HomeMy WebLinkAboutCC ORD 1974-1421 Adopts 1973 building code; repeals Ord. 1259 (15.08)i ORDINANCE NO. 1421 s.-4 AA off. ,) AN ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA, ADOPTING THE UNIFORM BUILDING CODE, VOLUME 1, 1973 EDITION AND THE APPENDIX THERETO, EXCEPTING CHAPTER 70, PROVIDING PENALTIES FOR THE VIOLA- TION THEREOF AND REPEALING ORDINANCE NO. 1259, AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES OF SAID CITY IN CONFLICT THEREWITH 1421- SECTION 2. There is hereby adopted by the City Council of the City of National City for the purpose of pre- scribing regulations governing the erection, construction, enlargement, alteration, repair, moving, removal, s demolition, conversion, occupancy, equipment use, height, area, fire re- s sistance, and maintenance of all buildings •and/or structures, that cer- tain code known as the Uniform Build- t ing Code, Volume 1 and Appendix b thereto, excepting Chapter 70, pub- lished by the International Conference s of Building Officials, being particularly t the 1973 Edition thereof, save and t s except such portions as are hereinafter deleted, modified, or amended, of 0 0 which code not less than three (3) copies have been and are now on file in p the office of the Clerk of the City of r National City and the same are hereby 0 adopted and incorporated as fully as if set out at length herein, and from the date on which this Ordinance shall be controlling within the limits of the s City of National City. SECTION 3. Section 204 of the code a adopted by this Ordinance is hereby a amended to read as follows: Section 204. BOARD OF APPEALS. I The Advisory and Appeals Board, estab- D lished by City Ordinance No. 1324 shall w determine the suitability of alternate t materials and methods of construction; d provide reasonable interpretations of the provisions of this code; and shall c recommend to the City Council such h new legislation as is consistent there- with. Q The decisions of the Director of sh Building and Housing in interpreting re the provisions of this code; the refusal to issue any permit required by this code; and any action in issuing a Correction Notice of Notice to Abate a Public Nuisance may be appealed to the Advisory and Appeals Board. All such appeals shall be made in accord- ance with procedures set forth in Sec- tion 7 of City Ordinance No. 1324. SECTION 4. Section 205 of the code adopted by this Ordinance is hereby deleted. SECTION 5. A new Section 205 is hereby added to the code adopted by this Ordinance to read as follows: days, said building or structure is, for val the purpose of this section, an unsafe per building and is hereby declared to be a public nuisance. Such public nuisance Rep shall be abated in accordance with the me procedures specified in Section 203 of cha thi SECTION 205. ABANDONED CON- STRUCTION WORK. Any abandoned building or structure or portion thereof in an incomplete condition inherently constitutes injury hazards and is other- wise dangerous to health, safety, and the public welfare by reason of un- protected trenches and excavations, projecting structural elements, open pipe systems, exposed electrical con- ductors, and/or other conditions char- acteristic of construction projects. (a) GENERAL. Whenever any building or structure, for which construction work has been authorized by a permti issued pursuant to this code, is aban- doned in such an incomplete condition for a period in excess of 120 calendar (b) NOTICE TO PERMIT HOLDER. The Director of Building and Housing shall give to the permit holder of such abandoned constructoin work written notice stating that such work is in violation of this section. A copy shall be provided to the owner of record. This notice may require the permit holder, within 24 hours, to commence either the completion of said aban- doned construction work in accordance with approved plans and specifications The City Council of the City of National City, California, does ordain as follows: SECTION 1. That Ordinance No. 1259 of the City of National City, and all other ordinances and parts of or- dinances in conflict with this Or- dinance are hereby repealed. or the demolition and removal of portions of the construction work f the premises. All required correc work shall be completed within a t limit specified by the Director of Bu ing and Housing. SECTION 7. Section 301 (a) of the ode adopted by this Ordinance is ereby amended to read as follows: Section 301 (a). PERMITS RE- UIRED. No person, firm or corporation all erect, construct, enlarge, alter, pair, move, improve, remove, convert, or demolish any building or structure in the City of National City, or cause the same to be done, without first ob- taining a separate building permit for each such building or structure from the Director of Building and Housing. EXCEPTIONS: 1. Fences and free-standing walls not over six feet (6') in height located in residential zones. 2. Retaining walls and planter boxes not over three feet (3') in height. 3. Patio covers up to 100 square feet in area and at least six feet (6') from any other buildings. 4. One-story tool and storage sheds and other accessory buildings with not more than 100 square feet of projected roof area. 5. Television and radio towers sup- ported on roofs. 6. Awnings projecting not over six feet (6') where supported by the exterior walls of buildings of Group I or J occupancy. 7. Standard electroliers not over thirty-five feet (35') in height above finish grade. 8. SECTION 9. Section 304 of the code adopted by this Ordinance is hereby amended by adding subsections (f) and e- (g) to read as follows: 304 (f). COMPLIANCE SURVEY IN- SPECTION. Upon receipt of a written request for a compliance survey from the owner and after the fee specified in this section has been paid, the Di- rector of Building and Housing may inspect an existing building or structure to ascertain its compliance with the provisions of this code and other ap- plicable laws and ordinances, and re- port his findings in writing to such owner. 304 (g). RE INSPECT IONS. A re - inspection fee may be assessed for each reinspection pursuant to Section 303 (c). This subsection is not to be con- strued to mean that reinspection fees shall be required the first time work is rejected for failure to comply with requirements of this code, but as a control over the practice of calling for inspections before work is ready for such inspections or reinspections. Reinspection fees may be assessed by the Director of Building and Housing whenever it is apparent that the in- spection staff is being used to provide on-the-job supervision of work rather than for the performance of proper inspection duties as specified in this code. To obtain a reinspection, the per- mittee shall file an application therefor in writing upon a form provided for that purpose, and shall pay the re - inspection fee specified in Section 303 (c). Where reinspection fees have been assessed by the Director of Building and Housing no additional inspection work shall be performed until the required fees have been paid. SECTION 10. Section 308 is hereby added to the code adopted by this Ordinance to read as follows: Section 308. STREET NUMBERS. Every principal building or structure located within the incorporated limits of the City of National City shall be identified by a designating street number as issued by the Director of Building and Housing. Said designating street number shall be of sufficient size and contrasting color to appear read- able from the adjacent street or public way. SECTION 11. Section 502 of the code adopted by this Ordinance is hereby amended to read as follows: Section 502. No change shall be made in the character of occupancies or use of any building which would place the building in a different divi- sion of the same group of occupancy or in a different group of occupancies, unless such building is made to comply with the requirements of this code for such division or group of occupancy. EXCEPTION: The character of the occupancy of existing buildings may be changed subject to the approval of the Director of Building and Housing, and the building may be occupied for pur- poses in other groups without conform- ing to all the requirements of this code for those groups, provided the new or proposed use does not result in a hazard, based on life and fire risk. greater than that of the existing use. SECTION 12. Section 512 is hereby added to the code adopted by this Or- dinance to read as follows: Section 512. FIRE PROTECTION. All premises where buildings or portions of buildings are hereafter constructed shall comply with Section 13.301 of the cur- rently adopted edition of the Uniform Fire Code. SECTION 13. Section ' 1502 of the code adopted by this Ordinance is hereby amended by adding to the first paragraph thereof an exception to read as follows: EXCEPTION: Agricultural and nursery shade structures used only for the pro- tection of live plants and vegetation, when covered with non-combustible or plasticized materials which are in- herently flame retardant and which are approved for exterior use, may exceed 1,000 square feet in area. SECTION 14. Section 1503 of the code adopted by this Ordinance is hereby amended by adding thereto as follows: Agricultural and nursery shade struc- tures used only for the protection of live plants and vegetation, when cov- ered with non-combustible or plasti- cized materials which are inherently flame retardant and which are approved for exterior use, shall be located only in Fire Zone 3, and shall not be less than ten feet (10') from any adjacent property line if the covered area ex- ceeds 1,000 square feet. SECTION 15. Section 1709 (a) of the code adopted by this Ordinance is hereby amended to read as follows: Parapets. Section 1709 (a) General. Parapets shall be provided on all ex- terior walls of buildings, except as fol- lows: 1. Walls not required to be of fire - resistive construction. 2. Walls which terminate at roofs of not less than two hour fire resistive construction or roofs constructed en- tirely of noncombustible materials. 3. Walls where unprotected openings are permitted. 4. Walls on buildings having a floor area of not more than 1,000 square feet per floor. 5. Walls on buildings of Group H, I, or J occupancy not more than 25 feet in height and provided with a fire re- tardant roof covering. 6. Conversion of existing Group I occupancy of Group F occupancy. SECTION 16. Section 1807 (a) of the code adopted by this Ordinance is hereby amended to read as follows: Section 1807 (a). SCOPE. These re- quirements apply to buildings housing Group F, Division 2 Occupancies used primarily as offices and to Group H Occupancies. Such buildings having floors used for human occupancy located more than 40 feet above the lowest level of Fire Department vehicle access shall con- form to the requirements of this Section in addition to other applicable require- ments of this Code. SECTION 17. Section 2314 (d) of the code adopted by this Ordinance is hereby amended to read as follows: Section 2314 (d). Minimum Earth- quake Forces for Structures. 1. Total lateral force and distribu- tion of lateral force. Except as pro- vided in Section 2314 (d) 2 and Sec- tion 2314 (d) 4, every structure shall be designed" 'and constructed to with- stand minimum total lateral seismic forces assumed to act nonconcurrently in the direction of each of the main axes of the structure in accordance with the following formula: V=ZKCW (14-1) The value of K shall be not less than that set forth in Table No. 23-1. The value of C shall be determined in accordance with the following formula: 0.05 (14-2) C=3✓ T For all 'one -and two-story buildings or structure the value of C shall be not less than 0.10. For other buildings the maximum value of C need not exceed 0.10. EXCEPTION: C exceeds 0.10 where indicated in Table No. 23-1. T is the fundamental period of vibration of the structure in seconds in the direction under consideration. Properly substan- tiated technical data for establishing the period T may be submitted. In the absence of such data, the value of T for buildings shall be determined by the following formula: 0.05h„ T (14-3) D EXCEPTION: In all buildings in which the lateral force resisting system con- sists of a moment -resisting space frame which resists 100 percent of the re- quired lateral forces and which frame is not enclosed by or adjoined by more rigid elements which would tend to prevent the frame from resisting lateral forces: T=0.10N (14-3A) The total lateral force V shall be dis- tributed in the height of the structure in the following manner: F=.004Vf h: 1 (14-4) D l F need not exceed 0.15 V and may be con- sidered as 0 for values( h of 3 or less, and t D., F, = (Y - F) w, h. (14-5) n E a' h, i = 1 EXCEPTION: One- and two-story buildings shall have uniform distribution. At each level designated as x, the force F shall be applied over the area of the building in ac- cordance with the mass distribution on that level. 2. Structures having irregular shape or framing systems. The distribution of the lateral forces in structures which have highly irregular shapes, large dif- ferences in lateral resistance or stiff- ness between adjacent stories or other unusual structural features shall be determined considering the dynamic characteristics of the structure. 3. Lateral force on parts or portions of buildings or other structures. Parts or portions of buildings or structures and their anchorage shall be designed for lateral forces in accordance with the following formula: F,, = ZC,,W (14-6) The values of C are set forth in Table No. 23-j. The distribution of these forces shall be according to the gravity loads pertaining thereto. 4. Dynamic Analysis. Nothing in Section 2314 shall be deemed to pro- hibit the submission of properly sub- stantiated technical data for establish- ing the lateral design forces by a dynamic analysis. 5. Pile Foundations. Individual pile or caisson footings of every building or structure shall be interconnected by ties each of which con carry by tension and compression a horizontal force equal to 10 percent of the larger pile cap load- ing unless it can be demonstrated that equivalent restraint can be provided by other approved methods. SECTION 18. Section 2314 (i) of the code adopted by this Ordinance is here- by amended to read as follows: Section 2314 (i) Setbacks. Buildings having setbacks wherein the plan dimension of the tower in each direc- tion is at least 75 percent of the cor- responding plan dimension of the lower part may be considered as a uniform building without setbacks, providing other irregularities as defined in Sec- tion 2314 (d) 2 do not exist. Buildings having such irregularities shall conform to the provisions of Section 2314 (d)2. Other setback buildings shall conform to the provisions of Section 2314 (d)2. SECTION 19. Section 2314 (j) of the code adopted by this Ordinance is here- by amended to read as follows: SECTION 2314 (j) Structural Systems. 1. Design requirements. All buildings designed with a horizontal force factor K equals 0.67 or 0.80 shall have space frames -ductile moment resisting. Buildings more than 160 feet in height shall have space frames -ductile moment resisting capable of resisting not less than 25 percent of the required seismic forces for the structure as a whole. EXCEPTION: Buildings more than 160 feet in height in Seismic Zone No. 1 may have concrete shear walls designed in conformance with Section 2627 of this Code in lieu of a ductile moment resisting space frame, provided a K value of 1.00 or 1.33 is utilized in th design. In Seismic Zones No. 2 and No. all members in braced frames of equals 1.0 and K equals 1.33 buildings shall be designed for 1.5 times the force determined in accordance with Section 2314 (d) 1. Connections shall be designed to develop the full capacity of the members or shall be bosed on stresses without the one-third increase usually permitted on those re- sulting from earthquake forces. In Seismic Zones No. 2 and No. 3 concrete space frames required by de- sign to be part of the lateral force resisting system and all concrete frames located in the perimeter line of vertical support be space frames -ductile mo- ment resisting. EXCEPTION: Frames in the perimeter line of the vertical support of buildings designed with shear walls taking 100 percent of the design lateral forces need only conform with the following paragraph. In Seismic Zones No. 2 and No, 3 framing elements not required by de- sign to be part of the lateral force resisting system shall be investigated and shown to be adequate for vertical load -carrying capacity and induced moment due to four times the distor- tions resulting from the Code required lateral forces. The rigidity of other elements shall be considered in accord- ance with Section 2314 (e). If the framing elements do not have sufficient deformation capacity within their strength range, then deformation capacity shall be provided by ductility or other means. Moment resisting space frames and ductile moment resisting space frames may be enclosed by or adjoined by more rigid elements which would tend to prevent the space frame from re- sisting laferal forces where it can be shown that the action or failure of the more rigid elements will not impair the vertical and lateral load resisting ability of the space frame. Other structural concepts may be approved by the Building Official when evidence is submitted showing that equivalent ductility and energy absorption are provided. 2. Construction. The necessary duc- tility for a ductile moment -resisting space frame shall be provided by a frame of structural steel with moment resisting connections (complying with Section 2722 for building in Seismic Zones No. 2 and No. 3 or Section 2723 for buildings in Seismic Zone No. 1) or by a reinforced concrete frame (com- plying with Section 2626 for buildings in Seismic Zones No. 2 and No. 3 or Section 2625 for buildings in Seismic Zone No. 1) . Braced frames in buildings shall be composed of axially loaded bracing members of A36, A440, A441, A572 (except Grades 60 and 65) or A588 structural steel; or reinforced concrete members conforming to the require- ments of Section 2627. Reinforced concrete shear walls for all buildings shall conform to the re- quirements of Section 2627. In buildings where K equals 0.67 and K equals 0.80, all structural elements below the base 2 required to transmit seismic forces to the foundation shall be composed of structural steel (complying with Sec- tion 2722 for buildings in Seismic Zones No. 2 and No. 3 or Section 2723 for buildings in Seismic Zone No. 1) or by reinforced concrete (complying with Section 2626 for buildings in Seismic Zones No. 2 and No. 3 or with Section 2625 for buildings in Seismic Zones No. 1 and with Section 2627 for buildings in Seismic Zones Nos. 1, 2, and 3.) SECTION 20. Section 2609 (d) of the code adopted by this Ordinance is hereby amended to read as follows: Section 2609 (d) Required Strength. The required strength U provided to resist dead load D and live_ load L shall be at least equal to U = 1.5D + 1.8L (9-1) In the design of a structure or member, if resistance to the structural effects of a specified wind load W must be included in the design, the following combinations of D, L, and W shall be e investigated in determining the greatest required strength U. 3 U-0.75 (1.5D + 1.8L + 1.7W K (9-2) where the cases of L having its full 'value or being completely absentshall both be checked to determine the'most severe condition, and U = 0.9D + 1.3W (9-3) but in any case the strength of the Member or structure shall not be less than required by Formula (9-1 ). Where earthquake loads are a con- sideration, the requirements of the pre- ceding paragraph shall apply except that 1.1E shall be substituted for W in Formulas (9-2) and (9-3). Load factors contained in Section 2626 and Section 2627 shall be used where applicable. If lateral earth, pressure H must be included in design, the strength 'U shall be at least equal to 1.5D plus 1.8L plus 1.8H but where D or L reduce the effect of H, the corresponding coeffici- ents shall be taken as 0.90 for D and zero for L. EXCEPTION: Where lateral earth pressures have been estimated by "at rest" soil theory instead of "active" cr "Rankine" soil theory and such pres- sures are equal to or exceed an equiva- lent fluid pressure of 50 p.c.f., 1.5H may be used instead of 1.8H as re- quired in the above paragraph. This is allowed only on the basis of an in- vestigation, performed by qualified persons, conforming to the requirements of Section 2905 for foundation in- vestigations. For lateral pressures from liquids F, the provisions of the para- graph preceding the. exception shal! apply, except the 1.5F shall be sub- stituted for 1.8H. The vertical pressure of liquids shall be considered as dead load, with due regard to variation in liquid depth. Impact effects if any, shall be in- cluded with the live load L. Where the structural effects of dif- ferential settlement, creep, shrinkage, or temperature change may be signifi- cant, they shall be included with the dead load D and the strength U shall be at least equal to 0.75 (1.50D plus 1.8L). Estimations of differential settlement, creep, shrinkage, or temperature change shall be based on a realistic assessment of such effects occurring in service. SECTION 21. Section 2611 (q) of the code adopted by this Ordinance is hereby amended to read as follows: Section 2611 (q) Special Provisions for Walls. Design for horizontal shear forces in the plane of the wall shall be in accordance with this Section. The nominal sheaf stress, v shall be computed by 'Jilted by -"-cAht (11-31) Where d shall be taken equal to 0.81 . A larger value of d, equal to the distance from the extreme compression fiber to the center of force of all reinforcement in tension, may be used when determined by a strain com- patibility analysis. The shear stress carried by the concrete, v„ shall not be taken greater than the lesser value computed from c=3.3V7+41 h and yr=0.6 + 1 (1.25V},'.' + 0.2 I} U 2 (11-32) (11-33) where N is negative for tension. EXCEPTION: N when in compression shall be taken as zero for buildings located in Seismic Zone No. 3 when considering earthquake loads. However, v. may be taken as 2✓ f' if N is compression or Section 2611 (c) 4 may be applied if N is tension. When v is less than v./2, reinforcement shall be provided in accordance with Section 2614 except that in Seismic Zone No. 3 the minimum required ratio for Ph and P is 0.0025. P. When v exceeds v,/2, wall reinforcement for resisting shear shall conform to the fol- lowing: The area of horizontal shear reinforce- ment shall be not less than that computed by Formula (11-13). The ratio Ph, of horizontal shear reinforcement area to the gross con- crete area of vertical sections shall be at (east 0.0025. The spacing of horizontal shear reinforcement shall not exceed 1./5,3h, nor 18 inches. The ratio of vertical shear reinforcement area to gross concrete area of horizontal section shall be not less than 0.0025 nor less than the value of Ph required by the pre- ceeding paragraph. The spacing of vertical shear reinforcement shall not exceed 1w/3,3H, nor 18 inches. Horizontal wall elements required by de- sign to be part of the lateral force system shall be designed for induced vertical shear forces in the plane of the wall and, in addi- tion, shall meet all other requirements for beams when carrying vertical loads as a beam. The shear stress shall be computed from Formula (11-3). The shear stress car- ried by the concrete V shall be as given by Section 2611 (e). The ratio P of vertical shear reinforcement area to the gross con- crete area of horizontal sections shall be at least 0.0025. The ratio of horizontal re- inforcement Ph shall be not less than 0.0025 nor less than the required value of Ph. The spacing of vertical and horizontal reinforce- ment shall not exceed d/3, 3h nor 18 inches. Where torsion exists, the requirements of Sections 2611 (h) and (i) shall be satisfied. The total design shear stress V. at any section shall not exceed 10✓ f', except that, when considering earthquake loads, the average horizontal shear stress for at wall piers sharing a common lateral force component shall not exceed 817' . The average horizontal shear stress shall be com- puted from Formula (1 1-31) using the sum of all wall pier hd areas for the hd term of of the Formula. Design for shear forces perpendicular to the face of the wall shall be in ac- cordance with provisions for slabs in Section 2611 (k). SECTION 22. Section 3312 (b) of the code adopted by this Ordinance is here- by amended to read as follows: Section 3312 (b) Exit Signs. Any sign required by this code shall be a non- combustible, internally illuminated sign. The word "exit" shall be lettered in green on a white or opaque back- ground, and the letters shall be at least six inches in height with the principal strokes of the letters 3/4 inch in width. At every required exit doorway, and wherever otherwise required to clearly indicate the direction of egress, an exit sign shall be provided for all areas serving the occupant load specified in this subsection. In interior stairways, the floor level leading directly to the exterior shall be clearly indicated. 1. Group A occupancies and Group B, D, and H occupancies with an oc- cupancy load of more than 50. 2. All other occupancies serving an occupancy load of more than 100. EXCEPTION: Main exterior exit doors which obviously and clearly are identifi- able as exits need not be sign -posted when approved by the Director of Building' and Housing. SECTION 23. Section 3802 CID) of the code adopted by this Ordinance is here- by amended by adding item 12 to read as follows: Section 3802 (b) 12. In every build- ing regardless of occupancy group or type of construction when such build- ing is more than 40 feet or 4 stories or more in height. SECTION 24. Section 6002 of the code adopted by this Ordinance is hereby amended to read as follows: Section 6002. The U.B.C. Standards which are referred to in various parts of this code shall be the Uniform Building Code Standards, 1973 Edition, and the same are hereby declared to be a part of this code. SECTION 25. Section 6003 of the code adopted by this Ordinance is hereby deleted. SECTION 26. Section 6004 of the code adopted by this Ordinance is here- by deleted. SECTION 27. DELETIONS FROM APPENDIX. The following deletions are hereby made to the Appendix of the code adopted by this Ordinance: Chapter 70 and Section 2314 (i) are hereby deleted. SECTION 28. Section 4901 of the Appendix of the code adopted by this Ordinance is hereby amended to read as fol lows: Section 4901. Patio covers are one- story roofed structures not more than 10' above grade and used for recrea- tional or outdoor living purposes. Patio structures shall be open on two or more sides with a clear height of not less than 6'8" from floor to soffit of sup- porting members. The open sides shall not obstruct the free passage of light and air except that they may be en- closed with insect screen (16 x 16 mesh minimum) and solid walls to a height of not more than 3' above adjacent grade. Patio covers may be attached or detached and permitted only as acces- sory to Group J, Group I, or single dwelling units in Group H occupancies. Patio covers shall not be used as car ports, garages, habitable rooms, o storage structures. SECTION 29. Section 4904 is hereby added to Chapter 44 of the Appendix of the code adopted by this Ordinance to read as follows: Section 4904: A patio cover may be supported on a concrete slab on grade without footings, provided the slab is not less than 3-1/2 inches thick and provided the columns do not support live and dead loads in excess of 750 pounds per column.
