ORDINANCE NO. 1359
AN ORDINANCE AMENDING
ORDINANCE NO. 962, ZONING
ORDINANCE OF THE CITY OF
NATIONAL CITY, CALIFORNIA
(ZC-14-72, to Rezone from C-3-B, General
Commercial, to R-4, Multiple Family
Residence, the Property at and near the
Northeasterly Corner of the Intersection
of Highland Avenue and Eta Street, known
as Delta Park Apartments)
WHEREAS, pursuant to the terms and
provisions of the Government Code of
California, proceedings were duly
initiated for the rezoning of those parcels
of real property hereinafter described,
and for the amendment of National City
Zoning Ordinance No. 962, and
WHEREAS, pursuant to due and legal
notice, hearings were held by the City
Planning Commission of said City and
also by the City Council of said City, and
all persons interested were given
opportunity to appear and be heard before
said Planning Commission and said City
Council, and
WHEREAS, the City Planning
Commission of National City has
regularly and duly certified to the City
Council its report and has recommended
such rezoning and such amendment:
NOW, THEREFORE, the City Council
of the City of National City, California
does ordain as follows:
SECTION 1. All protests, if any against
said rezoning and said amendment to
Ordinance No. 962, and each of them, be
and hereby are denied and overruled.
SECTION 2. Section 4.96 is hereby
added to Ordinance No. 962 and shall read
as follows:
Section 4.96. That all the below
described real property now zoned C-3-B,
General Commercial Zone, is by this
ordinance rezoned to R-4, Multiple Family
Residence Zone:
That portion of Lot 69 of the Map of a
portion of Ex -Mission Lands of San Diego
(commonly known as Horton's Purchase)
in the City of National City, County of San
Diego, State of California, according to
Map thereof No. 283, filed in the office of
the County Recorder of San Diego County,
March 9, 1878, described as follows:
Commencing at a point which is 981.75
feet South and 1217.70 feet West of the
Northeast corner of said Lot 69, being a
point on the Southwesterly line of said Lot
69 and being also the Southwesterly corner
of land described in deed to Robert P.
Harvey, et ux, recorded November 18',
1968 as File No. 201274; thence along the
Southerly line of said Harvey's land,
North 89 degrees 34'41" East, 41.71 feet
(Record -North 89 degrees 40'00" East,
41.72 feet) to the Southwesterly corner of
that portion of said Lot 69 as described in
deed to the City of National City for street
purposes (now known as Eta Street),
recorded November 18, 1971 as File No.
269345; thence along the boundary of said
Eta Street as follows: North 89 degrees
34'41" East, 337.89 feet (Record -North 89
degrees 40'00" East, 337.88 feet) to a
corner therein; North 15 degrees 38'19"
West, (Record -North 15 degrees 33'00"
West) 20.73 feet to a corner therein; South
89 degrees 34'41" West, (Record -South 89
degrees 40'00" West) 33.62 feet to the
beginning of a tangent 425.00 foot radius
curve, concave Southerly; and westerly
along the arc of said curve through a
central angle of 09 degrees 04'08" a
distance of 67.27 feet to the point of
reverse curvature therein; thence leaving
said boundary North 16 degrees 38'19"
West, 174.90 feet to the beginning of a
tangent 52.00 foot radius curve, concave
Southeasterly; thence Northeasterly
along the arc of said curve through a
central angle of 54 degrees 45'10" a
distance of 49.69 feet to the beginning of a
reverse 30.00 foot radius curve; thence
Northeasterly along the arc of said curve
through a central angle of 24 degrees
29'08" a distance of 12.82 feet to the TRUE
POINT OF BEGINNING; thence
retracing last three above described
courses as follows: Southwesterly along
the arc of said 30.00 foot radius curve
through a central angle of 24 degree
29'08" a distance of 12.82 feet to the
beginning of a reverse 52.00 foot radius
curve; Southwesterly along the arc of said
curve through a central angle of 54
degrees 45'10" a distance of 49.69 feet; and
tangent to said curve South 16 degrees
38'19" East, 174.90 feet to the Westerly
terminus of said 425.00 foot radius curve,
concave Southerly, in the Northerly
boundary of said Eta Street as herein -
above described; thence retracing along
the boundary of said Eta Street as follows:
Easterly along the arc of said curve
through a central angle of 09 degrees
04'08" a distance of 67.27 feet; North 89
degrees 34'14" East, 33.62 feet to a corner
therein; and South 15 degrees 38'19" East,
20.73 feet to the Southerly line of said Eta
Street; thence along said Southerly line
and the Westerly prolongation thereof,
South 89 degrees 34'41" West, 379.60 feet to
the Southwesterly line of said Lot 69, being
also the Northwesterly corner of land
secondly described in deed to Frank
Agliano, recorded March 11, 1944 in Book
1639, Page 364 of Official Records; thence
along the boundary of said land last above
referred to, as follows: along the South-
westerly line of said Lot 69, South 16
degrees 54'03" East, 20.86 feet (Deed-20.00
feet) to a corner therein; North 89 degrees
34'41" East, 669.09 feet (Deed -East 675.00
feet) to a corner therein; and North 00
degree 25'19" West, (Deed -North) 20.00
feet to the Southerly line of land first
described in said deed to Agliano
hereinabove referred to; thence along
said Southerly line North 89 degrees 34'41"
East, 293.00 feet; thence leaving said
Southerly line North 02 degrees 30'00"
West, 289.00 feet; thence South 83 degrees
00'00" West, 69.00 feet; thence North 69
degrees 00'00" West, 95.00 feet; thence
North 45 degrees 00'00" West, 103.3
thence North 57 degrees 21'24" Wes
feet; thence South 89 degrees 38'36"
13.00 feet, more or less, to the Southerly
prolongation of the Easterly line of Bucky
Subdivision, according to Map thereof No.
5359, filed in the office of the County
Recorder of San Diego County, March 12,
1964; thence along said prolongation
North 00 degree 23'34" West, (Recor
North 00 degree 21'36" West) 15.00
the Southeasterly corner of sai
Subdivision; thence along the Sou
line of said Bucky Subdivision South 89
degrees 38'36" West, ( Record -South 89
degrees 37'32" West) 464.84 feet to the
most Westerly corner of land described in
deed to McMillin Construction Company,
Inc., recorded December 1, 1971 as File
No. 278752; thence along the South-
westerly line of said land and the South-
easterly prolongation thereof, South 16
degrees 38'19" East, (Record -South 16
degrees 33'00" East) 217.62 feet to a line
which is parallel with and 12.00 feet South-
easterly of and measured at right angles
to the Northwesterly line of said Harvey's
land first hereinabove referred to; thence
Southeasterly along a straight line a
distance of 2.00 feet, more or less, to the
TRUE POINT OF BEGINNING.
EXCEPTING THEREFROM all that
portion lying Easterly of the Southerly
prolongation of the Easterly Tine of Bucky
Subdivision, Map Number 5359, filed in the
office of the County Recorder of San Diego
County.
