and the City Council finds and determines that present and future construction projects are occurring and will occur within the necessary future street right-of-way, thereby increasing the cost and dif- ficulty of future construction, and the City Council finds and determines that the establishment of a twenty-five foot building setback line will facilitate the orderly development of the neighborhood for the future. SECTION 2. Establishment of a Speci- fic Plan of Setback. The City Council hereby establishes a twenty-five foot building setba from the street right-of-way alon easterly side of Palm Avenue bet Division Street and 4th Street, all o the foregoing being public streets within the City of Notional City. SECTION 3. Building Permit Instruc- tions. No building permits shall be issued to allow the construction of any struc- tures within the new building setback line.
