HomeMy WebLinkAboutCC ORD 1974-1442 Rezone (Repealed by 1503)1\�f�Cll� C.i Lt( vCd4. r G.uii3 1442✓ ORDINANCE NO. 1442 AN ORDINANCE AMENDING ORDINANCE NO. 962, ZONING ORDINANCE OF THE CITY OF NATIONAL CITY, CALIFORNIA (ZC-2-74 to Add Open Space Overlay Zoning to the Ca!trans Property, Southwest Corner of 24th Street and Newell/ WHEREAS, pursuant to the terms and provisions of the Government Code of California, proceedings were duly ini- tiated for the additon of Open Space Overlay Zoning of those parcels of real property hereinafter described, and for the amendment of National City Zoning Ordinance No. 962, and WHEREAS, pursuant to due and legal notice, hearings were held by the City Planning Commission of said City and also by the City Council of said City, and all persons interested were given opportunity to appear and be heard before said Planning Commission and said City Council, and WHEREAS, the City Planning Com- mission of National City hos regularly and duly certified to the City Council its report and has recommended such additional zoning and such amendment; NOW, THEREFORE, the City Council of the City of National City, California does ordain as follows: SECTION 1. All protests, if cny, against said odditionai zoning and said amendment to Ordinance No. 962, and each of them, be and hereby ore denied and overruled. SECTION 2. Section 5.13 is hereby added to Ordinonce No, 962 and shall read as follows: Section 5.13. That all the below described real property now zoned R-4-PD (Residential Planned Develop- ment Zone) is by this Ordinance zoned OS (Open Space Overlay Zone) in ad- dition to above zone designation: All that certain real property lying and being in the County of San Diego, State of California, described as: Those portions of Lots 41, 42 and 45 of Lincoln Acres according to Map No. 1740, filed December 6, 1922 in the Office of the Recorder of San Diego County, described as follows: Beginning at the Northwest corner of said Lot 45; thence along the Northerly line of said Lot 45 N 72°02'39"E , 50.02 feet to the Westerly right of way line of the Westerly frontage rood of State freeway 11-SD-805-9.5; thence along said right of way line, the following three courses: (1) S.14°08'24"E., 95.66 feet; (2) S.12°07'40"E., 258.68 feet; (3) along a tangent curve to the right, having a radius of 270.00 feet, through an angle of l5°06'07", a distance of 71.17 feet to the Southerly line of said Lot 41; thence along said Southerly line, S.72°12' 30"W., 101.25 feet to the Southerly prolongation of the Westerly line of Lot 46 of said Lincoln Acres; thence along said prolongation, N.17°55' 00"W., 199.65 feet to the Northerly line of said Lot 42; thence along said Northerly line N72° 17'00"E., 99.99 feet to the Southwest comer of said Lot 45; thence along the Westerly line of said Lot 45. N.17°55'00"W., 22231 feet to the Point of Beginning. RESERVING unto the State of Cali- fornia its successors and assigns, o, easement for highway slopes o and across that portion of the ala_�. described property described as fo lows: Beginning at the Northerly terminus of course (1) above; thence along above described courses (1), (2) and (31 to the Southerly terminus of said course (3); thence along t Southerly line of said Lot S.72°12'30"W., 10.63 feet; thene leaving said Southerly line, N.25°09 53"E., 17.60 feet; -thence N.15°19' 45"W., 192.69 feet; thence N.07°47' 16"W., 219.92 feet to the Point of Beginning. PROVIDED however, that owner or owners of the fee title underlying said slope easement retains the right at any time to remove such slopes or portions thereof upon removing the necessity for maintaining such slopes or portions thereof or upon providing in place thereof other adequate lateral support, the design and con- struction of which shall be first approved by the State Department of Transportation for the protection and support of the adjacent State high- way. There shall be no abutter's rights of access appurtenant to the above described real property in and to the adjacent State freeway. The bearings and distances used in the above description are on the California Coordinate System, Zone 6. Subject to special assessments, if any, restrictions, reservations and easements of record.
