ORDINANCE NO. 129.3
AN EMERGENCY INTERIM ZONING ORDINANCE
ESTABLISHING STANDARDS FOR THE INSTALLATION
AND MAINTENANCE OF DRIVEWAYS AND PARKING LOTS
BE .IT ORDAINED by the City Council of the City of
National City, California, as follows:
SECTION 1. All off-street parking areas and the
driveways incidental thereto, except required driveway ap-
proaches, thall be surfaced with minimum four inch (4") thick
portland cement concrete or paved with minimum three inch
(3") thick asphalt .surfacing or minimum two. inch (2".) thick
asphalt surfacing over a four inch (4") base of compacted
material approved by the City Engineer. All such paving shall
thereafter be properly maintained.
SECTION 2. All parking areas and driveway paving
in existence on th.e .effective date of this Ordinance shall
within 30 .days be improved and repaired to eliminate all
chuckholes, drainage puddles, hazards and obstructions to
vehicular and pedestrian use. For the purpose of this re-
quirement, said 30 day period shall commence on the day the
Planning Directcar sends notice by certified mail to th.e
property owner listed in th.e current San Diego County Tax
Roll, as owner of the property where improvements and repairs
are required. The action of the Planning Director may be
appealed in writing to the Planning Commission within 40 days
after the day it is sent. Such appeals shall beconsidered
by the Planning Commission in the same manner as a zoning
violation. The decision of the Planning Commission shall
be final.
SECTION 3. This ordinance is adopted as an interim
zoning ordinance pending a study and report on the subject
from the National City Planning Commission; and, unless other-
wise extended by the City Council, the ordinance shall expire
by own terms 90 days after adoption.
SECTION 4. The City. Council has been informed that
various parking lots which are now open to the public within
the City of National City exist in a dangerous and defec-
tive condition which constitutes an immediate hazard to the
health, safety and welfare of citizens of National City by
virtue of said parking lots and driveways being left in a
state of disrepair which make them dangerous for use by members
of the public and the City Council finds and determines that
the public health, safety and welfare require the adoption
of this ordinance as an emergency measure .for the immediate
preservation of the public health, safety and welfare.
