ORDINANCE NO. 1361
AN ORDINANCE GRANTING A RIGHT
OF ENTRY TO AUTHORIZED CITY
OFFICIALS FOR THE INSPECTION OF
BUILDINGS AND PREMISES FOR THE
ENFORCEMENT OF THE PROVISIONS
OF THE NATIONAL CITY,
CALIFORNIA ORDINANCES
BE IT ENACTED BY THE CITY
COUNCIL OF NATIONAL CITY,
CALIFORNIA AS FOLLOWS:
Section 1. Whenever necessary to make
an inspection to enforce any ordinance or
resolution, or whenever there is
reasonable cause to believe there exists
an ordinance or resolution violation in any
building or upon any premises within the
jurisdiction of the City, any authorized
official of the City of National City, may,
upon presentation of proper credentials,
enter such building or premises at all
reasonable times to inspect the same or to
perform any duty imposed upon him by
ordinance; PROVIDED, that except in
emergency situations or when consent of
the owner and/or occupant to the
inspection has been otherwise obtained,
he shall give the owner and/or occupant, if
they can be located after reasonable
effort, twenty-four hours written notice of
the authorized officials' intention to
inspect. The notice transmitted to the
owner and/or occupant shall state that the
property owner has the right to refuse
entry and that in the event such entry is
refused, inspection may be made only
upon issuance of a search warrant by a
duly authorized magistrate. In the event
the owner and/or occupant refuses entry
after such request has been made, th
official is hereby empowered to se
assistance from any court of compete
jurisdiction in obtaining such entry.
Section 2. All other ordinance sections
which grant any official of this City any
right of entry are hereby repealed.
Section 3. This ordinance shall be
published and become effective as
provided by law.

of May, 1973.

May 8, 1973 by the following vote, to -wit:
Ayes: Councilmen Camacho, Pinson,
Waters, Morgan.
Nays: Councilmen None
Absent: Councilmen Reid
Abstain: Councilmen None

foregoing ordinance was not finally
adopted until seven calendar days had
elapsed between the day of its
introduction and the day of its final
passage, to wit, on May 1, 1973 and on May
8, 1973.
I FURTHER CERTIFY THAT said
ordinance was read in full prior to its final
passage or that the reading of said
ordinance in full was dispensed with by a
vote of not less than a majority of the
members elected to the Council, and that
there was available for the consideration
of each member of the Council and the
public prior to the day of its passage a
written or printed copy of said ordinance.
