ORDINANCE NO. 1298
AN ORDINANCE AMENDING
CHAPTER 65 OF THE . NA-
TIONAL CITY MUNICIPAL
CODE RELATING TO THE LI-
CENSING AND USE OF BI-
CYCLES AND REPEALING
ORDINANCE NO. 895
BE IT ORDAINED by the
City Council of the City of Na-
tional City that Chapter 65 of
the Municipal Code of the City
of National City is hereby
amended to read as follows:
Article 650
General
6 5 0 0 . BICYCLES" DE-
FINED. A bicycle is a two-
w h e el e d vehicle propelled
wholly by muscular power,
either or both of which wheels
exceeds 12" in diameter."
Article 651
Bicycle Licenses
6510. It shall be unlawful for
any person to operate or use
a bicycle upon any of the
streets, alleys or highways in
the City of National City without
first obtaining a license there-
for.
6511. I SSUANCE, LIFE,
EFFECT OF LICENSE. The
City of National City is hereby
authorized and directed to issue,
upon written application a bi-
cycle license which shall be
effective during the period of
time such licensee retains title
to such bicycle, but, in no event
longer than ten (10) years,
which license when issued shall
entitle the licensee to operate
such bicycle upon the streets,
alleys and public highways in
this City in accordance with
traffic regulations.
6512. PLATES, SEALS, CARDS.
The City shall provide metallic
license plates or seals together
with registration cards.
6512.1 LICENSE NUMBERS.
Said metallic license plates or
seals and registration cards
shall have numbers stamped
thereon.
6512.2 NUMBERING, STAMP-
ING. Such metallic license
iplatesseals shall bestamped numericalorder and the
letters N.C.P.D. stamped thereon.
6512.3 TYPES OF PLATES.
S ch metallic license plates or
seals shall be suitable for at-
tachment upon the frames of
bicycles.
6512.4 ATTACHING OF LI-
CENSE. One such metallic
license plate or seal. shall be;,
attached to the frame of each
bicycle, and a corresponding
registration card shall be issued
to the licensee upon payment
of the license fees herein pro-
vided.
6512.5 USE OF PLATE. Such
*metallic license plate or seal
shall remain attached during
the existence of such license.
, 6512.6 RECORDS. The Chief of
Police shall keep a record of
the date of issue of each license,
to whom issued, and the
number thereof.
6513. TAMPERING WITH NUM-
BERS. It is unlawful for any
person to wilfully or maliciously
remove, destroy, mutilate or
alter the numbers of any
bicycle frame licensed pursuant
to this Chapter.
6513.1 TAMPERING WITH
PLATE, SEAL, CARD. It is
unlawful for any p lain to
remove, destroy, mor
alter any license plate, seal or
registration card during the
time in which such license
plate is operative. Provided,
however, that
65.13.2 STAMPING OF
FRAME NL'•MB:E.RS. Nothing in
this Chapter shall prohibit the
stamping of numbers on the
frame of bicycles on which no
serial number can be found, or
on which said number is
illegible or insufficient for
identification purposes.
6514. LICENSE FEE: REGIS-
TRATION. The license fee to
be paid for registration and
licensing of a bicycle shall be
one dollar ($1.00).
6514.1 TRANSFER FEE. For
registration and licensing when
there is a transfer of ownership,
the new owner shall pay one
dollar ($1.00).
6514.2 LOST PLATE. For lost
or destroyed license plate or
seal a new number shall be
issued for which the owner shall
pay fifty cents ($0.50).
6514.3 PAYMENT. All fees
shall be paid in advance.
Article 652
Transfer of Bicycle
6521. REPORT OF TRANS-
FER. It is the duty of every
person rs

report such sale or transfer by
returning to the Chief of Police
the registration card issued to
such person as licensee thereof,
together with the name and
address of the person to whom
said bicycle was sold, or trans-
ferred, and such report shall
be made within five (5) days
of the date of said sale or trans-
fer.
6522. TRANSFER OF REGIS-
TRATION. It is the duty of the
purchaser or transferee of such
bicycle to apply for a transfer
of registration therefor, within
five (5) days of said sale or
transfer.
6523. DEALERS' REPORTS.
Every person engaged in the
business of buying or selling of
new or secondhand bicycles in
this City shall file with the Chief
of Police a monthly report,
giving:
6523.1 SELLER OR BUYER.
The name and address of the
person from whom or to whom
a bicycle is purchased or sold.
6523.2 DESCRIPTION. The
description thereof.
6523.3 FRAME NUMBER. The
frame number thereof, and
6523.4 LICENSE NUMBER.
The number of the license plate,
if any, attached to said bicycle.
Article 653
Use of Bicycles
6531. CYCLING ON SIDE-
WALKS. It is unlawful for any
person to ride a bicycle upon
a sidewalk within any business
or residence district of the City
of National City, provided, that

RESOLUTION. The Council
m a y , by resolution duly
adopted, authorize the riding of
bicycles on the sidewalks of
such residential districts or
area with such limitations as
to hours and specific purposes
as they may deem proper.
6533. VIOLATION: MISDE-
MEANOR. It is a misdemeanor
for any person to violate any
of the terms or provisions of
this Chapter or to use a bicycle
in and upon any street, alley,
park or other public place in
this City, or upon any path or
lane set aside for the exclusive
use of bicycles within this City,
without complying in all re-
spects with the terms and provi-
sions of this Chapter.
6534. PARENT'S LIABILITY.
It is a misdemeanor for any
parent or guardian or any child
or of anyone who has the cus-
•
tody or control of any child in
this City to knowingly permit
such child to use a bicycle in
this City in violation of the
terms and provisions of this
Chapter.
Article 654
Enforcement
6541. PENALTili..,S FOR VIO-
LA.T'IONS. Every person con-
victed of a violation of any pro-
visions of this Chapter shall be
guilty of a misdemeanor and
shall be punished by a .fine of
not more than fifty dollars
($50.00) or by imprisonment for
not more than ten (10) days.
or by removal or suspension of
the license to operate a bicycle
within this City for a period
not to exceed thirty (30) *lays,
or by impounding the bicycle
of the person convicted for 'a
period not to exceed thirty (30)
days, or by any or all said
penalties or any combination
thereof.
6542. IMPOUNDING OF BI-
CYCLES. The Chief of Police
shall also have authority, in the
event that any juvenile or
person under the age of twenty-.
one (21) years is found violating
any provision of this Chapter
to take and impound the bicycle
of such juvenile or minor se
found violating such- Chapter,
and to hold the same for a
period not to exceed thirty (30)
days, during which said time
the Chief of Police shall notify -
the parents or guardian or other
person having the custody and
control of said juvenile or minor
of such offense.
