HomeMy WebLinkAboutCC ORD 1973-13561356 ORDINANCE NO. 1356 AN ORDINANCE PROVIDING FOR SPECIAL EVENT PEDDLERS LICENSE WHEREAS, the Nation& City business license ordinance does not contain a category of occupation to provide licensing for one day special events such as parades and circuses, and WHEREAS, it has been brought to the attention of the City Council that numerous out of town businessmen are corning to Nation& City, maintaining no fixed place of business in this community, and engage in business activities for the duration of special events, and WHEREAS, the present minimum business license fee is levied contemplating a businessman with a fixed place of business in National City who makes other contributions to the economy and who does not present special enforce- ment problems, and WHEREAS, transient businessmen of various types who come to National City for special events and then leave the corporate limits present special problems of business license enforcement and revenue collection; NOW, THEREFORE, BE IT OR- DAINED that Ordinance No. 708 is amended to add the following sub -sections to Section 31, Special Events Vendors License: a. Any person not maintaining a properly licensed fixed place of business within the City of National City who engages in any busness activity including, but not limited to, peddling, vending, and hawking, whether from a vehicle, or on foot, or from a portable stand, or otherwise during, prior to, or immediately after, a special event, as hereinafter defined must obtain a "Special Event Peddlers License" and pay for the fee therefor. b. A special event is any occasion of public celebration occurring within the City of National City including parades, rodeos, circuses, carnivals, concerts, festivals, dances, and the like. The City Council may from time to time, by resolution, designate those functions and activities which are to be considered "special events" within the meanin this ordinance. Such resolution designate the hours ,during which "special event" is considered to be occurring for the purposes of this ordinance. c. The City Treasurer shall issue one day "Special Event Peddlers Licenses" to persons applying therefor for a daily fee of $50.00. In the event a "special event" is designated by the Council to occur over a period of time greater than 24 hours, then an additional $50.00 daily fee shall collected for each 24-hour period, or thereof exceeding the fixed 24-hour p of such an event. d. Charitable and non-profit organiza- tions may apply to the City Council for exemption from the requirements of this ordinance, and the Council, in its discretion, may grant exemption from all or a part of the license fee called for herein to qualified charitable and non- profit organizations. e. Violation a Misdemeanor. Any person who engages in the activities described herein as Section (a) without obtaining the license herein required is guilty of a misdemeanor for the violation of which such person may be fined a sum not to exceed $500.00 and imprisonment for a period not to exceed 6 months.
