ORDINANCE NO.1383
AN ORDINANCE AMENDING
ORDINANCES 962, 803, 1181, 1288, AND
REPEALING ORDINANCE 1316,
RELATING TO CONDOMINIUM
PROJECTS
(Code Amendment No. A-9-73)
WHEREAS, pursuant to the terms and
provisions of the Government Code of
California, proceedings were duly
initiated for the amendment of National
City zoning ordinances, and
WHEREAS, pursuant to due and legal
notice, hearings were held by the City
Planning Commission of said City and
also by the City Council of said City, and
all persons interested were given
opportunity to appear and be heard before
said Planning Commission and said City
Council, and
WHEREAS, the City Planning
Commission of National City has
regularly and duly certified to the City
Council its report and has recommended
such amendment;
NOW, THEREFORE, THE CITY
COUNCIL OF THE CITY OF NATIONAL
CITY, CALIFORNIA, DOES ORDAIN AS
FOLLOWS:
SECTION 1. All protests, if any,
against said amendment to Ordinances
962, 803, 1181, 1288 and each of them, be
and hereby are denied and overruled.
SECTION 2. Ordinance No. 962 is
amended and changed by adding to
Section la thereof a new subparagraph W,
which shall read as follows:
"W. CONDOMINIUMS
1) New condominium and community
apartment projects shall comply with all
the zoning regulations applicable to
apartment house projects.
2) Condominium Conversion.
Apartment house projects proposed for
conversion to condominium or community
apartment projects shall be made to
comply with existing zoning regulations.
At such time as any multiple family
dwellings are to be converted from
individual corporate or partnership
ownership to a condominium or
community apartment form of ownership,
those persons desiring,to make such
conversion shall submit to the Planning
Department a complete set of site
development plans for Site Development
Plan Approval in accordance with Section
10-T of this ordinance. Condominium
conversion projects which do not conform
with and which cannot be made to
conform with all the requirements and
standards for new apartment house
projects as specified in the Zoning
Ordinance as amended and
supplemented, will be disapproved by the
Planning Department."
SECTION 3. Ordinance No. 803 is
amended and changed by adding to
Section 3 thereof, a new subparagraph A,
which shall read as follows:
"(A) Condominiums
Subdivision maps will be required for all
condominium projects of 5 condominiums
or more and community apartment
projects of 5 parcels or more, as defined in
Section 11535.1 of the Subdivision Map Act
of the State of California, except where the
site of the condominium or community
apartment is already a "one -lot
subdivision" (lot of record). In case
requiring Subdivision Map submittals, th
Final Subdivision Map shall be
accompanied by the following companion
documents specified in Section 1351 and
1355 of the California Civil Code:
1. Diagrammatic Floor Plans
2. Certif icate of Consent
3. Declaration of Covenants,
Conditions, and Restrictions (Form and
Content to be approved by the City
Attorney and to include a determination
that the funds provided by the
maintenance provisions of the covenants
and restrictions will be sufficient to cover
all contemplated costs.)
In cases not requiring subdivision map
submittal, the companion documents
specified above shall be submitted with
the site development plan required by
Section 10-T, Ordinance No. 962, Zoning
Ordinance of the City of National City."
SECTION 4. Ordinance No. 1181 is
amended and changed by adding to
Section II-2, following the words" . (5)
or more lots or parcels" the following
phrase:
"and condominium projects of 5
condominiums or more and community
apartment projects of 5 parcels or more as
defined in Section 11535.1 of the
Subdivision Map Act of the State of
California whether such projects are new
or are conversion from other form of
ownership."
SECTION 5. Ordinance No. 1288 is
amended and changed by adding to
Section 1, Article 2302-b thereof, a new
subparagraph which shall read as
olhws:
"The term 'dwelling unit' for the
purpose of this article shall also include a
condominium unit or a unit of an existing
multiple family dwelling which is to be
sold as a condominium as defined by the
Civil Code of the State of California."
SECT ION 6. Ordinance No. 1316
requiring condominium and community
apartment project to comply with
residential planned unit development
standards of Ordinance No. 1116 is hereby
repealed in its entirety.

introduction and the day of its final
passage, to wit, on September 4, 1973 and
on September 11, 1973.

passage or that the reading of said
ordinance in full was dispensed with by a
vote of not less than a majority of the
members elected to the Council, and that
there was available for the consideration
of each member of the Council and the
public prior to the day of its passage a
written or printed copy of said ordinance.
