HomeMy WebLinkAboutCC ORD 1973-1384 Adds W to § 10 of 962, zoning (Repealed by 1503)-r-i5ucz 1384 ORDINANCE NO. 1384 AN ORDINANCE AMENDING ORDINANCE NO. 962 TO ADD PROVISIONS FOR AN EQUESTRIAN PARK (A-5-73) WHEREAS, pursuant to the terms and provisions of the Government Code of California, proceedings were duly initiated for the amendment of Ordinance No. 962, Zoning Ordinance of the City of National City, and WHEREAS, pursuant to due and legal notice, hearings were held by the City Planning Commission of said City and also by the City Council of said City and all persons interested were given opportunity to appear and be heard before said Planning Commission and said City Council, and WHEREAS, the City Planning Commission of the City of National City has legally and duly certified to the City Council its report and has recommended such amendments, and WHEREAS, the City Council has approved the recommendation of the City Planning Commission. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. All protests, if any, against said amendment to Ordinance No. 962, and each of them be and hereby are denied and overruled. SECTION 2. There is hereby added to SECTION 10 of Ordinance No. 962, a new paragraph, hich shall read: Eq strian Park Overlay Zone When y property bears on the zoning the City of National City in ition to its zone designation, as described in Section 4 hereof the symbol "E", the provisions of this paragraph shall apply thereto. 1. Equestrian Park Zone Regulations In areas designated "E", Equestrian Parks (including Public Riding Stables and Riding Academies) shall be a permitted use subject to the issuance of a Conditional Use Permit. In addition to the required findings for the approval of Conditional Use Permits, it shall also be required that: a. An Equestrian Park shall have a minimum ten (10) acres. b. Any building or enclosure in which horses are contained shall be distant at least one hundred feet (100') from any school, church, or other building used for human habitation. c. The horses must be maintained 1 an enclosure. d. Stable or paddock locations shall be submitted to the Planning Department for approval. e. A maximum limit on the number of horses permitted on any lot or parcel may be established by the City Council upon recommendation of the Plann Commission. This number may excess of the number permitted in areas of the City pursuant to the Anima Regulation Ordinance (Ordinance No. 891) . f. The sanitary regulations as stated in ad the Animal Regulation Ordinance (Ordinance No. 891) shall be strictly enforced. g. Any horse(s) presently being maintained in conformity with the regulations of either the City of Natdonal City or the County of San Diego on the effective date of this ordinance as applied to the property where said horses are being maintained may continue to be so maintained in accordance with said rules. h. Other specific conditions regarding animal keeping, shelter, or sanitation, as may be specified by the Planning Commission or City Council.
